Provisions on the Administration of Online Recruitment Services

Chapter I General Provisions Article 1 In order to standardize online recruitment services, promote the healthy and orderly development of online recruitment services, and promote the employment and mobile allocation of human resources, according to the Employment Promotion Law of People's Republic of China (PRC), the Cyber Security Law of the People's Republic of China, the Electronic Commerce Law of the People's Republic of China, the Provisional Regulations on Human Resources Market, the Measures for the Administration of Internet Information Services and other laws and regulations, Article 2 The online recruitment services mentioned in these Provisions, Refers to the human resources service institutions in People's Republic of China (PRC), through the Internet and other information networks, using online recruitment service platforms, self-built websites or other online services to provide job-seeking services for job-seeking workers and employers.

Human resources service institutions include public human resources service institutions and operating human resources service institutions. Article 3 The administrative department of human resources and social security of the State Council is responsible for the comprehensive management of online recruitment services nationwide.

The administrative departments of human resources and social security of local people's governments at or above the county level shall be responsible for the management of online recruitment services within their respective administrative areas.

The relevant departments of the people's governments at or above the county level shall, within the scope of their respective duties, manage online recruitment services according to law. Article 4 To engage in online recruitment services, one should follow the principles of legality, fairness, honesty and credibility, fulfill the obligations of network security and information protection, assume the responsibility of service quality, and accept the supervision of the government and society. Article 5 Where an operating human resources service institution engaged in online recruitment services provides public welfare human resources services, it shall give subsidies or give support through the government's purchase of services in accordance with regulations. Article 6 The administrative department of human resources and social security shall strengthen the standardization of online recruitment services and support enterprises, scientific research institutions, universities and industry associations to participate in the formulation of national standards and industry standards for online recruitment services. Article 7 The human resources service industry association shall, in accordance with the provisions of laws, administrative regulations, rules and their articles of association, strengthen the self-discipline of the online recruitment service industry, promote the integrity construction of the industry, and promote fair competition in the industry. Chapter II Access to Online Recruitment Services Article 8 To engage in online recruitment services, one shall meet the requirements stipulated by laws and administrative regulations such as employment promotion, human resources market management, telecommunications and Internet management. Article 9 An operating human resources service institution engaged in online recruitment service shall obtain a human resources service license according to law. Involving the operation of telecommunications business, it shall also obtain a telecommunications business license according to law. Article 10 The administrative department of human resources and social security shall indicate "developing online recruitment services" in the service scope of the operating human resources service institutions engaged in online recruitment services. Eleventh online recruitment services include the following services:

(a) to introduce the employer to the employees;

(2) Recommending laborers for the employing units;

(3) Holding online job fairs;

(four) to carry out senior talent search services;

(five) other online job hunting and recruitment services. Article 12 Where an operating human resources service institution engaged in online recruitment service changes its name, domicile and legal representative or terminates online recruitment service, it shall report in writing to the administrative department of human resources and social security within 15 days from the date of completion of registration change or cancellation of registration of market entities, and handle the change and cancellation of the human resources service license. Article 13 An operating human resources service institution engaged in online recruitment service shall continuously publicize information such as business license and human resources service license or the link identification of the above information in a prominent position on its website, mobile Internet application and other homepages according to law.

If the information specified in the preceding paragraph changes, the operating human resources service institutions engaged in online recruitment services shall update the public information in a timely manner.

Where an operating human resource service institution engaged in online recruitment service terminates online recruitment service by itself, it shall continuously publicize relevant information in a prominent position on the homepage 30 days in advance. Article 14 The administrative department of human resources and social security shall promptly announce to the public the list of operating human resources service institutions engaged in online recruitment services and their changes and cancellations. Chapter III Online Recruitment Service Standards Article 15 Online recruitment information provided by an employer to a human resources service institution, such as the basic information of the employer, the number of recruits, recruitment conditions, employment type, work content, working conditions, work place, basic labor remuneration, etc. , shall be legal and true, and shall not contain any discriminatory content such as nationality, race, gender or religious belief.

The online recruitment information mentioned in the preceding paragraph shall not violate the provisions of the state to set conditions that restrict the flow of human resources, such as household registration, region and identity. Article 16 A laborer applying for a job online through a human resources service institution shall truthfully provide his basic information, knowledge, skills and work experience related to the position he is applying for. Seventeenth human resources service institutions engaged in online recruitment services should establish a complete online recruitment information management system, and review the authenticity and legality of the materials provided by the employer according to law. The contents of the review should include the following aspects:

(a) the employer's recruitment brochure;

(2) The business license of the employing unit or the documents approved by the relevant departments for establishment;

(three) to handle the identity certificate of the recruitment information publisher and the entrustment certificate of the employer.

If an employer intends to recruit foreigners, it shall comply with the relevant requirements of the Regulations on the Administration of Employment of Foreigners in China.
