Article 2 These Provisions shall apply to the health care services for women who enter puberty and after puberty and children under 6 years old (hereinafter referred to as health care objects) within the administrative area of this Municipality.
These provisions shall not apply to the treatment of diseases whose health care objects are beyond the scope of health care services.
Article 3 The municipal, municipal and district health administrative departments in Qingdao are the departments in charge of women's and children's health care under the people's governments at the same level. Its main responsibilities are:
(a) to publicize and implement the laws, regulations, rules and policies related to the health care of women and children;
(two) the preparation of women's and children's health care development plans and plans;
(3) Organizing women's and children's health care and scientific research activities;
(four) the implementation of supervision and inspection of women and children's health care services;
(five) the implementation of birth control technical guidance and family planning technical quality supervision and management;
(six) to deal with disputes between medical and health institutions and medical and health care objects;
(seven) other duties as determined in these Provisions.
The specific management of women's and children's health care is the responsibility of the maternal and child health care management institutions designated by the health administrative departments of Qingdao and cities and districts.
Article 4 Departments of planning, civil affairs, family planning, finance, prices, taxation, education, labor, personnel, etc. must cooperate with health administrative departments to do a good job in women's and children's health care within the scope of their respective duties.
Article 5 To carry out health care for women and children, we should adhere to the principle of giving priority to prevention and serve to reduce maternal and infant mortality, birth defects, the incidence of common diseases among women and children and improve the quality of the population.
Article 6 The health care rights enjoyed by women and children shall be protected by law.
All units and individuals should support and encourage women and children to participate in health care.
This Municipality shall provide key health care services to women and children under the age of 3 during pregnancy and postpartum statutory maternity leave (hereinafter referred to as key health care targets).
Article 7 Health care for women and children shall be incorporated into the national economic and social development plan.
People's governments at all levels should strengthen their leadership over women's and children's health care work, incorporate the reduction of maternal and infant mortality into the responsibility objectives of government leadership positions at the corresponding level, and provide favorable conditions for the development of women's and children's health care.
The people's governments at or above the county level shall create conditions, establish scientific research institutions for maternal and child health care, and encourage and support relevant educational and scientific research activities.
Chapter II Medical and Health Institutions
Article 8 The maternity and child care centers established in Qingdao and other cities and districts are specialized institutions that specifically implement women's and children's health care services. Its main responsibilities are:
(a) to participate in the implementation of women's and children's health care development plans and plans;
(two) according to the division of labor, responsible for the investigation, registration and filing of health care objects;
(three) to undertake tasks related to health care services and guide designated units of maternal and child health care to carry out health care services;
(4) Training relevant professional and technical personnel;
(five) to carry out health research activities;
(six) to cooperate with the health and epidemic prevention departments to do a good job in vaccination and prevention and control of infectious diseases;
(seven) other duties as determined in these Provisions.
Article 9 Hospitals, health centers (institutes), out-patient departments, clinics and other medical institutions (including medical institutions established by government agencies, military units, enterprises, institutions or individuals) that meet the requirements after examination by the administrative department of health can be identified as designated units for maternal and child health care and undertake health care services within the prescribed scope.
For streets and villages that have no medical institutions or have medical institutions, but do not have the conditions to be designated units for maternal and child health care, local maternal and child health care institutions shall set up institutions or determine professional and technical personnel to undertake their maternal and child health care services.
Tenth designated units of maternal and child health care must meet the following basic conditions:
(a) there are places, equipment, instruments and other facilities to meet the needs of medical and health care services;
(2) Having specially trained medical and health care professionals to meet the needs of medical and health care services;
(3) Having safety and hygiene conditions and measures that meet the requirements of medical and health care services;
(4) Other conditions stipulated by the Ministry of Health.
The basic conditions of maternal and child health care at all levels shall be implemented in accordance with the provisions of the Ministry of Health.
Eleventh was identified as the designated unit of maternal and child health care, by the Qingdao municipal health administrative department issued a designated unit of maternal and child health care logo and certificate; The signboard must be hung in a prominent position at the door of the designated maternal and child health care unit.
Twelfth professional and technical personnel engaged in women's and children's health care services shall meet the following basic conditions:
(a) in line with the requirements of the "medical ethics standards for medical personnel" stipulated by the Ministry of Health;
(2) graduated from secondary medical school or equivalent;
(three) more than 2 years of clinical practice experience;
(four) familiar with the professional knowledge and skills of women and children's health care;
(5) Being in good health;
(6) Other conditions as determined in these Provisions.
