Article 3 The term "farmers' market" as mentioned in these Regulations refers to a public trading place established in accordance with the law, with a fixed location and corresponding facilities, and focusing on spot transactions of edible agricultural products.
The term "farmers' market operators" as mentioned in these Regulations refers to corporate legal persons or other organizations that provide venues, facilities and services to operators in accordance with the law or engage in the operation and management of farmers' markets.
The term "vendor operators" as mentioned in these Regulations refers to natural persons, corporate legal persons or other organizations that independently engage in business activities in farmers' markets. Article 4: Farmers’ markets have a public welfare nature. The construction and management of farmers' markets should follow the principles of planning first, standardized management, and market operation, and establish a development model with government guidance, self-discipline of market entities, and the joint participation of industry organizations and other social forces. Article 5 People's governments at all levels shall strengthen leadership and coordination over the construction and management of farmers' markets in accordance with the principle of territorial management.
The municipal and county (city, district) people's governments should clarify the competent departments of the farmers' market industry, establish a farmers' market management coordination mechanism, establish and improve the investment guarantee mechanism for farmers' market construction (renovation) and management, and encourage the development of new business formats .
Relevant departments such as market supervision and management, commerce, natural resources, urban management, agriculture and rural affairs, health, public security, and emergency management of the people's governments of cities and counties (cities and districts) shall do a good job in the management of farmers' markets in accordance with their respective responsibilities. Supervision, management and service work.
Township people's governments and sub-district offices should do a good job in the management of farmers' markets in accordance with their duties. Chapter 2 Planning and Construction Article 6 The natural resources administrative departments of the municipal and county (city, district) people's governments shall make scientific layouts when preparing land spatial planning and reserve space for the construction of farmers' markets. When implementing the construction of new urban areas and the renovation of old urban areas, farmers' markets should be planned and constructed as public service facilities.
The competent commerce departments of the municipal and county (city, district) people's governments shall, together with relevant departments, prepare special plans for farmers' markets and standards for the construction (renovation) of farmers' markets in accordance with the principles of reasonable allocation and convenience for residents, and submit them to the people at the same level Implemented after government approval.
A new farmer’s market should be located in a single building or a relatively independent site in a non-single building, and should not be located on the underground floor. Construction projects for new, reconstructed, and expanded farmers' markets should be planned and constructed simultaneously with infrastructure facilities such as farmers' market parking lots, sanitation, water supply and drainage, and fire protection.
Temporary stalls selling agricultural products and agricultural and sideline products shall not be set up within 200 meters of the farmer's market. Article 7 The land used for supporting the construction of farmers' markets with clear land spatial planning shall not be changed in use without authorization. If it is really necessary to change the land use, an application shall be made to the natural resources department of the municipal or county (city, district) people's government in accordance with the law, and the natural resources department of the city or county (city, district) people's government shall submit it to the people's government at the same level for approval.
The supporting farmers’ market project should be designed, constructed and delivered simultaneously with the main project. Article 8 The construction, reconstruction, and expansion of farmers' markets shall comply with relevant laws and regulations as well as the special planning, construction (renovation) standards for farmers' markets. If the farmer's market is not constructed according to the plan or if the construction of the farmer's market is unqualified, it shall not be delivered for use, and the real estate registration agency will not accept the property rights registration.
If the existing farmers’ market does not meet the construction (renovation) standards, it should be gradually upgraded and transformed in accordance with the construction (renovation) standards. Article 9 The purpose of the buildings (structures) in the farmer's market shall not be changed without authorization, and their property rights shall not be divided without authorization.
Chapter 3 Business Regulations Article 10 To open a farmer’s market, the following conditions must be met:
(1) Comply with land spatial planning, farmer’s market special planning and farmer’s market construction standards;
( 2) Have fixed venues, facilities, management agencies, full-time management personnel and hygiene and cleaning personnel that are suitable for the scale of the farmers’ market;
(3) Establish an agricultural product testing room, equipped with testing equipment and testing personnel with corresponding qualifications Personnel;
(4) Other conditions stipulated by laws and regulations. Article 11 To open a farmer's market, registration procedures must be carried out in accordance with relevant laws and regulations, and the business license and other business licenses must be clearly displayed at its business premises. Article 12 If a farmers' market needs to close down or terminate operations, it shall notify the municipal and county (city, district) people's government commerce departments, market supervision and management departments and on-site operators in writing three months in advance, and make an announcement. If business operations are terminated, cancellation procedures must be completed in accordance with the law.
Article 13 The farmer's market operator shall perform the following rights and responsibilities:
(1) Sign a stall rental agreement with the venue operator, make agreements on operations, management, safety and other matters, and clarify the rights and obligations of both parties;
(2) Set up trading areas in accordance with the requirements for food safety management and stall delineation, carry out zoning sales according to the categories of food and edible agricultural products, and demarcate an area of ??no less than 10% of the total area of ??the farmers' market as In the self-produced agricultural products sales area, strengthen the daily management of the use of stalls in the area, register the identity information of self-produced agricultural product sellers in the area, and waive market stall rental service fees;
(3) Formulate The farmer's market has food safety, environmental sanitation, production safety, price disclosure, integrity management, credit evaluation, public security, epidemic prevention and control and other business management systems, formulates emergency response plans, and equips specialized managers and professional technicians. Carry out daily management of the performance of agreements and operation and management systems by on-site operators, and dissuade those who violate the lease agreement and operation and management systems. Those who do not listen to the dissuasion will be promptly reported to the relevant functional departments for handling in accordance with laws and regulations; p>
(4) Set up a public notice board in a conspicuous position in the farmer's market, and promptly publish information such as management systems, management personnel, edible agricultural product sample inspection results, unqualified edible agricultural product processing results, safety accident hazard investigation and management status, complaint reporting hotlines, etc. ;
(5) Check and retain in accordance with relevant regulations the relevant license information of on-site operators and the certificates of conformity of edible agricultural products and food, certificates of origin or purchase vouchers; no certificate of origin or purchase vouchers; , edible agricultural products with certificates of conformity shall be subject to sampling inspection or rapid testing. Only after passing the inspection or testing can they be put on the market for sale, and the test results shall be publicized;

(8) Supervise operators to publicize their business licenses and related permits in conspicuous places;
(9) Install video security monitoring equipment in accordance with regulations and ensure normal operation, configure fire-fighting facilities, fire-fighting equipment, fire safety signs, and safety warning signs and keep them intact, conduct fire prevention inspections, and ensure evacuation passages and fire trucks The passages and safety exits should be smooth;
(10) Implement the relevant provisions of the person responsible for city appearance and environmental sanitation, organize dedicated personnel to clean and clean, strengthen the environmental sanitation management of the farmers' market, keep the farmers' market clean and orderly, and conduct regular inspections of market stalls Cleaning and disinfection;
(11) Set up garbage classification collection containers that meet standards, urge on-site operators to classify garbage, and classify and process garbage in accordance with requirements;
( 12) Discourage and stop behaviors that damage the city appearance and environmental sanitation, such as operating outside the scope of the store (stall), disorderly pouring, disorderly construction, etc.;
(13) Equip safe and effective preventive measures Facilities and equipment to control mosquitoes, flies, cockroaches, rats and other vector organisms, and assign dedicated personnel to be responsible for the prevention and control of vector organisms to ensure that the density of vector organisms in the market is controlled within the scope specified by the state;
