Article 1 In order to protect the legitimate rights and interests of blind medical massage practitioners and to regulate the activities of blind medical massage, these Measures are formulated in accordance with the Law of the People's Republic of China on the Protection of Persons with Disabilities and other laws and regulations.
Second Article The medical massage for the blind referred to in these Measures refers to the massage activities engaged in by the blind for the purpose of treating certain diseases.
Medical massage for the blind is a medical act and should be carried out in medical institutions.
Medical massage personnel for the blind are health technicians, and should have good professional ethics and practicing standards, and their performance of duties in accordance with the law, are protected by law.
Article 3 Local federations of persons with disabilities at or above the county level, human resources and social security departments, as well as the administrative departments of health and traditional Chinese medicine management departments in accordance with the division of responsibilities for the management of medical massage for the blind.
Article 4 Blind persons who meet one of the following conditions may apply for practicing blind medical massage in medical institutions with the certificate of approval issued by the federation of persons with disabilities at the municipal level of the county where the district is located:
(1) Those who have obtained the qualification of professional and technical posts of blind medical massage before the issuance of these Measures;
(2) Those who have obtained the qualification of medical massage for blind persons with secondary specialties or above and who have been continuously engaged in medical massage for the blind before the issuance of these Measures. (b) Before the promulgation of these Measures, the blind person has obtained secondary specialized education or above, and has been engaged in medical massage activities for more than 2 years continuously;
(c) Before the promulgation of these Measures, the blind person has been engaged in medical massage activities for 15 years continuously in a medical institution;
(d) Before the promulgation of these Measures, the blind person has been engaged in medical massage activities for more than 2 years continuously in a medical institution, but less than 15 years continuously in a medical institution, and has passed the examination of medical massager; and
(e) Those who have obtained secondary specialized education or above in medical massage for the blind and have passed the examination for medical massage personnel for the blind.
The examination for blind medical massage personnel is organized by the China Disabled Persons' Federation and the examination methods are formulated. The China Blind Massage Guidance Center is responsible for its implementation.
Blind people who have passed the examination for blind medical massage personnel shall obtain a certificate of passing the examination, and at the same time shall obtain the qualification for primary professional and technical posts of blind medical massage personnel.
Article 5 Blind medical massage personnel who meet the provisions of Article 6 of these Measures may apply to open medical massage clinics for the blind.
Article 6 The following conditions shall be met in order to open a medical massage center for the blind:
(1) The person who opens the center shall be a blind medical massage practitioner;
(2) There shall be at least one blind medical massage practitioner who has been engaged in the activity of medical massage for more than five years;
(3) There shall be at least one massage bed and the corresponding supplies necessary for massage, with a floor area of not less than 40 square meters;
(4) There shall be at least one massage bed, and the corresponding supplies necessary for massage. square meters;
(d) have the necessary disinfection equipment;
(e) have the corresponding rules and regulations, bound book of the state formulated or recognized by the blind medical massage technical procedures;
(f) can independently bear the legal responsibility;
(g) have the municipal federation of persons with disabilities agreed to open the medical massage clinic of the blind issued by the municipal level (vii) There is a document certifying that the Federation of the Disabled at the municipal level has agreed to open a blind medical massage center.
Article 7: The medical massage center for the blind shall be approved by the county-level health administrative department, and if it meets the requirements, it shall be issued with a License to Practice in Medical Institutions, with the name of the organization as the identifying name of the medical massage center for the blind, and the subject of the clinic as Tui Na Section (Medical Massage for the Blind).
Medical massage clinics for the blind do not register diagnostic and therapeutic subjects other than massage (medical massage for the blind), do not set up beds, and do not set up pharmacies (cabinets).
The license to practice medical massage for the blind is valid for five years.
Article 8 Blind medical massage practitioners shall enjoy the following rights in their work:
(1) to participate in the exchange of technical experience and to join professional academic societies;
(2) to participate in business training and continuing education;
(3) not to be infringed upon in their work in terms of their human dignity and personal safety;
(4) to receive remuneration;
(v) To give opinions and suggestions on health work.
