Encourage qualified villages to set up nursing homes, and advocate social forces to set up and fund nursing homes.
Article 3 Township people's governments shall strengthen their leadership over the construction and management of nursing homes and incorporate them into local economic and social development plans.
Article 4 The civil affairs department is the competent department in charge of the construction and management of nursing homes, and is responsible for guiding the business work of nursing homes. The financial department is responsible for the implementation of nursing home support funds. Civil affairs, finance, price, supervision and auditing departments are responsible for the supervision and inspection of the management and use of funds for nursing homes.
Chapter II Acceptance and Support
Fifth nursing homes to support five objects, giving priority to receiving five objects that can not take care of themselves and receiving special care for the elderly. Conditional nursing homes can be open to the society and absorb the elderly from the society to provide for the elderly at their own expense. Mental patients and patients with infectious diseases shall not be admitted to hospital for support and foster care.
Sixth five guarantees recipients must apply for admission and support by themselves, with the approval of the Township People's government, and sign an admission agreement with the nursing home. When the self-funded foster care object is admitted to the hospital, the nursing home will sign a self-funded foster care agreement with the foster care object or the guardian of the foster care object, and submit a medical certificate. ?
Article 7 The occupancy agreement of the five-guarantee recipients shall include the following contents: the responsibilities that the villagers' group should bear, the disposal methods of the property of the recipients, and the rights, responsibilities and obligations of the nursing home and the recipients. Foster care agreement should include the following contents: admission conditions, charging standards, rights, responsibilities and obligations of both parties after admission, medical expenses, funeral matters, liability for breach of contract, etc.
Eighth five objects after admission, the village should cooperate with the nursing home to continue to do related services; If the supporter dies, he should be cremated, and the village group should assist the nursing home and simply take care of the funeral.
Article 9 If the personal property of the five-guarantee recipients needs to be escrow, the real estate shall be escrow by the villagers' group and the movable property shall be escrow by the nursing home. If there are property disposal clauses in the occupancy agreement, it shall be handled according to the occupancy agreement.
Article 10 The actual life of the dependents of nursing homes shall not be lower than the average living standard of local villagers.
Chapter III Diet Management
Article 11 Nursing homes should pay attention to the diet and nutrition of dependent objects, operate in strict accordance with food hygiene requirements, have recipes every week, and try to meet the dietary requirements of special dependent objects.
Twelfth weekly recipes should be adjusted according to the opinions and requirements of family members. Representatives of dependent objects should participate in the procurement and acceptance of food materials, and food accounts should be published to dependent objects on a monthly basis. ?
Thirteenth dependents and staff are not allowed to set their own stoves to cook in the hospital. When dining in the hospital, employees should be in the same kitchen with their families, and pay the food expenses according to regulations.
Chapter IV Service and Nursing
Fourteenth homes for the aged should reasonably arrange the housing for the dependents. Dependents admitted to hospital due to infectious diseases shall be quarantined.
Fifteenth nursing homes should provide warm and thoughtful daily care for the dependents, and provide necessary special care for the dependents who can't take care of themselves.
Sixteenth nursing homes should emphasize family service, give spiritual comfort to the dependents, organize the dependents to carry out learning and fitness and entertainment activities, and implement the democratic and political rights of the dependents.
Seventeenth dependent objects should unite and help each other, pay attention to hygiene, care for public property, obey management, and strive to serve independently; Consciously abide by social morality and various rules and regulations of the hospital; Actively participate in productive labor and other collective activities.
Chapter V Medical Care
Eighteenth nursing homes should set up an infirmary or infirmary, equipped with full-time or part-time medical staff, equipped with commonly used drugs and basic medical equipment.
Nineteenth nursing home clinics or clinics should establish health records for the dependents. Relying on local medical institutions, the dependents are given a physical examination once a year, and the sick dependents are treated in time.

Article 25 The entrances and exits of nursing homes and places for living and activities of dependent objects shall provide convenient facilities for the elderly, and shall be treated with anti-skid.
Twenty-sixth attached rooms should have good orientation, natural lighting and natural ventilation. The average living room area is not less than 6 square meters in principle. Rooms should be equipped with necessary furniture and daily necessities.
Twenty-seventh nursing homes should set up public health places such as toilets, bathrooms and public laundry rooms. There should be one toilet for each bungalow and one toilet for each floor of the building. Where conditions permit, try to set up toilets in the room.
Twenty-eighth nursing homes should set up public entertainment, fitness and other activities. Conditional nursing homes should be equipped with fitness equipment suitable for the elderly.
Twenty-ninth kitchens for nursing homes should be able to meet the needs of dependent objects and keep them clean and tidy. There should be a restaurant that meets the needs of the dependents, with tables and chairs, tableware disinfection facilities and food preservation equipment.
