Provisions on the Supervision and Administration of Work Safety of Metallurgical Enterprises in Hebei Province (revised 20 15)

Chapter I General Provisions Article 1 In order to strengthen the supervision and management of production safety in metallurgical enterprises, prevent and reduce production safety accidents and occupational hazards, and ensure the life safety and health of employees, these provisions are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on Work Safety and other laws and regulations. Article 2 These Provisions shall apply to the safety production, supervision and management of enterprises (hereinafter referred to as metallurgical enterprises) engaged in coking, sintering, pelletizing, ironmaking, steelmaking, steel rolling, ferroalloy and its supporting refractories, carbon materials, gas, oxygen and related gases, mechanical maintenance, power generation, construction and other production activities within the administrative region of this province.

These provisions are not applicable to the smelting and pressure processing of non-ferrous metals (electrolytic aluminum, electrolytic copper, gold, etc.). Article 3 The safety production supervision and management department of the people's government at or above the county level shall supervise and manage the safety production of metallurgical enterprises within their respective administrative areas.

The relevant departments of the people's governments at or above the county level shall, in accordance with their respective duties, supervise and manage the safety production of metallurgical enterprises. Article 4 Metallurgical enterprises are the main responsible persons for production safety, and their main responsible persons (including legal representatives and actual controllers) are the first responsible persons for production safety. The group company is responsible for the safety production of its subsidiaries, branches and holding companies. Chapter II System Guarantee for Safe Production Article 5 Metallurgical enterprises shall meet the conditions for safe production stipulated by laws, regulations, rules, national standards, compulsory industry standards and local standards for safe production, and obtain corresponding administrative licenses according to law. Article 6 Metallurgical enterprises shall establish the responsibility system for production safety and the rules and regulations for production safety, improve the safety operation rules for various jobs and posts, and revise and update them in time. Seventh metallurgical enterprises shall, in accordance with the provisions of the state, fully withdraw the safety production expenses every year to improve the safety production conditions. Safety production expenses are included in independent financial accounts. Article 8 Metallurgical enterprises with 100 employees or more shall set up special safety production management institutions, and the highest management institution directly under the enterprise shall not be merged with other management institutions. Metal smelting enterprises shall be equipped with full-time safety production management personnel (not less than three) according to the proportion of employees, and shall be equipped with registered safety engineers in accordance with relevant regulations. Workshops and teams should be equipped with full-time or part-time safety production management personnel.

The treatment of full-time safety production management personnel shall not be lower than that of other post management personnel at the same level, and enjoy the risk allowance for enterprise safety production management posts, and the allowance standard shall be implemented in accordance with the relevant provisions of the state and this province. Article 9 The principal persons in charge of metallurgical enterprises, persons in charge of production safety, persons in charge of production safety management, and persons in charge of major production links such as steelmaking, ironmaking and gas-related activities shall receive special safety training and pass the examination by the supervision and administration department of production safety.

Special operations personnel must undergo special safety training and assessment in accordance with the relevant provisions of the state and obtain the qualification certificate for special operations before taking up their posts. The scope of special operations personnel shall be determined in accordance with the relevant provisions of the state. Article 10 Metallurgical enterprises shall educate and train their employees in production safety, so as to ensure that the employees have the necessary knowledge of production safety, be familiar with relevant rules and regulations on production safety and safe operation procedures, and master the skills of safe operation of their posts. Employees who have not passed the safety education and training are not allowed to work at their posts. Eleventh metallurgical enterprises should identify all kinds of hazards existing in their own units, and conduct safety assessment, register and file, and implement monitoring responsibilities in accordance with regulations for those that constitute major hazards. Registration and filing shall be filed with the safety production supervision and management department and other relevant departments in accordance with relevant regulations. Twelfth metallurgical enterprises should establish a hidden danger investigation mechanism, and implement the responsibility, measures, funds, time limit and plan for hidden danger investigation and management. Establish a hidden danger rectification mechanism led by safety production professionals to ensure that the rectification is in place. Thirteenth metallurgical enterprises should establish and improve the emergency rescue system, formulate corresponding emergency plans, equip with necessary emergency rescue equipment and equipment, and regularly carry out emergency publicity, education, training and drills.

Metallurgical enterprises shall, after the occurrence of production safety accidents, timely report and organize accident rescue in accordance with relevant regulations. Fourteenth metallurgical enterprises to build, rebuild and expand projects (hereinafter referred to as metallurgical construction projects), should be in accordance with the relevant provisions of the state safety evaluation. Fifteenth safety facilities of metallurgical construction projects must be designed, constructed and put into production and use at the same time as the main project. The design of safety facilities for metal smelting construction projects shall be reported to the relevant departments for review in accordance with the provisions of relevant state laws and regulations.

The construction unit of metallurgical construction project shall design and construct according to the approved safety facilities, and be responsible for the engineering quality of the safety facilities.

Before the metal smelting construction project is completed and put into production or use, the construction unit shall be responsible for organizing the acceptance of safety facilities; Only after the acceptance is qualified can it be put into production. Sixteenth metallurgical enterprises should review the qualifications of construction units and supervision units before construction. The project contract agreement shall clearly stipulate the safety production responsibilities and obligations of both parties. The cost of safety measures should be included in the project contracting cost.

If there are multiple contractors on the construction site of a construction project, the metallurgical enterprise shall conduct unified coordination and management on the safety production of the contractors. The project contractor shall obey the unified management of the contractor and shall not subcontract or illegally subcontract.
