Chapter 1 General Principles

Article 2 These regulations shall apply to the production safety and supervision and management of production safety of units engaged in production and business activities within the administrative region of this province (hereinafter referred to as production and business units).

If relevant laws and regulations have other provisions on fire safety, road traffic safety, railway traffic safety, water traffic safety, and civil aviation safety, those provisions shall prevail.

Article 3 Safety production management adheres to the policy of safety first, prevention first, and comprehensive management.

Article 4 Production and business units shall strengthen production safety management, establish and improve various production safety management systems and responsibility systems, improve production safety conditions, and ensure production safety.

Article 5 Governments at all levels shall strengthen leadership over production safety, incorporate production safety into economic and social development plans, and support and urge relevant departments to perform their work safety supervision and management responsibilities in accordance with the law.

Governments at all levels and their relevant departments should carry out safety production publicity and education to improve citizens’ safety production awareness.

Article 6 The production safety supervision and management departments of governments at or above the county level and other relevant departments shall, within the scope of their respective responsibilities, do a good job in the supervision and management of production safety in accordance with the law.

Article 7 The trade union shall organize employees in accordance with the law to participate in the democratic management and democratic supervision of the unit's production safety work, and safeguard the legitimate rights and interests of employees in production safety.

News units should create a public opinion atmosphere conducive to production safety and strengthen public opinion supervision of production safety.

Article 8 Encourage and support production and business units to adopt new technologies and new processes to improve production safety levels.

Governments at all levels have made significant achievements in improving production safety conditions, preventing production safety accidents, participating in emergency rescues, researching and promoting production safety science and technology, and reporting violations of production safety laws and regulations. Chapter 2: Safety Production Guarantee of Production and Business Units

Article 9 Production and Business Units shall meet the following safety production conditions:

(1) Have a sound production and operation system Safety production rules and regulations and operating procedures;

(2) Production and operation sites, equipment, and facilities comply with relevant production safety laws and regulations, and meet the requirements of national standards or industry standards;

(4) Have systems, equipment and facilities to prevent occupational hazards;

(5) For Employees are equipped with labor protection supplies that comply with national standards or industry standards;

(6) Production and operation units such as mining, construction, hazardous chemicals, fireworks, and civilian blasting equipment have obtained safety production licenses in accordance with the law or Business license;

(7) Other production safety conditions stipulated in laws, regulations, national standards or industry standards.

Article 10 Production and business units must apply for work-related injury insurance for employees in accordance with the law. For underground coal mine workers, they must also purchase accidental injury insurance with a compensation amount of more than 30,000 yuan per person and pay the insurance premium.

Article 11 Production and business units shall not use production technologies, processes and equipment that endanger production safety that are prohibited or explicitly eliminated by the state and the province.

The catalog of production technologies, processes and equipment that endangers production safety that are prohibited from use and explicitly eliminated by the province shall be formulated by the provincial government. If the state has other regulations, those regulations shall prevail.

Article 12 A production and business operation unit shall, based on the characteristics of the unit's production and operation, monitor the production and operation links that are prone to production safety accidents. If any hidden dangers of production safety accidents are discovered, measures shall be taken immediately to eliminate them.

Article 13 Safety facilities in new construction, reconstruction, and expansion projects of production and business operation entities shall be designed, constructed, and put into production and use at the same time as the main project.

If the design of safety facilities approved by relevant departments needs to be significantly modified, the approval of the original approving unit shall be obtained.

Article 14 The main person in charge of the production and business unit shall have the following responsibilities for the unit's production safety work:

(1) Establish and improve the production safety management system and responsibility system and organize their implementation ;

(2) Organize the formulation and implementation of emergency rescue plans for production safety accidents;

(3) Organize regular production safety inspections to eliminate accident hazards in a timely manner;

(4) Regularly organize managers and employees to learn production safety laws, regulations and safety knowledge, and improve the safety awareness of employees;

(5) Ensure necessary investment in safety production and effective use;

(6) Report production safety accidents in a timely and truthful manner, actively cooperate with the investigation and evidence collection of production safety accidents, and do a good job in the aftermath;

(7) Other responsibilities prescribed by laws and regulations.

Article 15 The principal persons in charge of production and business units, production safety management personnel and employees shall receive no less than 16 hours of safety production education and training every year.

Newly recruited personnel must receive no less than 40 hours of safety production education and training before taking up their posts.

If laws and regulations have other provisions on safety education and training time, those provisions shall prevail.

Employees who have not received qualified production safety training are not allowed to work.

Article 16 Employees have the right to put forward opinions, criticisms, reports and accusations on problems existing in the unit's production safety work, and have the right to refuse illegal instructions and forced risky operations. Production and business units shall not retaliate against them in the form of removal from office, dismissal, or reduction of wages or welfare benefits.

Article 17 The production and business units of song and dance halls, theaters, stadiums (venues), hotels, restaurants, shopping malls, tourist areas (spots), Internet cafes and other public gathering places shall Comply with the following regulations:

(1) Have obvious safety exit signs and evacuation routes that meet the requirements;

(2) Have intact and effective emergency broadcasts, emergency lighting facilities, fire protection equipment, etc. Equipment and command system;

(3) The actual number of people accommodated in the business premises shall not exceed the specified capacity;

(4) Other provisions of laws and regulations.

