Chapter I General Provisions Article 1 In order to standardize the order of the construction market, strengthen the supervision and management of construction activities, and promote the healthy development of the construction industry, these Regulations are formulated in accordance with the provisions of the Construction Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this province. Second in the administrative area of this province to engage in construction projects such as expansion, renovation, demolition and other construction activities, as well as the implementation of supervision and management of the construction market, should abide by these regulations. Article 3 The supervision and management of the construction market shall follow the principles of unity, openness and order. It is forbidden to divide, block or monopolize the construction market in any form.

Engaged in construction activities should implement the basic construction procedures, and the contracting and contracting of construction projects should follow the principles of openness, fairness, impartiality and good faith. Article 4 People's governments at all levels and relevant units in the construction industry shall take measures to promote the scientific and technological progress of construction projects. Chapter II Supervision and Management Article 5 The construction administrative department of the provincial people's government shall supervise and manage the construction market of the whole province; The transportation, water conservancy and other departments of the provincial people's government shall be responsible for the supervision and management of professional construction projects in the province according to their respective responsibilities.

The construction administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of the construction market within their respective administrative areas in accordance with the principle of hierarchical management; The transportation and water conservancy departments of the people's governments at or above the county level shall be responsible for the supervision and management of professional construction projects within their respective administrative areas.

Industry and commerce, price, quality supervision and other departments shall, in accordance with their respective responsibilities, supervise and manage the related activities of the construction market according to law. Article 6 The construction administrative departments of the people's governments at or above the county level and other relevant departments shall not approve construction projects in violation of legal procedures or simplify capital construction procedures without authorization. Article 7 The construction administrative departments and relevant departments of the people's governments at or above the county level may entrust the relevant institutions with the specific implementation of quality supervision, safety supervision, tendering and bidding, earthquake resistance and project cost of construction projects. Article 8 Law enforcement officers of the construction administrative departments and relevant departments of the people's governments at or above the county level shall produce valid law enforcement certificates and take the following measures when performing their duties of supervision and inspection of the construction market according to law:

(a) to enter the workplace of the inspected unit for inspection;

(two) require the inspected units and personnel to provide documents and materials related to the supervision and inspection matters, and consult and copy them;

(three) require the inspected units and relevant personnel to explain the existing problems;

(four) for obvious violation of the basic construction procedures, mandatory standards or major quality and safety hazards, shall be ordered to make corrections within a time limit or interrupt construction activities;

(5) Other measures stipulated by laws and regulations.

If the relevant law enforcement departments make a decision to stop construction activities according to law, they shall inform the construction administrative department that issued the construction permit or the relevant departments such as transportation and water conservancy in writing. Ninth construction administrative departments and other relevant departments shall establish and improve the complaint system of construction activities, accept complaints according to their respective responsibilities and make a decision according to law. Chapter III Construction Permit Article 10 The following units shall be registered according to law, hold corresponding qualification certificates and engage in construction activities within the scope permitted by their qualification grades:

(a) construction engineering survey and design units;

(2) Construction enterprises and landscaping engineering enterprises engaged in engineering construction, engineering demolition, production of building components and ready-mixed commercial concrete;

(three) engineering supervision, engineering cost consulting, engineering quality inspection, engineering project management, construction project bidding agency and other institutions;

(four) other units as prescribed by laws and administrative regulations.

Where the units specified in the preceding paragraph are involved in the design, manufacture and installation of special equipment, they shall obtain the permission of the quality and technical supervision department of the people's government at or above the county level before undertaking the project.

Before undertaking the project, the construction unit shall obtain the safety production license according to law. Eleventh persons who have obtained the qualification of construction engineering practice according to law, after registration, can engage in professional and technical work within the scope stipulated in the registered practice certificate.

Construction engineering practitioners can apply for registration in construction engineering survey, design, construction, supervision, cost consultation, bidding agency, project management and construction units; Those with multiple qualifications can only register in one unit. Article 12 Special operators such as vertical transport machinery operators, installers and dismantlers, blasters, signal workers, and erectors engaged in construction activities shall, in accordance with relevant state regulations, pass the examination and obtain technical post certificates before taking up their posts.

The employing unit shall provide pre-job technical and production safety training to the workers who participate in construction activities, and can only take up their posts after passing the examination. Article 13 After a construction project meets the conditions for commencement, the construction unit shall apply to the construction administrative department or the transportation, water conservancy and other departments for a construction permit in accordance with the project management authority. Where laws and regulations provide otherwise, such provisions shall prevail.

Non-public construction projects with an investment of less than 300,000 yuan and a construction area of less than 300 square meters do not need to apply for a construction permit. Fourteenth construction units can apply for the overall construction permit of construction projects; You can also apply for a single project construction permit in the construction project or according to the bid section; If the construction project is built by stages, the construction unit may apply for the construction permit separately on schedule.
