The labor administrative departments of the people's governments at all levels shall exercise unified supervision over mine safety production according to law. Article 4 Mines must be equipped with safety production management personnel, and their responsibilities for safety production must be clearly defined. The legal representative of the mine (individual miner) is the first person responsible for the safety production of this mine; The employer and the contractor shall be responsible for the safe production of the contracted mines. Article 5 Before mining mineral resources, mines must apply to the labor administrative department for examination of the conditions for safe production in mines. The competent department of geology and mineral resources may issue a mining license only after the examination meets the technical specifications for mine safety production and the labor administrative department signs the opinions; Do not meet the technical specifications of mine safety production, the labor administrative department shall explain the reasons and notify the mine in writing. Article 6 The following materials shall be submitted when applying to the labor administrative department for examination of mine safety production conditions:
(a) the occurrence conditions and hydrogeological conditions of the deposit;
(2) Information on safety facilities and technical strength;
(3) mine safety qualification certificate;
(four) production (design) drawings and topographic and geological maps reflecting the development of mines and the layout of safety facilities;
(five) the type of ore, the geographical location of the mine and its distance from residential areas, important buildings, traffic trunk lines and power transmission and communication lines. Article 7 The labor administrative department shall complete the audit within 15 days from the date of receiving the relevant materials submitted by the mine. Article 8 Mines must report to the administrative department of labor safety regularly every year. Article 9 Mines must abide by the following provisions:
(a) to protect the environment and mineral resources in accordance with the law, and to set up tailings ponds with special dumping sites and water mining mines, and to prohibit littering;
(two) the workplace has the conditions for safe production, and the measures for safe production are implemented to ensure the safety and health of employees;
(three) clear responsibility for production safety of mine employees, and often carry out safety inspection;
(four) to establish and improve the inspection and handling system of slopes, blasting and dangerous stones, and to take preventive measures against hidden dangers of accidents;
(five) safety education for employees; Special operations personnel must be trained in accordance with the provisions of the state and hold relevant certificates after passing the examination;
(six) mine casualties, must immediately organize rescue, prevent the accident from expanding, and immediately report to the relevant departments in accordance with the provisions. Tenth mines and employees must sign labor contracts according to law, and implement the employee registration system.
The labor contract and roster shall be reported to the competent mining department and the labor administrative department for the record. Eleventh mines must be prepared in accordance with the provisions of the mining and stripping operation procedures and technical operation procedures; Establish and improve the post responsibility system for production safety, the reward and punishment system for production safety and the analysis and reporting system for hidden dangers of accidents. Twelfth mines must be divided into bench mining according to the top-down mining order. It is forbidden to cut from the lower part without segmentation and work at the same time on the same working face. Thirteenth mine bench height, bench inclination and minimum platform width should be determined according to the characteristics of ore and rock, mining and blasting methods and the requirements of mining, loading and unloading and transportation equipment, specifically:
(a) mechanized mining, the height of the steps shall not exceed 10 meters. Manual mining, the bench height is: soil and sand ore does not exceed 1.8m, soft ore does not exceed 3m, and hard ore does not exceed 6m;
(2) Step slope angle: soft rock shall not be greater than 45 degrees, hard rock shall not be greater than 50 degrees, and hard rock shall not be greater than 80 degrees;
(three) the minimum working platform width should ensure the safety of mining and transportation, and the minimum platform width of mechanized mining should be determined through design, but the minimum should not be less than 30 meters; The minimum manual excavation shall not be less than 5m. It is forbidden to form umbrella eaves, tree roots and holes in the mining and stripping working face, and the bench working platform should be kept flat;
(four) the slope angle of deep concave mine should be implemented according to the design regulations. When the mining depth does not exceed 50 meters, the soft rock does not exceed 40 degrees, the stable rock does not exceed 50 degrees, and the hard rock does not exceed 60 degrees. Article 14 When there is pumice in the mining and stripping face, it is necessary to immediately deal with or set up safety signs, and no other operations are allowed in the pumice danger zone, and no personnel are allowed to rest and stay at the bottom of the slope.
Mine must have someone who is responsible for slope management. When slope managers find signs of collapse and landslide, they have the right to order them to stop mining and stripping operations, evacuate personnel and equipment, and immediately report to the person in charge of the mine. Fifteenth personnel entering the job site must wear safety helmets. Personnel working on a step slope above 3 meters or 30 degrees above the ground must use safety ropes. Before use, the safety rope must be checked, the safety factor should not be less than 5, and the length of the tail rope should not exceed 1 m. It is forbidden for two people to use a safety rope at the same time.
