Chapter I General Provisions

Article 4 The lawful rights and interests of dog-keeping shall be protected in accordance with the law; dog-keeping shall not jeopardize the interests of the public **** and the lawful rights and interests of others.

Article 5 The people's governments at all levels are responsible for the organization and implementation of these regulations, the establishment of public security, urban management, aquatic animal husbandry and veterinary medicine, industry and commerce, health and other departments of dog management coordination mechanism.

The administrative departments in accordance with the division of responsibilities, each responsible for its own:

(a) public security organs are responsible for dog registration, capture and kill rabid dogs, shelter abandoned dogs, investigate and deal with illegal dog breeding and other acts;

Article 7 Associations and other civil organizations related to dog-raising shall actively advocate civilized dog-raising, strengthen self-discipline, and assist in publicity, education and other work in dog-raising management.

Chapter II immunization, registration

Article 11: Individuals raising dogs in key management zones shall meet the following conditions:

(1) have legal identification;

(2) have full capacity for civil behavior;

(3) have a fixed abode and the abode is not within the prohibited dog-raising area;

(4) have a legally valid certificate of immunization of dogs;

(5) have no abandoned dogs in the last three years;

(6) have no abandoned dogs in the last three years;

Article 12 The application for keeping dogs by units in key management areas shall comply with the following conditions:

(3) sound dog Management system;

Article XIII of the key management area units, individuals raising dogs, shall inform the residence of the villagers' committee, the community residents committee or owners' committee of residential district, and signed a guarantee of the obligation to raise dogs.

Article XIV of the key management areas within the individual application for dog registration, the dog breeder shall submit the following materials to the residence of the Public Security Police Station:

(a) dog registration application form;

(b) the dog breeder's identity certificate;

(c) proof of immunization of the dog;

(d) conformity with the provisions of the dog photograph;

(e) ) Guarantee of the obligations of the dog owner.

If a unit in a key management area applies for registration of dog-keeping, it shall provide the following materials to the public security police station at its place of residence:

(1) application form for dog-keeping registration;

(2) certificate of the unit and other relevant supporting materials;

(3) certificate of immunization of the dog;

(4) photo of the dog in conformity with the regulations.

Units and individuals keeping dogs imported from abroad, should also have the entry inspection and quarantine institutions issued by the entry-exit quarantine certificate.

Article XV of the Public Security Police Station shall receive applications for dog breeding within 20 working days from the date of application, to meet the conditions, to be registered and issued a dog registration certificate and dog identification tags, to the dog set up an electronic identification mark; not registered, it shall explain the reasons. Acceptance of the unit application, shall conduct field verification.

Article XVI of the dog registration card is valid for 1 year. The expiration of the need to continue to raise dogs, dog owners should be valid 10 days before the expiration of the validity of the dog immunization certificate and dog registration card to the original registration authority to apply for continuation of the procedures.

Article XVII of the key management area of the dog keeper of one of the following circumstances, shall hold the dog registration certificate to the residence of the public security organs for change, cancellation or replacement procedures:

Article 18 If a permitted dog breeds puppies, the dog breeder shall, within 90 days from the date of birth of the puppies, transfer the dogs exceeding the limited number to another person or send them to a dog shelter and rescue place.

Article 19 of the public security organs shall establish key management areas of dog management electronic files.

The main information of the electronic file of dog breeding can be provided to the relevant departments to query.

Article 20 of the key management area units and individuals raising dogs should pay the dog management fee. Dog-raising management fee shall be paid by the dog-raising public security organs in the place of residence for dog-raising registration or for the continuation of dog-raising procedures.

Dog management fee paid once a year. The specific standard shall be determined by the municipal people's government in accordance with the law.

Blind people keeping guide dogs and people with severe physical disabilities keeping assistance dogs shall be exempted from the management fee.

If a sterilized dog is kept, the management fee shall be reduced by half on the basis of a certificate of sterilization of the dog issued by an institution commissioned by the department of fisheries, animal husbandry and veterinary medicine.

Article 21 of the dog management fees paid to the centralized financial, financial budget management, specifically for the digital management of dog registration, dog immunization, sheltering stray dogs, dog shelter and rescue site construction, harmless treatment of dead dogs, as well as the villagers' committees, community residents' committees, owners' committees of residential districts and other grass-roots organizations to participate in the management of the dog management and other work expenses.

Article 22 The people's governments of townships (townships) shall strengthen the management of dog-raising in general management areas, and annually organize animal epidemic prevention and supervision agencies to provide free veterinary rabies vaccination for dogs.

