Chapter II Health Certificate

Article 5 crew members of seagoing ships shall hold valid health certificates during their work.

(3) Applicable provisions of relevant international conventions;

(4) the statement of the chief physician;

Article 7 If the crew of a seagoing vessel meets the following conditions, the chief physical examination officer shall sign the health certificate and affix the official seal of the physical examination institution:

(a) At least 18 years old (interns and trainees on board are at least 16 years old);

(2) Holding valid identity documents;

(3) Conforming to the standards of Requirements for Seafarers' Health Examination (GB30035-20 13);

(four) to complete the crew information collection.

Article 8 The validity period of the health certificate shall not exceed 2 years; For seafarers under the age of 18, the validity period of health certificate shall not exceed 1 year.

Article 9 If the validity period of the health certificate on voyage expires, the health certificate shall remain valid until it reaches the next port of call of the chief physician recognized by the States parties to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (1978), but the period shall not exceed 3 months.

In case of emergency, the maritime administrative agency may allow seafarers whose recent health certificates have expired to work in the next port accompanied by the chief physician recognized by the States parties to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, but the period shall not exceed three months.

Article 10 If the health certificate is damaged or lost, it shall be reissued by the original medical examination institution.

The validity period of the re-issued health certificate is the same as that of the original health certificate.

Article 11 The crew of a seagoing vessel shall undergo a new occupational health examination under any of the following circumstances:

(a) losing the ability to work for more than 30 days;

(two) due to medical reasons;

(three) other circumstances that affect the performance of duties due to changes in health status.

Article 12 The photocopies of the crew's identity documents, the originals of the crew's health checklist (including the report of physical examination items) and other files obtained or formed by the physical examination institutions shall be kept for at least 3 years.

Thirteenth medical institutions should properly keep blank health certificates. The invalid blank health certificate shall be registered by the medical examination institution and returned to the maritime administrative agency that issued the blank health certificate in time.

Chapter III Physical Examination Institutions and Chief Inspectors

Article 14 A medical examination institution shall meet the requirements of the medical examination institution for the occupational health examination of seafarers, and its chief physician shall meet the requirements of the chief physician for the occupational health examination of seafarers.

Fifteenth medical institutions should report relevant information to the local maritime administrative agency and obtain a blank health certificate.

The national maritime administrative agency shall provide the society with the information of medical institutions and chief physicians that can be inquired through the official website.

Article 16 If the information reported by the medical examination institution changes, it shall report to the maritime administrative agency that issued the blank health certificate within 5 working days.

Chapter IV Occupational Health Examination

Seventeenth medical institutions shall carry out occupational health examination in accordance with the items and standards stipulated in the Requirements for Seafarers' Health Examination; Before the physical examination of each project, the physical examination doctor should carefully verify the identity information of the crew.

The chief physician shall make an objective and fair appraisal conclusion on the occupational health status of the crew within 1 working days after the physical examination. In accordance with the provisions of these measures, the medical examination institution shall issue a health certificate for the medical examination crew.

The physical examination institution shall promptly notify the crew members who need reexamination and medical observation. If it is necessary to postpone the issuance of certificates under special circumstances, the medical examination institution shall explain the reasons and inform the crew themselves.

Article 18 The chief physician has independent decision-making power (except for vision, color vision and other items) when making medical appraisal conclusions on the occupational health status of seafarers.

Article 19 Medical institutions shall promptly report the issuance of health certificates to the maritime administrative agency that issues blank health certificates.

Chapter V Supervision and Administration

Article 20 The maritime administrative agency shall establish and improve the supervision and inspection system for the physical examination institutions, supervise and inspect the ability maintenance, business development, honesty and trustworthiness of the physical examination institutions by randomly selecting the inspection objects and law enforcement inspectors, make inspection records (Annex 5), and disclose the inspection results in a timely manner.

The maritime administrative agency shall conduct comprehensive on-site supervision and inspection within 5 days after the physical examination institution receives the blank health certificate for the first time.

Article 21 In any of the following circumstances, the physical examination institution that issued the health certificate shall cancel the health certificate in time and report the relevant information to the maritime administrative agency that issued the blank health certificate:

(1) The crew members themselves apply for cancellation;

(2) Obtaining a health certificate by cheating, bribery or other improper means;

(3) It is found that concealing the medical history of relevant occupational taboos does not meet the requirements for issuing health certificates.

Article 22 If a medical institution or its chief physician is under any of the following circumstances, it shall not issue health certificates within two years, and the blank health certificates received shall be recovered by the maritime administrative agency.

(a) did not effectively fulfill the obligation to verify the identity of the medical examiner;

(2) Failing to conduct medical examination according to the prescribed standards or failing to make a medical examination conclusion truthfully;

(three) failing to issue a health certificate in accordance with the provisions;

(4) Failing to keep relevant files as required;

(5) Failing to keep blank vouchers as required;

(6) Failing to meet the requirements of these Measures on the ability of the chief inspector of seafarers' occupational health examination and the ability of medical institutions to carry out seafarers' occupational health examination, and still providing health certificates.

Chapter VI Supplementary Provisions

Twenty-third seafarers in China can hold the health certificate issued by the chief physician recognized by any state party to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (1978) and work among seafarers in China.

Twenty-fourth blank health certificates shall be uniformly printed by the competent department.

Article 25 These Measures shall come into force as of the date of promulgation. The Measures for the Administration of Seafarers' Health Certificates in People's Republic of China (PRC) (Seafarers [2065438+02] No.2365438+0) issued on March 5, 20 12 shall be abolished at the same time.
