Measures for the administration of green food certification and mark use fees
Article 1 These Measures are formulated for the purpose of standardizing green food certification and mark use fees, safeguarding the legitimate rights and interests of owners and users of green food marks, and promoting the healthy development of green food undertakings.
Article 2 The Ministry of Agriculture is responsible for organizing and implementing the quality supervision and certification of green food. China Green Food Development Center recognizes green food according to standards, and implements green food marks and trademark management according to trademark law.
Article 3 China Green Food Development Center can carry out green food certification and green food label licensing, and can collect green food certification fees and label use fees.
Article 4 The green food certification fee shall be paid by the enterprise applying for the green food mark use license at the time of application, and the specific charging standard shall be implemented according to the provisions in Annex II.
Article 5 The green food mark use fee shall be paid by the enterprise that has obtained the green food mark use license before the start of each green food mark use year, and the mark use right shall be valid for 3 years. The specific charging standards shall be implemented according to the provisions of Annex II.
Sixth the following products enjoy preferential policies for the use of marks:
(a) primary products, primary processing products and deep processing products of enterprises in key counties of national poverty alleviation and development work;
(2) Primary products of enterprises in the western region;
(3) The products of the year in which the green food mark trademark was licensed.
Specific preferential policies shall be implemented in accordance with the provisions of the Ministry of Agriculture.
Article 7 Enterprises that need to accept environmental monitoring and product inspection in the process of applying for the use of green food labels shall pay environmental monitoring fees and product inspection fees as required. Environmental monitoring fees and product inspection fees shall be collected by units qualified for environmental monitoring or product inspection when monitoring or inspection is carried out. The charging unit shall apply to the designated competent price department for a fee license in accordance with regulations and use the prescribed fee bills. The specific charging standards for environmental monitoring fees and product inspection fees shall be implemented in accordance with the provisions of Annexes III and IV.
Article 8 During the period when an enterprise uses the green food label, the expenses for product inspection and environmental monitoring for the purpose of supervision and management shall be borne by the unit implementing supervision and management; The supervision and management department requires the enterprise to rectify and re-examine, and the expenses shall be borne by the enterprise; The expenses for an enterprise to apply for arbitration inspection shall be paid by the enterprise first, and then borne by the responsible party according to the arbitration inspection results.
Ninth green food certification fees and logo use fees as the source of funds for green food. Certification fees are mainly used for accepting certification applications, certification inspections, certification audits, issuing certificates, and issuing announcements. Logo use fees are mainly used for logo management and green food development.
Article 10 Matters related to the collection of certification fees and mark use fees shall be agreed in the License Contract for Green Food Marks and Trademarks in accordance with the relevant provisions of these Measures.
Eleventh failed to pay the certification fee or mark use fee, China Green Food Development Center can make it refuse or terminate the green food mark use license.
Twelfth China Green Food Development Center to collect green food certification fees and green food logo use fees, should apply to the National Development and Reform Commission for a "license fee", use tax invoices, pay taxes according to law.
Article 13 China Green Food Development Center shall not charge green food label fees in addition to green food certification fees and green food label use fees, and charging units shall strictly follow the provisions of these Measures, and shall not expand the scope and raise the standard of fees without authorization, and consciously accept social supervision.
Article 14 These Measures shall be interpreted by the National Development and Reform Commission.
Article 15 These Measures shall be implemented as of 1 month 1 day, 2004.
Annex II: Green Food Certification Fee and Logo Use Fee
Green food certification fee charging standard
The charging standard of green food certification fee is: similar primary product series (57 subcategories) and more than two parts, each product is 8000 yuan, and each product is 1 000 yuan; A series of products with the same main raw materials and similar processes, with more than two parts, each product is 2000 yuan; Other series products, more than two parts, each product is 3000 yuan.