Article 9 Medical massage personnel of the blind shall fulfill the following obligations in their work:
(1) to abide by laws, rules, regulations and relevant technical operation norms;
(2) to establish a spirit of dedication and to abide by professional ethics;
(3) to care for, love, and respect the patients, and to protect the privacy of the patients;
(4) to receive training and Continuing education, and strive to study the business and improve professional and technical skills.
Article X. Medical massage personnel of the blind shall truthfully introduce the medical massage program to the patients or their families, but shall take care to avoid adverse consequences to the patients.
Article 11 The medical massage personnel for the blind shall not carry out medical, preventive or health care activities other than massage (medical massage for the blind), prescribe medicines, issue medical diagnostic certificates, sign medical certificates not related to the medical massage for the blind, or conceal, forge or destroy the medical documents and related information without authorization.
Article 12: Medical massage clinics for the blind shall practice in accordance with the prescribed places of practice and diagnostic and therapeutic subjects, and shall not carry out medical, preventive or health care activities other than medical massage for the blind. Non-blind persons shall not engage in medical, preventive and health care activities in the medical massage clinics for the blind.
Article 13 Blind medical massage personnel shall not take advantage of their duties to solicit or illegally accept property from patients or make other improper gains.
Article 14 The China Disabled Persons' Federation is responsible for formulating plans for the training of blind medical massage personnel, and for ensuring that such personnel receive training and continuing education in accordance with the provisions of the law, and that they engage in blind medical massage activities in accordance with the law.
The China Guidance Center for Blind Massage and the Guidance Centers for Blind Massage in each province, autonomous region and municipality directly under the Central Government are responsible for formulating training plans for blind medical massage personnel in accordance with the training plan, and are also responsible for organizing the training work.
Medical institutions shall provide conditions for blind medical massage personnel to carry out their work and study, and ensure that their blind medical massage personnel receive training, continue their education and legally engage in medical massage activities.
Article 15 If any of the following circumstances applies to medical massage for the blind, the original licensing authority shall cancel the license and withdraw the License to Practice in Medical Institutions:
(1) Employing non-blind persons to carry out medical, preventive, and health care activities;
(2) Carrying out medical, preventive, and health care activities other than blind medical massage;
(3) Selling, transferring, or lending the License to Practice in Medical Institutions.
(4) prescribing medicines;
(5) setting up beds, pharmacies (cabinets);
(6) the expiry of the validity period of the Medical Practice License has not been renewed;
(7) does not have the conditions stipulated in Article 6 of these Measures.
Article XVI of the county-level health administrative department of the blind medical massage clinic does not meet the conditions issued by the Medical Practice Permit for Medical Institutions, or in violation of the provisions of these Measures to expand the registration of diagnostic and therapeutic subjects, approval of the setup of beds or dispensary (cabinets), its actions are invalid, by the original licensing authority or the next level of health administration department shall be revoked.
Article 17 The blind medical massage clinic and its staff violates the relevant provisions of the "Regulations on the Administration of Medical Institutions" and shall be dealt with according to the "Regulations on the Administration of Medical Institutions". In the event of medical malpractice, it shall be dealt with in accordance with the Regulations on the Handling of Medical Malpractice.
Article XVIII of the former Ministry of Personnel, Ministry of Health, the State Administration of Traditional Chinese Medicine, the China Disabled Persons' Federation "on the blind medical massage personnel assessment of professional and technical positions related to the issue of notice" (Disabled Persons' Federation of Education on the word 〔1997〕 No. 103) in the director (deputy director) of the massage practitioner, massage practitioner, massage practitioner (doctor) of the name of the professional and technical positions were changed to director (deputy director) of the medical massage practitioner, medical massage practitioner, medical massage practitioner, medical massage practitioner, medical massage practitioner, medical massage practitioner (secretary) ) Medical Massage Therapist, Attending Medical Massage Therapist, and Medical Massage Therapist (Sgt.).
Before the release of these measures, the blind medical massage professional and technical qualifications continue to be valid. The appraisal and recruitment of the professional and technical positions of blind medical massage personnel shall be handled in accordance with the relevant provisions of No. 103 of the Disabled Persons' Federation of Education and Training [1997].
Article 19 The blind persons referred to in these Measures include those who are totally blind and have low vision.
Article 20 These Measures shall come into force on September 1, 2009.
