Regulations of Guangxi Zhuang Autonomous Region on Prevention and Control of Soil Pollution

Chapter I General Provisions Article 1 In order to protect and improve the ecological environment, prevent and control soil pollution, safeguard public health, promote the sustainable utilization of soil resources, promote the construction of ecological civilization, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Soil Pollution and other relevant laws and administrative regulations, combined with the actual situation of this autonomous region. Article 2 These Regulations shall apply to the prevention and control of soil pollution and related activities within the administrative area of this autonomous region. Article 3 The prevention and control of soil pollution shall adhere to the principles of giving priority to prevention, giving priority to protection, classified management, risk control, pollution responsibility and public participation. Article 4 All organizations and individuals shall fulfill their obligations to protect the soil environment and prevent soil pollution, and enjoy the right to participate in and supervise the prevention and control of soil pollution.

Organizations and individuals engaged in land development and utilization activities or production and operation activities shall take effective measures to prevent and reduce soil pollution, and shall be responsible for the soil pollution caused by it according to law. Fifth people's governments at all levels are responsible for the prevention and control of soil pollution and the safe use of soil within their respective administrative areas.

The target responsibility system and assessment system shall be implemented for the prevention and control of soil pollution. The people's governments at or above the county level shall take the completion of soil pollution prevention and control objectives as the content of the assessment of the departments and their responsible persons responsible for the supervision and management of soil pollution prevention and control of the people's governments at lower levels and the people's governments at the same level, and make the assessment results public. Article 6 People's governments at or above the county level shall strengthen their leadership in the prevention and control of soil pollution, establish a comprehensive coordination mechanism for the prevention and control of soil pollution, study and solve major problems in the prevention and control of soil pollution, and formulate and implement plans, policies and measures for the prevention and control of soil pollution. The prevention and control of soil pollution across administrative regions shall be settled by the relevant people's governments through consultation; If negotiation fails, it shall be settled by the people's government at the next higher level.

Township people's governments and sub-district offices shall, in accordance with the provisions of laws and regulations and the entrustment of the relevant departments of the people's governments at higher levels, carry out the prevention and control of soil pollution.

Village (neighborhood) committees assist in the prevention and control of soil pollution and guide villagers to protect the soil environment. Article 7 The competent departments of ecological environment of the people's governments of autonomous regions and districts shall exercise unified supervision and management over the prevention and control of soil pollution within their respective administrative areas.

The competent departments of agriculture, rural areas, natural resources, housing and urban construction, forestry and other people's governments at or above the county level shall supervise and manage the prevention and control of soil pollution within their respective functions and duties, and the competent departments of development and reform, industry and information technology, finance, water conservancy, health, science and technology, transportation, emergency and other departments shall do a good job in the prevention and control of soil pollution within their respective functions and duties. Article 8 The competent department of ecological environment of the people's government of the autonomous region shall, in accordance with the relevant provisions of the state and the autonomous region, establish a basic database of soil environment with the competent departments of development and reform, industry and informatization, natural resources, housing and urban construction, water conservancy, agriculture and rural areas, health and emergency, forestry and big data development of the autonomous region, and bring it into the unified management of the national soil environment information platform and the autonomous region data sharing and exchange platform, and implement data integration, dynamic update and information sharing. Article 9 People's governments at all levels and their relevant departments, grassroots mass autonomous organizations and news media shall strengthen publicity and education on soil pollution prevention and control, popularize relevant scientific knowledge on soil pollution prevention and control, raise the awareness of the whole society on soil pollution prevention and control, and guide the public to participate in soil pollution prevention and control according to law.

The news media should strengthen the supervision of public opinion on the illegal acts of polluting the soil environment. Chapter II Planning, Standards, Detailed Investigation and Monitoring Article 10 The people's governments at or above the county level shall incorporate the prevention and control of soil pollution into their national economic and social development plans and environmental protection plans.

The people's governments at or above the county level and their relevant competent departments shall incorporate the prevention and control of soil pollution into the planning when preparing various plans involving land use. Article 11 The competent department of ecological environment of the people's government of an autonomous region or a city divided into districts shall, jointly with the competent departments of development and reform, industry and informatization, natural resources, urban and rural housing construction, agriculture and rural areas, forestry, etc. According to the requirements of environmental protection planning, land use, soil pollution investigation, detailed investigation and monitoring results, formulate a plan for the prevention and control of soil pollution and report it to the people's government at the same level for approval before promulgation and implementation.

The plan for the prevention and control of soil pollution shall conform to the actual demand for the prevention and control of soil pollution, and specify the objectives and indicators for improving the quality of soil environment, pollution prevention and ecological protection measures, risk control and restoration projects, financial and technical support and completion time limit.

The people's government at the county level shall, according to the plan for the prevention and control of soil pollution, formulate the implementation plan for the prevention and control of soil pollution. The implementation plan should include the prevention and control of soil pollution in chemical parks and industrial parks involving heavy metal emissions within their respective administrative areas. Article 12 The people's government of the autonomous region may, according to the soil pollution situation, public health risk, ecological risk and economic and technical conditions of the autonomous region, formulate the soil pollution risk control standards of the autonomous region for the projects not specified in the national soil pollution risk control standards; For the projects that have been stipulated in the national soil pollution risk control standards, regional soil pollution risk control standards that are stricter than the national soil pollution risk control standards can be formulated. The risk control standard of soil pollution in the autonomous region shall be reported to the competent department of ecological environment in the State Council for the record.

The risk control standard of soil pollution in the autonomous region is mandatory.
