Construction units shall, in accordance with the provisions of this list, organize the preparation of environmental impact report, environmental impact report form or fill in the environmental impact registration form. Article 3 The environmentally sensitive areas referred to in this list refer to the various types of natural and cultural protection sites at all levels established by law, as well as the areas that are particularly sensitive to certain types of pollution factors or ecological impact factors of the construction projects, mainly including:
(1) nature reserves, scenic spots, sites of the world's cultural and natural heritage, and drinking water source protection zones;
(2) basic farmland protection zones, basic grasslands, forest parks, geological parks, important wetlands, natural forests, natural concentrated distribution areas of rare and endangered wild animals and plants, natural spawning grounds, baiting grounds, overwintering grounds and migratory corridors of important aquatic organisms, natural fisheries, areas of resource scarcity of water, key soil erosion prevention and control zones, sandy land closed protection zones, enclosed and semi-enclosed seas, eutrophication of waters;
(iii) Residential, medical and health, cultural and educational, scientific research, and drinking water source protection zones;
(c) Residential, cultural, educational, scientific research, and drinking water source protection zones, medical and health care, culture and education, scientific research, administrative offices, etc. as the main function of the area, cultural relics protection units, with special historical, cultural, scientific and national significance of the protected area. Article 4 The sensitive nature and degree of sensitivity of the environment in which the construction project is located is an important basis for determining the environmental impact assessment category of the construction project.
Construction projects involving environmentally sensitive areas shall be strictly in accordance with this list to determine its environmental impact assessment category, shall not be raised or lowered without authorization environmental impact assessment category. Environmental impact assessment documents should be focused on the impact of the project on environmentally sensitive areas for analysis. Article 5 cross-industry, composite construction projects, the environmental impact assessment category according to which the single highest level to determine. Article 6 For the construction projects not stipulated in this list, the environmental impact assessment categories shall be proposed by the provincial environmental protection administrative department according to the characteristics of the pollution factors and ecological impact factors of the construction projects, as well as the sensitive nature and degree of sensitivity of the environment in which the projects are located, and shall be reported to the State Council for determination by the State Council's administrative department for environmental protection. Article 7 This Directory shall be interpreted by the competent administrative department for environmental protection under the State Council and revised and published in due course. Article 8 This Directory shall come into force on June 1, 2015 onwards. The Classified Management List for Environmental Impact Assessment of Construction Projects (Decree No. 2 of the Ministry of Environmental Protection) shall be repealed at the same time.