Chapter VII Sources of Funds
Article 30 The sources of funds for nursing homes include: centralized five-guarantee funds paid by financial transfer, special funds arranged by township finance, social donation income, hospital income and other income.
Article 31 the county finance shall allocate five-guarantee funds on a monthly basis according to the actual number of dependents in nursing homes, and set up a special account management as the living expenses for centralized support of five-guarantee objects.
Article 32 The township finance shall include the funds for the work, personnel, construction and maintenance of nursing homes into the financial budget, and the county finance and relevant departments shall give appropriate subsidies.
Chapter VIII Production and Operation
Thirty-third nursing homes should have the necessary conditions for production and operation, and have a breeding base that can meet the living needs of the dependents. Organize the dependent objects who have the ability to work to participate in productive labor voluntarily, and give appropriate rewards. The production and operation of nursing homes shall be exempted from taxes and fees in accordance with the Notice of the General Office of the Ministry of Civil Affairs on Forwarding State Taxation Administration of The People's Republic of China's Relevant Tax Policies for Aged Care Services (Private Letter [2001] No.9).
Thirty-fourth nursing homes should account for the production and operation costs, and regularly publish the production and operation of the dependent objects.
Article 35 The income from the production and operation of nursing homes is mainly used for the following aspects: reproduction investment, supplementary living expenses and medical expenses of the dependents, supplementary work expenses, personnel expenses, construction and maintenance expenses of nursing homes, and production and operation incentive fees approved by the Township People's Government.
Chapter IX Property Management
Article 36 The assets of nursing homes shall be managed and used by nursing homes according to law, and no unit or individual may occupy or dispose of them at will. There are state-owned assets in the assets of nursing homes, and the asset disposal plan must be approved by the state-owned assets management department before implementation.
Article 37 In principle, the financial affairs of nursing homes are managed by township social affairs offices, and the accounting and management, the acquisition and filling of various vouchers, and the handling of accounts and statements meet the requirements of the Accounting System of Institutions and the Basic Accounting Work Standard.
Thirty-eighth large expenses of nursing homes should be discussed by the hospital management committee and reported to the Township People's government for approval if necessary.
Article 39 The financial revenue and expenditure of nursing homes shall be announced to the providers every quarter, and shall be subject to the supervision of the supervision and auditing departments.
Chapter X Organizational Construction
Fortieth homes for the aged implement the president responsibility system. Chapter II XI Personnel Management
Forty-third nursing home staff consists of the dean, nursing staff, security personnel, financial personnel, medical staff and cooks. Employees can be full-time or part-time.

Article 46 The director of nursing home accepts the annual assessment of the township people's government and the trust evaluation of the hospital. If the annual assessment is incompetent, the township government will adjust or dismiss it. Before the dean leaves office, he should conduct a departure audit.
Article 47 Other staff members of nursing homes shall be appointed by nursing homes. The appointment of nursing home staff adheres to the principles of openness, fairness and merit.
Forty-eighth employment of other staff in nursing homes shall sign an employment agreement.
Forty-ninth the salary of the president and other staff consists of two parts: basic salary and production and operation bonus. The basic salary is determined at the time of employment (employment), and the production and operation bonus depends on the production and operation status of the nursing home, and the assessment calculation method is clear at the time of employment.
Chapter XII Legal Liability
Fiftieth nursing home support staff should consciously abide by the laws and regulations of the state and the rules and regulations of nursing homes. If there is any violation, the dean or the hospital management committee or the higher authorities will criticize and educate them, and those who violate the law will be investigated for legal responsibility according to law.
Article 51 In case of any of the following circumstances, the nursing home and its staff shall be criticized and educated by the administrative organ in accordance with the management authority until disciplinary action is given. If the case constitutes an illegal act, legal responsibility shall be investigated according to law:
(a) in violation of the relevant laws and regulations of the state, infringing on the legitimate rights and interests of the object of support;
(two) false number of dependents, impersonator five funds, medical assistance funds and other financial funds;
(three) misappropriation, embezzlement, misappropriation of funds for nursing homes and embezzlement, illegal disposal of assets for nursing homes;
(four) dereliction of duty, dereliction of duty caused adverse effects or serious consequences.
Chapter XIII Supplementary Provisions
Fifty-second these Measures shall apply to township nursing homes. Village-run nursing homes refer to the implementation. Nursing homes set up by social forces are managed according to the Regulations of the Ministry of Civil Affairs on the Administration of Social Welfare Institutions.
Article 53 Nursing homes may formulate rules and regulations such as leave cancellation system, health system, attendance system, meal management system, financial management system, infirmary management system, and support object code according to these measures.