General management areas of dog breeders shall, in accordance with the relevant provisions of the state, regularly for dogs vaccinated against veterinary rabies. Dogs that are not immunized shall be dealt with by the people's government of the township (township) in accordance with the law.

Article 23 It is prohibited to forge, alter, deface, fraudulently use, transfer, buy or sell documents and certificates relating to dog-raising and dog-business activities.

Chapter III Daily Management

Article 24 In the key management area, individuals and units raising dogs must comply with the following provisions:

(1) Individuals raising dogs in the dog keeper's residence, units raising dogs should be kept in captivity or tethered, and shall not be allowed to let the dog out of the house on their own;

(2) Keeping a dog shall not interfere with the normal work and rest of others, the dog barking. Rest, barking dogs should be stopped in a timely and effective;

(c) shall not abandon the breeding of dogs;

(d) shall not organize "dogfighting" activities, no abuse of dogs;

(e) shall not be allowed to let go of the dog, driving dogs intimidate and injure others;

(f) Shall not commit other violations of laws, regulations, rules and regulations of dog breeding behavior.

Article 25 No one shall bring a dog into the following areas:

(1) Party and government organs, hospitals, schools, kindergartens and other places for children's activities;

(2) convention and exhibition centers, exhibition halls, libraries, museums, art galleries;

(3) stadiums (halls), swimming pools (halls), theaters and other public **** cultural and sports venues;

(4) the dog shall not be allowed to be used in any way that violates the laws, regulations and rules. p>

(4) shopping malls, hotels, restaurants;

(5) waiting room (aircraft, ship), small rental cars other than public **** transportation;

(6) parks, city squares, public **** green space, scenic spots;

(7) other public **** place with a sign that dogs are prohibited.

Blind people with guide dogs or severely physically disabled people with assistance dogs are not subject to the provisions of the preceding paragraph.

Article 26 The managers or operators of establishments and business premises outside the areas where entry with dogs is prohibited shall have the right to decide whether entry with dogs is prohibited or restricted in the premises under their management or operation.

Article 27 The village committee, the community residents committee, the owners' committee of a residential district may, through a convention, agree on the area and time when dogs are allowed to be walked in the village, community or residential district.

Article 28 The key management area, individuals with dogs out of the house shall comply with the following provisions:

(1) carry a dog registration certificate and dog immunization certificate, wear dog identification tags for the dog, the dog is drawn by a person with full capacity for civil behavior, pay attention to avoid the elderly, disabled, pregnant women and children;

(2) small dogs with a length of no more than 2 meters of dog (b) Small dogs shall be pulled by a leash or chain of not more than 2 meters in length; large dogs shall be pulled by a leash or chain of not more than 1.5 meters in length;

(c) If a dog is taken in a mini-hire car with the consent of the driver, the driver shall muzzle the dog or put the dog into a bag or cage;

(e) No dog shall be allowed in public ****ing places;

Article 29 Bringing a dog into a key management area shall be in accordance with the conditions of the key management area of the dog.

Article 30 units or individuals transporting dogs through the key management area, the dog should be loaded into the cage, the dog shall not stay in the key management area for more than 24 hours.

Article 31 If a dog causes damage to the person or property of another person, the dog owner shall bear the corresponding legal responsibility according to law.

Dogs endanger traffic safety, causing injury or death to themselves, the vehicle driver is not liable for compensation.

Article 32 of the injury to the dog or suspected rabies dogs, dog owners shall be promptly sent to the dog rescue places, by the animal epidemic prevention and supervision institutions for quarantine; confirmed rabies dogs, aquatic animal husbandry and veterinary administrative departments shall, in accordance with the law to take measures to extinguish, and harmless disposal.

Article 33 of the occurrence of rabies epidemic, the city, county (district) people's government shall, according to the epidemic situation of the epidemic point, the infected area, and according to law to take emergency extermination of dogs and other prevention and control measures, dog breeders shall cooperate.

Chapter IV Dog Business, Diagnosis, Rescue and Disposal

Article 34 It is prohibited to engage in dog business breeding activities within the key management area.

Anyone engaging in dog business activities shall have legal procedures.

Article 35 Anyone engaging in dog breeding, trading and other production and business activities shall comply with the following provisions:

(1) Dog trading shall be carried out in the dog trading places recognized by the administration for industry and commerce;

(2) The dog trading places shall comply with the conditions of epidemic prevention stipulated by the state, and shall be equipped with facilities for rinsing, disinfecting, and harmless treatment of sewage and filth;

(3) The dog trading places shall be equipped with legal procedures. /p>

(c) the breeding of dogs should be vaccinated against veterinary rabies;

(d) dog trading, should provide the buyer with animal quarantine certificate or certificate of immunization and other materials;

(e) found that the dog is infected with the disease or suspected of infected with the disease, should be immediately reported to the local competent authorities of the aquatic, animal husbandry and veterinary or the public security organs, and guardianship of the scene, shall not transfer , selling and slaughtering.

