Article 1 In order to standardize the quality supervision and safety supervision of special equipment, ensure the product quality and safe use of special equipment, safeguard personal and property safety, and promote economic development and social stability, these Provisions are formulated in accordance with the provisions of laws and administrative regulations and the responsibilities of the quality and technical supervision department of the State Council. Article 2 Special equipment refers to the equipment recognized by the state, which is prone to accidents due to the influence of the equipment itself and external factors, and once an accident occurs, it will cause personal injury and great economic losses. The "special equipment" mentioned in these Provisions includes elevators, hoisting machinery, motor vehicles in factories, passenger ropeways, amusement machines and amusement facilities, explosion-proof electrical equipment, etc. The specific catalogue of special equipment for the implementation of these provisions shall be put forward by the State Bureau of Quality and Technical Supervision according to the degree of danger of special equipment, determined after soliciting opinions from relevant parties, and promulgated for implementation. Provisions on quality supervision and safety supervision of explosion-proof electrical equipment shall be formulated separately. Article 3 These Provisions shall apply to the design, manufacture, installation, use, inspection, maintenance and transformation of special equipment. Article 4 The State Bureau of Quality and Technical Supervision shall be responsible for the quality supervision and safety supervision of special equipment throughout the country. The local administrative departments of quality and technical supervision shall be responsible for the quality supervision and safety supervision of special equipment within their respective administrative areas; Special equipment safety supervision institutions of quality and technical supervision administrative departments at all levels (hereinafter referred to as special equipment safety supervision institutions) shall be responsible for the implementation of quality supervision and safety supervision of special equipment within the scope of their respective duties. Special equipment safety supervision institutions at all levels shall play the role of industry authorities and social intermediary organizations when implementing quality supervision and safety supervision of special equipment. Article 5 Technical institutions engaged in the supervision and inspection of special equipment (hereinafter referred to as the supervision and inspection institutions) shall meet the corresponding conditions, and can only carry out the supervision and inspection of special equipment for authorized projects after being qualified and authorized by the administrative department of quality and technical supervision at or above the provincial level. Chapter II General Provisions Section 1 Design and Manufacture Article 6 Design units and their designers shall be responsible for the quality and safety technical performance of the designed special equipment. The design must meet the corresponding standards and safety technical requirements. If no national standards or industrial standards are formulated, they must meet the requirements of safeguarding human health and personal and property safety. Seventh manufacturing units are responsible for the quality and safety technical performance of the special equipment manufactured. For special equipment subject to production license management, the State Bureau of Quality and Technical Supervision shall uniformly implement the production license system; The safety certification system shall be implemented for special equipment that is not subject to production license management. Units that have not obtained the production license or safety approval certificate of the corresponding products shall not manufacture the corresponding products. The acquisition (renewal) and management of the production license of special equipment shall be implemented in accordance with the specific provisions of the state on the production license of industrial products. The acquisition (replacement) of special equipment safety approval certificate shall be subject to classified management. The acceptance of the certificate application shall be undertaken by the national special equipment safety supervision institution or the provincial special equipment safety supervision institution respectively, and the examination shall be undertaken by the unit authorized by the national special equipment safety supervision institution. After passing the examination, they shall be approved and certified by the State Bureau of Quality and Technical Supervision or the provincial administrative department of quality and technical supervision respectively. Article 8 Under any of the following circumstances, the type test of the whole machine or parts must be carried out by a supervision and inspection institution recognized by the State Bureau of Quality and Technical Supervision, and products can only be provided to users after passing the inspection: (1) Trial production of new products or parts of special equipment; (2) Products or components with type test requirements in manufacturing standards or technical regulations. If formal production is needed, formal production and sales can only be carried out after obtaining the production license or safety approval certificate of the corresponding product. The period from passing the type test to applying for production license or safety approval certificate shall not exceed 6 months. Article 9 When special equipment products leave the factory, they must provide corresponding accompanying documents in accordance with the relevant laws, administrative regulations and the specific requirements in Chapter III of these Provisions, and ensure the supply of spare parts. Article 10 The sale of special equipment products manufactured overseas in China must meet the requirements of China's laws, administrative regulations, rules, mandatory standards and technical specifications on special equipment. Overseas enterprises selling overseas-made special equipment in China must identify the agents registered in China, and the agents shall bear corresponding quality and safety responsibilities. The agent must hold the certification materials of accepting the entrusted agency and registering in China, and go to the local provincial special equipment safety supervision agency for the record. If the products or parts of special equipment