Measures of the People's Court on Archives Management

I. General Provisions Article 1 In order to strengthen the archives management of the people's courts, these Measures are formulated in accordance with the relevant provisions of the Archives Law of People's Republic of China (PRC), the Measures for the Implementation of the Archives Law of People's Republic of China (PRC) and the Regulations on the Work of Government Archives, and in combination with the actual archives of the people's courts. Article 2 Most of the files of the people's courts are litigation files. Litigation file is one of the important professional files of the country, a true record of the trial activities of the people's courts, and an important basis and necessary condition for doing a good job in trial and implementing trial supervision. The management of litigation files is an inseparable part of trial work. Article 3 The archives institutions of the people's courts at all levels shall be responsible for centralized and unified management of all archives of the courts (including archives of various categories and carriers), actively providing and utilizing them, and effectively serving the trial and other work. Ensuring the integrity and integrity of archives is the common task of leaders at all levels and all staff of the people's courts. Article 4 The archival work of local people's courts at all levels shall be subject to the supervision and guidance of the archival institutions of the people's courts at higher levels and the archival administrative departments at the same level. Two. Institutions and responsibilities Article 5 People's courts at all levels shall set up archives institutions that are suitable for their functions and tasks, and be equipped with full-time archives cadres that are suitable for their tasks. Article 6 The staffing of archival cadres in people's courts at all levels shall refer to the relevant provisions of the Ministry of Labor and Personnel and the National Archives Bureau, and take 1 full-time archival cadres who keep ten thousand files (pieces) as the base according to the current actual situation of the courts. More than fifteen thousand copies of the part of each additional person. Seventh people's court archives function:

(a) the implementation of laws, regulations and policies related to archives work.

(two) unified collection, sorting, storage and statistics of all the archives of our hospital, actively and effectively carry out the work of utilization and compilation, and serve the leadership, judicial work and other work of our hospital.

(three) to supervise and guide the filing of documents and materials of courts at all levels (including people's courts) and other departments in our hospital.

(4) The archival institutions of the intermediate people's courts are responsible for establishing and improving the rules and regulations on the archival work of the courts in their respective jurisdictions, making archival work plans, holding archival work meetings, organizing experience exchanges, conducting professional training for archival cadres, and conducting professional supervision and guidance on the archival work of the lower people's courts.

Article 8 People's courts at all levels shall appoint judges, assistant judges and clerks who are politically reliable, have a strong sense of responsibility, are healthy and have a high school education or above to engage in archival work. Archives cadres with unclear titles should be appointed or evaluated with corresponding titles. The ranks of archival cadres should remain relatively stable. Article 9 People's courts at all levels shall commend and reward archival cadres who are loyal to their duties, study hard and have made remarkable achievements in their work. Three. Receiving and sorting out archives Article 10 The archives institutions of the people's courts shall do a good job in receiving, inspecting and filing archives in accordance with the provisions. The quality of archives shall be guaranteed, and those that do not meet the requirements shall not be accepted for filing. Eleventh archived files should be stamped with the "archive" chapter in the upper right corner of the file cover. At the same time, according to the category, year, trial grade and storage period, register the file directory and retrieve the cards. Article 12 The litigation file shall be kept by the case. The files of the same case with multiple case numbers due to trial level changes or other reasons shall be stored centrally. The requirements for the merger are: the retrial volume is merged into the first or second trial volume; The appeal volume formed by appealing to our court is incorporated into the trial volume of our court, and the appeal volume formed by appealing to the superior court is filed by the superior court; In recent years, the appeal volume has been merged into the early appeal volume. When files are merged, the relevant case numbers of moving out and moving in should be indicated on the file cover, file register and search card. Article 13 People's courts at all levels shall, according to the actual situation of their respective files, compile scientific retrieval tools to improve work efficiency and quality. Four. Utilization of Archives Article 14 The staff of our hospital must have a borrowing form signed by the leaders of the hospital and office where they work, and the borrowed files should be returned within the prescribed time limit. When the staff is transferred, the archives management department shall go through the liquidation procedures. Fifteenth Party committees, the Standing Committee of the National People's Congress and the relevant courts, public security organs, state security organs, procuratorates to borrow files, must hold a formal letter of introduction and work permit (ID card), after the approval of the relevant leaders, go through the formalities of borrowing files and return them within a time limit. Other units are not allowed to borrow in principle. Sixteenth foreign units to consult the archives, should be at or above the county level (county, district, township, street office above) letter of introduction, in accordance with the relevant provisions of the transfer. No access to files involving state secrets, personal privacy and adverse effects on society. Lawyers should consult the case files through the original case undertaker. Except for conclusive materials such as judgments, rulings and conciliation statements, other materials are not allowed to be extracted and copied in principle. Seventeenth file users are not allowed to open, extract information, alter, sketch, deface the lent or consulted files, and offenders will be held accountable. Article 18 People's courts at all levels shall set up marking rooms for internal investigation and external investigation to facilitate confidentiality and supervision. Article 19 Archivists must strictly abide by discipline, keep state secrets, and may not expand the scope of utilization or disclose the contents of archives without authorization.