Article 36 of the dog clinic shall have the appropriate professional and technical personnel and the appropriate equipment, facilities, premises, and according to the law to obtain the aquatic animal husbandry and veterinary administrative departments issued by the "Animal Clinic License".

Article 38 The municipal and county people's governments shall, in accordance with the needs of the jurisdiction of the dog management work, the establishment of dog shelters. Dog shelter and rescue places managed by the public security organs, responsible for receiving and handling the dogs sent in accordance with the regulations and confiscated dogs.

The government supports and encourages civil animal protection organizations and individuals with the conditions to set up dog shelter and rescue places in accordance with the law, to take in stray, abandoned dogs. Specific management by the municipal public security organs in conjunction with the municipal aquatic animal husbandry and veterinary medicine, civil affairs and other departments to formulate a separate.

Article 39 The dog shelter rescue places for the shelter of the owner of stray dogs, shall notify the owner to claim. If the dog is not claimed within 10 days from the date of notification, it shall be treated as an ownerless stray dog.

Dog shelters and rescue facilities shall take the necessary immunization and medical measures for the sheltered dogs, and establish a system for the adoption of abandoned and stray dogs, allowing units and individuals to adopt them.

Dog shelters and rescue places should be provided free of charge to the community lost dog information query service.

Article 40 Units and individuals who keep dogs shall not abandon their carcasses at will.

Dogs kept non-infectious disease deaths shall be buried deep; deaths from infectious diseases, shall notify the administrative department of aquatic animal husbandry and veterinary medicine in accordance with the provisions of the treatment.

Chapter V Legal Liability

Article 41 violation of these Regulations, one of the following acts, the public security organs shall be punished:

(a) violation of Article 9, the key management area without registration or without immunization of dogs, confiscate the dogs. (3) in violation of the provisions of Article 17 (1) and (2), not in accordance with the law to change procedures, confiscate the dogs. Article 42 Violation of the provisions of Article 28, paragraph 6 of these Regulations, the city management department shall order the timely removal of dog excreta; refusal to remove, a fine of 50 yuan.

Article 43 violation of the provisions of Article 30 of these Regulations, units or individuals transporting dogs passing through the key management area, the dog is not put into the cage or stay in the key management area for more than 24 hours, the public security organs shall be fined 500 yuan or more than 1,000 yuan or less; the circumstances are serious, the confiscation of the dog.

Article 44 Violation of the provisions of these Regulations, other acts, laws and regulations have been stipulated penalties, in accordance with its provisions. Constitutes a crime, shall be investigated for criminal responsibility.

Article 45 Any unit or individual in violation of these Regulations have the right to criticize, discourage, report, complain. The relevant department receiving the report or complaint shall deal with it in a timely manner.

Strike, retaliation against the report, the complainant, by the public security organs in accordance with the provisions of the "Chinese People's Republic of China *** and the State Public Security Administration Punishment Law"; constitutes a crime, shall be investigated for criminal responsibility.

Article 46 If a dog owner is confiscated for violating these Regulations, the public security organs shall cancel the dog-keeping registration certificate and shall not allow him or her to apply for dog-keeping registration within three years.

Article 47 Any of the following acts of the departments responsible for dog-keeping management and their staff shall be subject to administrative sanctions by the supervisory organs or higher administrative authorities in accordance with the law; and if they constitute a crime, they shall be held criminally liable in accordance with the law.

(1) for eligible applicants for dog registration not to apply for dog registration or deliberately delayed;

(2) law enforcement inspections found problems or received complaints or reports, not dealt with in accordance with the law or shirking responsibilities;

(3) other abuse of power, negligence, favoritism and malpractice.

Article 48 The parties to the public security organs and other relevant administrative departments to make the specific administrative act related to dog management, may apply for administrative reconsideration or to the people's court.

Chapter VI Supplementary Provisions

Article 49 Where the area under the jurisdiction of a street office is within the scope of a general management area, the duties of the street office in relation to the management of dog-raising shall be governed by the provisions of these Regulations relating to the people's governments of townships (townships).

Article 50 These Regulations shall come into force on August 1, 2009, and the Provisions of Nanning Municipality on Strict Restrictions on Dog-Raising promulgated and implemented on March 1, 1997 shall be repealed at the same time.