manufactured overseas are sold in China, the first similar products or parts must be type-tested by the supervision and inspection institutions designated by the State Bureau of Quality and Technical Supervision, and then they can be officially sold. Section 2 Installation, Maintenance and Renovation Article 11 Units that install, repair and renovate special equipment must be responsible for the quality and safety technical performance of installation, maintenance and renovation of special equipment. Installation, maintenance and renovation units must meet the corresponding conditions, apply for qualification accreditation to the local provincial special equipment safety supervision institution or its authorized special equipment safety supervision institution, and only after obtaining the qualification certificate can they undertake the business of accredited projects. The qualification certificate is valid nationwide. The installation, maintenance and transformation of special equipment shall not be subcontracted or subcontracted in any form. Twelfth special equipment installation, maintenance and transformation, the use of units must hold the construction plan and other relevant information to the local special equipment safety supervision institutions at or above the municipal level for the record. Article 13 After the quality, safety and technical performance of special equipment after installation, overhaul and transformation have passed the self-inspection by the construction unit, the user unit shall submit an application for acceptance to the designated supervision and inspection institution, and the inspection report shall be issued by the institution that carries out this acceptance. Unless otherwise stipulated by national laws and administrative regulations, no administrative department may require compulsory acceptance again. Fourteenth after the installation, maintenance and transformation of special equipment are qualified, the construction unit must hand over the construction technical documents and materials to the user and store them in the technical archives of special equipment. Section 3 Use and Management Article 15 The user of special equipment must be responsible for the use and operation safety of special equipment. Units using special equipment must use special equipment with production license or safety approval certificate. The special equipment used must be subject to corresponding acceptance and regular inspection in accordance with the relevant requirements of these Provisions. Sixteenth new special equipment, before put into use, users must hold the acceptance inspection report issued by the supervision and inspection institutions and safety inspection marks, and register with the local special equipment safety supervision institutions at or above the municipal level. After the safety inspection mark is fixed in a prominent position of special equipment, it can be put into formal use. Seventeenth users must formulate and strictly implement the post responsibility system as the core of the safe use and operation management system of special equipment, including technical file management, safe operation, daily inspection, maintenance, regular inspection and emergency measures, etc., and must ensure the integrity and accuracy of technical files of special equipment. Eighteenth special equipment in case of natural disasters or equipment accidents that may affect its safety and technical performance, and stopped for more than one year, before using it again, the user should conduct a comprehensive inspection, and must eliminate the hidden dangers that affect its safety. Nineteenth special equipment operators (special equipment installation, maintenance, maintenance and operation personnel) must undergo professional training and assessment, and obtain the qualification certificate of special equipment operators issued by the administrative department of quality and technical supervision at or above the prefecture level before they can engage in the corresponding work. Twentieth users must carry out daily maintenance of special equipment in use. The maintenance of special equipment must be carried out by qualified personnel, and users without special equipment maintenance qualification must entrust units with special equipment maintenance qualification to carry out daily maintenance of special equipment. Twenty-first users should strictly implement the routine inspection system of annual inspection, monthly inspection and daily inspection of special equipment. When abnormal conditions are found in the inspection, they must be handled in time, and it is forbidden to run in spite of illness. The inspection shall be recorded in detail and filed for future reference. Twenty-second in the use of special equipment to implement the safety and technical performance of regular inspection system. Users must apply for regular inspection to the supervision and inspection institutions where special equipment is used on schedule, and change the relevant contents in the safety inspection marks in time. Special equipment with the safety inspection mark exceeding the validity period shall not be used. The validity period of safety inspection marks shall be calculated from the date of acceptance or issuance of periodic inspection reports. Periodic inspection of all kinds of special equipment shall be carried out in accordance with the specific provisions in Chapter III. Twenty-third standards or technical specifications for the service life of special equipment or parts, should be scrapped in accordance with the corresponding requirements. After the special equipment is scrapped, the user shall report to the special equipment safety supervision agency responsible for the registration of special equipment. Twenty-fourth special equipment accidents, users must take emergency rescue measures to prevent the disaster from expanding, and in accordance with the relevant provisions, timely report to the local special equipment safety supervision institutions and relevant departments. Twenty-fifth special equipment used in explosive dangerous places, in addition to the relevant requirements of these Provisions, must also meet the requirements of explosion-proof safety technology. Section 4 Supervision, Supervision, Supervision and Inspection Article 26 The local administrative department of quality and technical supervision shall organize regular or irregular quality supervision and spot checks of special equipment products according to the actual situation in the region and the arrangement of the superior administrative department of quality and technical supervision.
