Auxiliary police are divided into civilian auxiliary police and service auxiliary police.
Social forces such as public security joint defense, public security volunteers, village protection teams and school protection teams, as well as personnel engaged in logistics services such as security, cleaning and catering in public security organs, do not belong to the auxiliary police. Article 4 The management of auxiliary police shall follow the principles of standardization according to law, clear rights and responsibilities, strict supervision and reasonable guarantee. Article 5 The people's governments at or above the county level shall strengthen the organization and leadership of the auxiliary police, incorporate the construction of auxiliary police into the local national economic and social development plan, scientifically allocate the scale of auxiliary police, strengthen supervision and inspection, and implement safeguard measures.
Auxiliary police labor remuneration, insurance benefits, equipment installation, education and training, daily management and other expenses included in the fiscal budget at the corresponding level. Article 6 The public security organs of the people's governments at or above the county level shall be responsible for the recruitment, use and management of auxiliary police.
The human resources and social security departments of the people's governments at or above the county level are responsible for guiding the recruitment of auxiliary police, determining their wages and salaries, and implementing social security work such as industrial injury insurance.
The veterans affairs department of the people's government at or above the county level is responsible for the acceptance, investigation and verification of the martyrs' evaluation of the auxiliary police who meet the conditions for the martyrs' evaluation, and puts forward the evaluation report and the pension work for the survivors of the martyrs.
Civil affairs, finance, health and other departments are responsible for the management of auxiliary police according to their respective responsibilities. Article 7 The assistance of auxiliary police to the people's police in performing their duties according to law shall be protected by law, and citizens, legal persons or other organizations shall support and cooperate.
The consequences of the behavior of the auxiliary police in performing their duties shall be borne by the public security organ that uses the auxiliary police. Eighth auxiliary police officers who have made outstanding achievements or contributions in their work shall be commended and rewarded in accordance with the provisions of the state and the autonomous region. Commend and reward the situation as a reference for the promotion of auxiliary police. Chapter II Recruitment Article 9 The public security organ of the people's government of the autonomous region shall, jointly with the departments of staffing, finance, human resources and social security at the same level, study and formulate measures for the management of auxiliary police personnel in public security organs, which shall be implemented after being approved by the people's government of the autonomous region.
The public security organ of the people's government at or above the county level shall, jointly with the human resources, social security, finance and other departments at the same level, formulate a local auxiliary police recruitment plan within the approved quota, report it to the people's government at the same level for examination and approval, and report it to the public security organ of the people's government at the next higher level for the record. Article 10 The recruitment of auxiliary police shall be jointly organized and implemented by the public security organs of the people's governments at or above the county level in conjunction with the human resources and social security departments at the same level according to the approved recruitment plan, or may be independently organized and implemented by the public security organs of the people's governments at or above the county level.
All police types, units and grass-roots teams of public security organs shall not organize the recruitment of auxiliary police by themselves. Eleventh auxiliary police recruitment should follow the principles of openness, equality, competition and merit, unify recruitment standards and procedures, clarify recruitment positions, and strictly select and employ. Article 12 The recruitment of auxiliary police officers shall be conducted in accordance with the procedures of voluntary registration, qualification examination, examination, physical fitness test, physical examination, inspection and publicity, and shall be subject to social supervision. Thirteenth auxiliary police should meet the following conditions:
(1) Having China nationality;
(2) Upholding the Constitution and observing national laws and regulations;
(three) at least eighteen years of age;
(4) Having good political quality and moral conduct;
(5) Having a high school education or above and working ability required to perform post responsibilities;
(6) Having the physical conditions and psychological qualities required for normal performance of duties;
(seven) other conditions stipulated by the state and the autonomous region. Article 14 When recruiting auxiliary police, priority should be given to the following personnel under the same conditions:
(1) Survivors of martyrs, soldiers who died in the line of duty and people's police;
(2) Retired soldiers and rescuers who quit the national comprehensive fire rescue team;
(three) courageous people, national unity and progress model individuals;
(4) graduates from public security or political and legal colleges;
(five) personnel with professional qualifications and special skills required for the post;
(six) other preferential employment as prescribed by the state and the autonomous region.
Items 1 and item 3 of the preceding paragraph can be planned separately and targeted for recruitment. Fifteenth for hard and remote areas, special posts and talents in urgent need, according to the needs of the work, we can adopt simplified recruitment procedures or other assessment methods for recruitment. Sixteenth any of the following circumstances, shall not be recruited as an auxiliary police:
(a) has been investigated for criminal responsibility or suspected crime has not been closed;
(2) Being expelled from public office or having his labor contract dissolved or terminated due to violation of law and discipline;
(3) Being listed as the disciplinary object of dishonesty according to law;
(four) other circumstances stipulated by the state and the autonomous region that are not suitable for police auxiliary work.