Thirteenth women and children's health care professional and technical personnel to implement the certificate system. Professional and technical personnel engaged in women's and children's health care services must receive the training of professional knowledge and skills related to women's and children's health care, and be assessed by the health administrative department, and post certificates will be issued after passing the examination. The post certificate shall be uniformly printed by the health administrative department of Qingdao.
Fourteenth any unit or individual outside the scope of authorization of these Provisions shall not engage in the work of women's and children's health care services without the examination of the administrative department of health.
Fifteenth women's and children's health care technical appraisal work, by the local city, District People's government set up a medical technical appraisal organization is responsible for; If the medical technical appraisal organization has not been established, the health administrative department shall employ relevant experts to form an expert group.
Chapter III Health Care Services
Article 16 The scope of women's routine health care includes adolescence, perinatal period, pregnancy, puerperium, lactation period, reproductive adjustment period, perimenopausal period and old age. Among them, perinatal health care must include premarital medical examination (including men); Pregnancy and perinatal care should be combined with fetal care (from the 28th week of pregnancy to birth).
The scope of routine health care for children includes: newborn (within 28 days of birth), infancy (from 28 days of birth to 1 year), infancy (1 year to 3 years old) and infancy (from 3 to 6 years old).
Child vaccination can be combined with child health care.
Seventeenth main contents of providing health care services for health care objects:
(a) women's perinatal period, puerperal period, neonatal period, infancy and early childhood regular routine examination and monitoring;
(two) the general survey of cancer prevention in women's reproductive organs and the preventive examination of common diseases in children;
(3) Prevention and monitoring of seasonal or regional epidemics and frequently-occurring diseases, investigation after the onset and medical advice;
(four) health knowledge publicity and education and consulting services in physical, psychological and behavioral health, nutrition and hygiene.
Conditional maternal and child health centers or designated units of maternal and child health care can set up family-style health care wards to implement health care services in agreement with health care targets.
Eighteenth maternal and child health care hospitals or designated maternal and child health care units found that health care objects suffer from diseases beyond the scope of health care services, and should promptly recommend treatment; Need to put forward medical advice, in accordance with the relevant provisions of the state.
Nineteenth health care objects (or their guardians, the same below) can choose the nearest maternal and child health care center for health care registration; Health care objects with work units can be collectively registered by their units. Street residents' committees or villagers' committees shall assist local maternal and child health hospitals to do a good job in health care registration of health care objects.
Maternal and child health hospitals must sign health care service contracts with registered health care objects or units, and stipulate the rights and obligations of both parties.
Twentieth according to the provisions of the registration and payment of health care objects (including free), issued by the local maternal and child health care institutions "health handbook". The health care manual shall indicate the health care items and contents that the health care object participates in. The Health Manual is uniformly printed by the health administrative department of Qingdao.
Twenty-first holders of the "Health Handbook" enjoy the prescribed items and contents of health care services; Maternal and child health hospitals or designated maternal and child health care units must provide health care services according to the prescribed items and contents. After each health care service, the health care doctor will fill in the health care manual and sign it, and give it to the health care object for preservation.
Maternal and child health hospitals or designated units of maternal and child health care should fill in the health care service card every time after providing health care services for the health care objects, and save it after being signed by the health care objects.
Maternal and child health hospitals or designated units of maternal and child health care fail to provide health care services for health care objects according to the prescribed items and contents, and health care objects have the right to apply to local women's health care management institutions for prescribed compensation standards.
Twenty-second health care objects with health care manuals can choose maternal and child health care centers or designated units for maternal and child health care to receive health care services in local cities and districts (Shinan, Shibei, Sifang and Licang); If it is necessary to cross the local city or district 4 and Laoshan, Chengyang and Huangdao districts, it will be arranged by the local maternal and child health hospital.
The health care object has the right to change the selected maternal and child health care center or the designated maternal and child health care unit, but it must go through the change formalities at the local maternal and child health care center 30 days in advance.
Those who belong to pre-marital medical examination shall be borne by the maternal and child health care designated by the health administrative department.
Twenty-third health administrative departments and maternal and child health care management institutions shall promptly organize the investigation and handling of health accidents or incidents. The specific measures for handling health accidents shall be formulated by the administrative department of health of Qingdao Municipality and implemented after being approved by the Qingdao Municipal People's Government.
Chapter IV Medical and Health Care Fund
Twenty-fourth women's and children's health care funds (including personnel funds and business funds) and infrastructure construction, purchase and repair investment and scientific research funds should be included in the fiscal budget at the same level.
For seasonal or regional epidemic, frequently-occurring disease prevention, monitoring and other expenses, by the health administrative department to make a special application, the finance at the same level shall be appropriated.
