(six) after the production safety accident, have the right to timely rescue and medical treatment, have the right to get compensation for work-related injury insurance;
The obligation of safe production is:
(1) During the operation, abide by the safety production rules and regulations and operation procedures of the unit, obey the management, and do not operate illegally;
(two) to receive safety education and training, and to master the knowledge needed for work and safety production;
(3) the hidden dangers of accidents shall be reported to the safety production management personnel or the main person in charge of the unit in a timely manner;
(4) Use and wear labor protection articles correctly.
Among them, construction workers have the right to ensure safe production according to law.
(A) the right to know and make suggestions on construction safety production
Employees of production and business units have the right to know the risk factors, preventive measures and emergency measures of accidents existing in their workplaces and posts, and have the right to make suggestions on the safety production of their own units.
Operators have the right to put forward suggestions for improvement of operating procedures and conditions that affect personal health. The construction unit shall provide the operators with safety protection articles and safety protection clothes, and inform them in writing of the operation procedures of dangerous posts and the hazards of illegal operations.
(2) the right to obtain construction safety protection articles
Production and business units must provide employees with labor protection articles that meet national standards or industry standards, and supervise and educate employees to wear and use them in accordance with the rules of use.
Operators have the right to obtain protective equipment needed for safe production. The construction unit shall provide safety protective articles and safety protective clothing for the operators.
(three) have the right to criticize, report, accuse and refuse illegal command.
It is stipulated that operators have the right to criticize, report and accuse acts that endanger life safety and personal health. Operators have the right to criticize, report and accuse the safety problems existing in the working conditions, procedures and methods on the construction site, and have the right to refuse illegal command and force risky operation.
"Safe production law" also stipulates. Production and business units shall not reduce their wages, welfare and other benefits or terminate their labor contracts because employees criticize, report, accuse or refuse to command or force risky operations in violation of regulations.
(4) Emergency avoidance right
Employees have the right to stop working or leave the workplace after taking possible emergency measures when they find an emergency that directly endangers their personal safety. The production and business operation entity shall not reduce the wages, welfare and other benefits of employees or terminate the labor contract with them because they stop working or take emergency evacuation measures in the emergency mentioned in the preceding paragraph. In case of emergency that endangers personal safety during construction, the operators have the right to immediately stop operation or evacuate the dangerous area after taking necessary emergency measures.
(five) the right to obtain compensation for work-related injury insurance and accidental injury insurance.
Construction enterprises shall pay work-related injury insurance premiums for employees who participate in work-related injury insurance according to law. Encourage enterprises to handle accidental injury insurance for employees engaged in dangerous operations and pay insurance premiums.
Accordingly, construction workers engaged in dangerous operations can enjoy not only the right of industrial injury insurance, but also the right of accidental injury insurance according to law.
(6) the right to claim civil compensation
Workers who suffer from production safety accidents have the right to claim compensation from their own units in addition to enjoying work-related injury insurance according to law and the right to compensation according to relevant civil laws.
(seven) relying on trade unions and dispatched workers to protect their rights.
The trade union of a production and business operation entity shall organize employees to participate in the democratic management and supervision of production safety in the entity according to law, and safeguard the legitimate rights and interests of employees in production safety. The production and business operation entities shall listen to the opinions of the trade unions when formulating or amending the rules and regulations related to production safety.
The trade union has the right to require the production and business operation entities to correct the acts that violate the laws and regulations on production safety and infringe upon the legitimate rights and interests of employees; When it is found that the production and business operation entities command or force risky operations in violation of regulations or find hidden dangers of accidents, they have the right to put forward solutions, and the production and business operation entities shall promptly study and reply; When it is found that the life safety of employees is endangered, it has the right to suggest to the production and business operation entities to organize employees to evacuate from dangerous places, and the production and business operation entities must deal with it immediately. The trade union has the right to participate in the accident investigation according to law, put forward handling opinions to the relevant departments, and demand that the relevant personnel be held accountable.
Where a production and business operation entity uses dispatched workers, the dispatched workers shall enjoy the rights of workers as stipulated in this Law.
Second, the construction workers should fulfill the obligations of production safety
(1) Abide by the law and correctly use safety protection equipment and other obligations.
Construction units should ensure the safety of construction personnel according to law, and construction personnel should also abide by relevant rules and regulations according to law, so as not to operate illegally.
Construction enterprises and operating personnel shall abide by the laws and regulations on production safety and the safety rules and regulations of the construction industry in the construction process, and shall not command or operate illegally. Employees should strictly abide by the safety production rules and regulations and operating procedures of the unit, obey management, and wear and use labor protection articles correctly. Operators shall abide by the mandatory standards, rules and regulations and operating procedures for safe construction, and correctly use safety protection appliances, machinery and equipment, etc.
(2) Obligation to receive education and training in production safety.
It is an important measure to control and reduce construction safety accidents for construction units to strengthen safety education and training, so that operators can have the necessary knowledge of construction safety production, be familiar with relevant rules and regulations and safety operation procedures, and master the safety operation skills of their posts.
It is stipulated that employees should receive education and training in production safety, master the knowledge of production safety required for their own work, improve their skills in production safety, and enhance their ability in accident prevention and emergency handling. Before entering a new post or a new construction site, operators shall receive education and training in production safety. Without education and training or education and training examination unqualified personnel shall not work at their posts.
(3) the obligation to report the hidden dangers of construction safety accidents
Construction safety accidents are usually caused by hidden dangers or other unsafe factors. Therefore, once the construction personnel find hidden dangers of accidents or other unsafe factors, they should immediately report them so as to take timely measures to nip in the bud.
Employees who find hidden dangers of accidents or other unsafe factors shall immediately report to the on-site safety production management personnel or the person in charge of the unit, and those who receive the report shall deal with them in time.
(4) Obligations of the dispatched workers
Where a production and business operation entity uses dispatched workers, the dispatched workers shall perform the obligations of workers as stipulated in this Law.
