Regulations of Hebei Province on the Protection of Minors

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of minors, optimize their growth environment, strengthen their education and management, and enable them to develop morally, intellectually and physically in an all-round way, these Regulations are formulated in accordance with the Constitution of People's Republic of China (PRC) and relevant laws and regulations. Article 2 "Minors" as mentioned in these Regulations refer to citizens who have lived and temporarily stayed in this province and have reached the age of six but under the age of eighteen. Article 3 Minors are the hope and future of the country. Educating and protecting minors is the responsibility of state organs, armed forces, political parties, social organizations, enterprises and institutions, schools, residents' committees, villagers' committees, families and every citizen. Article 4 To protect minors, we should adhere to the principles of education, inspiration and guidance according to the characteristics of their physical, mental and intellectual development, educate minors to love the motherland, people, labor, science and socialism, and make them become citizens with ideals, morality, culture and discipline. Chapter II Family Protection Article 5 Parents or other guardians shall exercise guardianship over minors in accordance with the law, earnestly fulfill their obligations of upbringing and education, and protect the personal, property and other legitimate rights and interests of minors. Article 6 Parents and other guardians shall protect the physical health of minors and ensure their necessary material life and medical and health care conditions, and shall not discriminate, abuse or abandon them.

Without guardianship measures, minors shall not be allowed to live alone. Article 7 Parents or other guardians shall set an example, discipline minors with healthy thoughts, good words and deeds and correct educational methods, and shall not spoil, indulge or accommodate them. Eighth parents or other guardians shall educate and stop the following acts of minors:

(1) Smoking;

(2) drinking alcohol;

(3) in love;

(4) gambling;

(five) damage to public property and public facilities;

(six) fighting, fighting, insulting others;

(seven) reading or listening to or watching books, newspapers, audio-visual products that promote pornography and obscenity;

(8) Other bad behaviors. Chapter III Protection of Schools Article 9 Schools should fully implement the educational policy of the state, attach importance to the education of students' ideals, revolutionary traditions, morality, discipline and legal system while carrying out cultural education, so as to enable students to develop morally, intellectually and physically in an all-round way.

Schools and teachers should care about students' health and provide students with necessary health care conditions; Ensure students' time for rest, entertainment, sports and extracurricular activities, and do not increase students' learning burden; The teaching facilities and places of the school shall not be used for other purposes; Teaching activities are not allowed in dangerous school buildings. Tenth primary and secondary schools should be based on the actual situation of students, labor and labor skills education, organize students to participate in necessary work-study programs, social welfare labor or social service activities. Eleventh school teachers should be teachers, teaching and educating people, not only to carry out cultural knowledge education, but also to carry out ideological, moral, legal and discipline education.

Teachers should cherish students, respect their personality, safeguard their legitimate rights and interests, and may not abuse or physically punish them. Students who are backward, mentally retarded or disabled shall not be discriminated against or left unattended. Twelfth schools and teachers should educate and stop disturbing school order or intercepting, insulting, beating or extorting students' property, and report to the public security organs when necessary. Thirteenth schools should support the affiliated Communist Youth League, Young Pioneers and Students' Union to carry out activities conducive to students' physical and mental health, and listen to their opinions and suggestions. Fourteenth schools and teachers are prohibited from overcharging students in violation of state regulations, and it is forbidden to punish students who violate school rules by means of fines. Fifteenth schools should establish a parent-teacher conference system and a home visit system to provide family education and guidance to parents. Parents or other guardians should actively cooperate with schools and teachers to do a good job in the discipline of students.

Schools and teachers shall, in accordance with the provisions of Article 8 of these regulations, educate and stop students with bad behavior. Chapter IV Protection of State Organs Article 16 Local people's governments at all levels must create conditions for school-age children and adolescents to receive compulsory education. Except due to illness or special circumstances, if school-age children and adolescents do not attend school to receive compulsory education, the local people's government shall criticize and educate their parents or other guardians and order them to send their children or ward to school. Seventeenth local people's governments at all levels should be concerned about the growth of minors, especially to help disabled minors in life, education, rehabilitation, employment and other aspects, and safeguard their legitimate rights and interests.

No organization or individual may discriminate, insult or abuse disabled minors. Eighteenth local people's governments at all levels should encourage and support schools, social organizations and citizens to carry out physiological, psychological, legal, educational and other consulting services for the education of minors; Encourage and support retired cadres, workers, PLA officers and soldiers and social celebrities to serve as minors' counselors. Article 19 Local people's governments at all levels shall support and organize news propaganda, culture and art departments and individuals to create or provide works suitable for minors' characteristics and beneficial to their physical and mental health, so as to enrich their spiritual and cultural life.