Twenty-fifth the establishment of special funds for women and children's health care services. Source of funds:
(a) by the financial allocation according to the principle of grading burden. Is the financial burden of Qingdao, according to the annual per capita is not lower than the standard of 0.2 yuan appropriated; Belonging to the financial burden of the city and district, it shall be implemented in accordance with the standards appropriated by Qingdao Municipal Finance.
(2) Enterprises within the administrative area of this Municipality (including the whole people, collectives, private enterprises, foreign-invested joint-stock enterprises and other enterprises) shall be drawn every year according to the proportion of 1.5‰ of the total wages of the enterprise in the previous year, and the cost shall be amortized by stages.
(three) according to the proportion of (two), belonging to the self-supporting institutions, paid from its own funds; Is a financial institution, by the health administrative department in consultation with the financial department to adjust expenses from the relevant funds.
The special funds for women's and children's health care services are mainly used to determine the cost of health care services for health care recipients who are given relief according to these regulations.
Twenty-sixth health care objects to participate in health care services, according to the items and contents of health care services they participate in, individuals should pay health care compensation fees in one lump sum or in installments as agreed. However, for women's health care objects who pay special funds for women's and children's health care services, when participating in the health care services referred to in Item (1) of Article 17 of these Provisions, the health care compensation fee shall be charged at a reduced rate of 80%; The key health care objects with special difficulties in family life without fixed income shall apply to the health administrative department for approval, and the health care compensation fee shall be reduced or exempted.
The collection standard of health insurance compensation fee and the standard of insurance compensation amount shall be approved by the administrative department of health of Qingdao Municipality in conjunction with the administrative department of price.
Twenty-seventh special funds for women and children's health care services and health care compensation fees paid by individual health care objects shall be collected by the local municipal, district and Qingdao maternal and child health care management institutions or entrusted by relevant departments.
Twenty-eighth medical and health services included in the maternity insurance project shall be appropriately extracted from the maternity insurance expenses by the maternal and child health care management institution. The extraction standard shall be determined by the administrative department of health of Qingdao Municipality in conjunction with the administrative departments of labor and price.
Twenty-ninth enterprises or institutions that implement the overall system of medical insurance funds should be included in the arrangements for women and children's health care services.
Thirtieth to encourage domestic and foreign organizations and individuals to donate money to develop women's and children's health care.
Donors can enjoy the preferential and encouraging policies stipulated in these regulations on an equal footing.
Thirty-first women and children's health care costs by the local city, district and Qingdao maternal and child health care management institutions to set up a special account for storage, as a whole for women and children's health care, no unit or individual may intercept or misappropriate.
Qingdao city, city and district maternal and child health care management institutions should settle accounts and share health care service fees with relevant maternal and child health care centers or designated units every quarter.
Chapter v rewards and punishments
Thirty-second units and individuals that have made remarkable achievements in the health care of women and children in the implementation of these provisions shall be commended and rewarded by the people's government or the administrative department of health.
Thirty-third difficulties, hinder the health care object to receive health care services, by the health administrative department to give informed criticism, instructed to make corrections within a time limit; If the circumstances are serious, the main person in charge and the person directly responsible shall be given administrative sanctions by the competent department.
Article 34 Whoever, in violation of the provisions of these Regulations, engages in health care services for women and children without examination shall be stopped by the administrative department of health, and may be given a warning or a fine of more than 500 yuan 10000 yuan according to the seriousness of the case.
Article 35 Whoever, in violation of the provisions of this Ordinance, fails to pay the special funds for women's and children's health care services within the time limit shall be ordered by the maternal and child health care management institution to make up the overdue payment, and a late payment fee of 1‰ shall be added on a daily basis from the date of delay.
Thirty-sixth interception, misappropriation or other occupation of women's and children's health care costs, the competent authorities shall give administrative sanctions to the responsible personnel; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 37 Where a maternal and child health hospital or a designated unit of maternal and child health care lowers its service standard, impairs the interests of the health care object, or causes a health accident, the administrative department of health shall, depending on the seriousness of the case, order it to stop its health care service or cancel its qualification as a designated unit. The person in charge of the responsible unit and the person directly responsible shall be given administrative sanctions by the competent department according to the circumstances; If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirty-eighth maternal and child health care management personnel in violation of the provisions, dereliction of duty or malpractice, shall be given administrative sanctions by the competent department; If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter VI Supplementary Provisions
Thirty-ninth problems in the specific implementation of these Provisions shall be interpreted by the administrative department of health of Qingdao Municipality.
Article 40 These Provisions shall come into force as of June 1995.