Article 18 Coal mining enterprises shall establish a safety fee extraction system in accordance with relevant national regulations.

Production and operation units in industries such as mining, construction, hazardous chemicals, fireworks and firecrackers, and civilian explosive equipment shall implement a safety production risk deposit system in accordance with relevant national regulations. Specific measures shall be formulated by the provincial government.

Article 19 A production and operation unit with a mine shall establish a mine rescue team or sign a rescue agreement with a nearby mine rescue team. The rescue agreement shall include the rights and obligations of both parties, rescue and disposal measures, and rescue costs. etc. content.

The charging standards for ambulance fees are set by the price department of the provincial government.

Article 20 Safety evaluation institutions and safety evaluation personnel shall obtain corresponding safety evaluation qualifications and qualifications in accordance with the law, issue true safety evaluation reports, and be responsible for the safety evaluation reports.

Safety evaluation agencies and safety evaluation personnel shall keep commercial secrets and technical secrets for the production and operation units being evaluated.

Chapter 3: Supervision and Management of Production Safety

Article 21 Supervision and management of production safety shall be subject to territorial management by governments at or above the county level and relevant departments where production and business activities are located .

Governments at or above the county level and their relevant departments should establish and improve the responsibility system for safety production supervision and management.

Article 22 The production safety supervision and management departments of governments at or above the county level shall implement comprehensive supervision and management of production safety work within their own administrative regions in accordance with the law; guide, coordinate and supervise other departments responsible for production safety supervision and management Perform safety production supervision and management responsibilities.

The work safety supervision and management department of the higher-level government supervises, inspects, guides and coordinates the work safety supervision and management work of the lower-level government in accordance with the law.

Other government departments at or above the county level are responsible for the corresponding work safety supervision and management in accordance with the provisions of laws and regulations and the responsibilities determined by the governments at the same level.

Article 23 Township, town governments and sub-district offices are entrusted by the production safety supervision and management department of the county-level government to inspect the production safety of production and business units, report and assist in handling production safety accidents, Handle other entrusted matters.

Township and town governments and sub-district offices should identify full-time or part-time work safety supervision and management personnel; if the work safety supervision and management tasks are heavy, a work safety supervision and management agency should be established.

Article 24 Governments at or above the county level and departments responsible for the supervision and management of production safety shall establish and improve the production safety work meeting system and hold at least one production safety work meeting every quarter to analyze the safety production work meeting in their respective regions and regions. The safety production situation of the industry, researching and formulating measures and plans to prevent accidents, and coordinating and solving major issues in safety production and supervision and management.

Article 25 Governments at or above the county level and departments responsible for the supervision and management of production safety shall organize at least once every six months an inspection of the production safety work of production and business units and production and business sites prone to production safety accidents. When conducting safety production supervision and inspection, more than two safety production supervision and inspection personnel should participate, and present valid law enforcement certificates, and make written records of the time, location, content, problems discovered, etc. of the inspection , signed by the inspector and the person in charge of the inspected unit.

Article 26 If governments at or above the county level and departments responsible for the supervision and management of production safety discover hidden dangers in production safety accidents during inspections, they shall order the production and business units to take measures to eliminate them immediately; if they cannot be eliminated immediately, , they should be eliminated within a time limit and their implementation should be urged. During the time limit for elimination, the production and business units shall be instructed to set up accident hazard warning signs at conspicuous locations on the production and business premises.

If the departments responsible for the supervision and management of production safety at or above the county level discover major hidden dangers in production safety accidents during the inspection process, they shall communicate the situation in writing; any safety problems discovered shall be handled by other relevant departments. , should be transferred within 1 day.

Article 27 Relevant government departments at or above the county level shall order production and business units that do not meet the production safety conditions stipulated in relevant laws, regulations, national standards or industry standards to suspend production and business for rectification.

Production and business units that have been ordered to suspend production and operations for rectification can only resume production and business activities after passing the inspection and acceptance by the relevant government departments that made the decision. The relevant government departments that make the decision shall organize acceptance within the specified time limit.

The acceptance department shall be responsible for the acceptance results. If the work safety supervision and management department is responsible for inspection and acceptance, the inspection and acceptance results shall be reported to the work safety supervision and management department of the government at the same level and the superior government for record. If other departments conduct acceptance inspection, the acceptance results shall be reported to the government at the same level and the work safety supervision and management department for record.

Article 28 The provincial government safety production supervision and management department shall regularly announce to the public the province’s production safety status and production safety accidents, and promptly announce serious violations of production safety laws and regulations and extremely serious and serious violations. Departments responsible for the supervision and management of production safety shall disclose reporting hotlines, e-mail addresses, etc., accept reports on violations of production safety laws and regulations, and investigate and handle them in accordance with the law.

Chapter 4: Emergency Rescue for Production Safety Accidents

Article 29 Governments at or above the county level shall formulate emergency rescue plans for production safety accidents within their respective administrative regions and establish an emergency rescue system .

The emergency rescue plan for production safety accidents shall include the following contents:

(1) The command and coordination agency for emergency rescue;

(5) Emergency measures for other accidents caused by production safety accidents;

Article 30 Governments at or above the county level shall arrange emergency rescue funds for production safety accidents and shall be guaranteed by the same level of finance.

Article 31 Production and business units shall establish emergency rescue organizations or equip emergency rescue personnel, and formulate emergency rescue plans for production safety accidents.
