Organs and units involving state secrets shall establish security organizations, determine full-time or part-time security staff and manage the security work of their own units.
Security personnel should receive special training from the Security Department. Article 3 State organs and units involved in state secrets shall educate their staff on secrecy, establish a secrecy system, improve secrecy facilities and regularly check the secrecy work. Article 4 State organs and units involved in state secrets shall, in accordance with the relevant provisions of the State, promptly determine the classification and duration of state secrets.
Scientific and technological achievements and projects that belong to state secrets shall be classified and kept secret in a timely manner, signed by the competent department of science and technology of the city, region or autonomous prefecture where they are located, and submitted to the competent department of science and technology of the state for examination and approval after being audited by the competent department of science and technology of the province. Article 5 If there is any dispute over whether it belongs to a state secret and what kind of classification it belongs to, it shall report the disputed matters and the reasons for determining the classification in writing to the state or provincial secrecy department for confirmation. Before the confidentiality department determines the classification, both parties to the dispute should first manage according to the highest classification in the dispute. Article 6 Organs and units involved in state secrets shall regularly clean up the generated state secrets. If it is found that the classification needs to be changed or decrypted, it shall go through the formalities of change or decryption in time and inform the relevant units and personnel. Article 7 The scope of personnel who have access to state secrets shall be limited by the leaders in charge of the units that have determined the secret level or the units that are allowed to have access to secret matters. The personnel who come into contact with top-secret state secrets shall be limited by the units that determine top-secret matters. Article 8 State secret documents and materials shall be printed and destroyed by designated units approved by the secrecy department. The destruction of state secret documents and materials shall be registered and supervised by special personnel.
No unit or individual may hand over state secret documents and materials to non-designated units for printing or destruction; State secret documents and materials shall not be sold to units and individuals that purchase waste products. Article 9 Wired and wireless communication facilities and computer equipment used for transmitting and storing state secrets shall adopt security technical measures according to the requirements of the security department and the state security department. Tenth news publishing units and information providers shall, in accordance with the provisions, conduct self-examination of information that may involve state secrets to be published and reported publicly; Information that is not clear about whether it involves state secrets shall be submitted to the relevant competent department or higher authorities or units for examination and approval. Eleventh important activities involving state secrets, the organizer shall inform the security department at the same level in advance, and take corresponding security measures. Article 12 When receiving overseas visitors to visit, discuss business or engage in academic exchanges involving state secrets, the receiving unit shall take corresponding security measures according to state regulations and actual conditions to prevent the disclosure of state secrets. Article 13 If it is really necessary to bring documents, materials and other articles belonging to state secrets out of the country because of work needs, it shall, after obtaining the consent of the secret-related unit, apply to the secrecy department of the local people's government at or above the city, region or autonomous prefecture for an exit permit; When leaving the country, you should take the initiative to declare to the customs. Article 14 A person who keeps state secrets shall leave the country or apply for a job in a foreign-invested enterprise or foreign institution in China, and shall report to his unit or higher authorities for examination and approval in accordance with the management authority. Article 15 State functionaries and other persons involved in state secrets shall not disclose the state secrets they know, and shall abide by the following provisions:
(a) without permission or confidentiality guarantee, no documents, materials and other articles belonging to state secrets shall be produced, sent, received, transmitted, used, copied, extracted, preserved and destroyed;
(two) do not use wired and wireless communication facilities and electronic computer equipment without security technical measures to transmit state secrets;
(3) Private correspondence and published articles and works do not involve state secrets;
(four) do not carry documents, materials and other articles belonging to state secrets to participate in social activities or to enter and leave public places;
(five) no documents, materials and other articles belonging to state secrets shall be mailed or illegally carried;
(six) shall not illegally provide state secrets in interviews with reporters or foreign exchanges;
(seven) do not conceal their own or others' leaks. Article 16 Citizens have the obligation to protect state secrets and should take corresponding measures under the following circumstances:
(a) found that others lost documents, materials and other items belonging to state secrets, should be promptly sent to the relevant units or local security departments;
(2) Discovering that others sell or buy documents, materials and other articles that belong to state secrets, or disclose or may disclose state secrets, they shall dissuade them and report to the secrecy department or the nearby public security and state security organs;
(3) If it is found that others have stolen, robbed or defrauded documents, materials and other articles belonging to state secrets, it shall immediately report to the local public security, state security organs and secret departments for handling.
