General

Article 1 In order to strengthen the management of kindergartens, and to promote the healthy development of the cause of pre-school education in our province, according to the relevant provisions of the actual situation of the province, the formulation of these measures.

Article 2 These measures shall apply to kindergartens at all levels and in all categories (including rural preschools) organized in our province to educate children aged 0-6 years old.

Article 3 Pre-school education is an important part of the national education, must implement the national education policy, follow the physical and mental development of preschool children and the laws of education, and adhere to the combination of care and education, to lay the foundation for the development of young children throughout their lives.

Article 4 The education department at all levels is the competent authority for pre-school education, responsible for the administration of local pre-school education, responsible for all levels and types of kindergartens for operational guidance.

Article 5 The other relevant departments of the government at all levels shall do a good job in the management of kindergartens according to their respective responsibilities.

Article 6 to establish and improve the kindergarten assessment system and classification management system, and strengthen the supervision, assessment, supervision, inspection and guidance of kindergartens at all levels and types.

Chapter I kindergarten organization

Article 7 adhere to the government-led, social participation, public and private, and fully mobilize the enthusiasm of all parties, a variety of forms to expand the resources of pre-school education to meet the basic needs of the people.

Article VIII encourages social forces to organize kindergartens in various forms, and actively explore innovative preschool education management mode and operation mechanism. Public-private model kindergartens to implement the separation of management and operation, with reference to the public kindergarten management mode entrusted to management.

Article IX implementation of kindergarten access system. Kindergartens should be held in accordance with the principle of territorial management, by the township (street) education office or central school declaration, the county-level education department is responsible for the approval and issuance of the "Henan Province kindergarten license" (hereinafter referred to as "kindergarten license").

Private kindergartens to obtain permission to run the school, according to law, "private education license", and then to the civil affairs department to register, and obtain the legal person of the private non-enterprise unit license.

Without obtaining the "school license" and registration procedures, no unit or individual shall hold kindergartens.

Article 10 of the social organizations to hold kindergartens should have legal personality; kindergartens held by citizens should have political rights and full capacity for civil behavior. The kindergartens shall meet the basic standards for kindergartens in Henan Province.

Article 11 The application for the organization of kindergartens, shall submit the following materials to the approving authority:

(a) application report and approval of the registration form. The application report includes the organizer, the name of the norm, the nature of the school, scale, form, conditions, internal management system, financing and management and use.

(B) to prove the conditions of the school's relevant information.

Application for the organization of private kindergartens, you also need to submit the following materials:

1. Proof of the qualifications of the organizer and the list of decision-making body members.

2. Proof of the qualifications of the director, teachers, caregivers and other staff, and health certificates issued by qualified health examination units.

3. Legally valid documents proving the assets of the proposed kindergarten.

4. The proposed kindergarten's draft statute (including the purpose of running the school, the management system, the target and scope of enrollment, the composition of the teaching staff, teaching programs, etc.) and development planning.

5. Premises of the real estate license. Rental of premises, should provide a legally binding lease contract or agreement.

6. Reviewed by the public security fire department agreed to valid documents.

7. Health supervision agencies above the county level issued by the site health supervision and audit.

8. Laws and regulations should be submitted to other materials.

Article XII of the kindergarten should use a standardized name, generally should be connected with the location of the place name.

The name can not be alone in the name of the province, province municipalities or place names, not "China", "China", "International" and other words; name in the title of the "Henan", "Henan Province", subject to the approval of the provincial education department and relevant departments.

The name shall not use words with religious colors and superstitious meanings.

Article XIII of the private kindergartens should be organized in accordance with the "People's Republic of China *** and the Promotion of Private Education Law" relevant provisions. Undertake to build private model kindergartens, should sign a contract or agreement with the education department entrusted to run the school, clear rights and obligations.

Article 14 The kindergarten organizes branch or cooperative kindergartens, must be agreed by the competent department and then reported to the original approval authority for approval. All kinds of kindergartens must have an independent legal person, independent economic accounting, independent premises, and independently carry out child care and education work.

Sino-foreign cooperative schools, in accordance with the "Chinese People's *** and State Regulations on Chinese-Foreign Cooperation in Running Schools" (State Council Decree No. 372), by the provincial education department for approval.

Cities (including urban and county cities) shall not organize any form of preschool.

Article 15 of the kindergarten has obtained a "license to operate" and registration procedures, the price supervisor, finance, health, taxation and other relevant departments shall, in accordance with the provisions of the timely handling of related procedures.

Article XVI of the establishment of regular review and validation and dynamic management system. Chapter II Conservation and Education

Article 19 The kindergarten shall implement the principle of combining conservation and education, create a harmonious environment compatible with the education and development of young children, and guide the healthy development of young children's personality.

The kindergarten shall protect the physical health of young children and cultivate good habits of life and hygiene; promote the intellectual development of young children; and cultivate the feelings of love for the motherland as well as good moral behavior in young children.

Article 20 The enrollment of kindergartens shall be in accordance with the regulations of the education department. Kindergarten class size is generally 25 people in small classes, 30 people in middle classes, 35 people in large classes. Conditional may have a small nursery class, class size is generally 20 people. Rural preschools may not have more than 40 students. Boarding kindergarten class number of children discretionary.

Article 21 When children enter the kindergarten, kindergartens need to check their vaccination certificate, and report to the local CDC agencies, urging children who have not completed the vaccination program in a timely manner to check the omission of the relevant vaccines. Young children who have not completed the required preventive vaccination procedures should not be admitted to kindergartens. The children should go to the maternal and child health institutions and other qualified medical institutions for physical examination before entering the school, and those who do not pass the physical examination are not allowed to enter the school.

In addition to the physical examination, it is prohibited to hold any form of examination or test when the children are admitted to the kindergarten.

Article 22 The kindergartens shall use Putonghua.

Article 23 The kindergarten shall take the game as the basic form of activities, education in the life and activities, to prevent the tendency of elementary school, adult-oriented, and to guide the scientific and healthy development of young children.

Article 24 The teaching staff should have good professional ethics, respect and care for young children, and become the guide, supporter and collaborator of young children's learning activities.

Corporal punishment, disguised corporal punishment of young children is strictly prohibited.

Article 25 The kindergarten shall establish a scientific day-life system, and reasonably arrange the time for children's meals, naps, games, outdoor activities and educational activities. The interval between meals is generally 3.5 hours; outdoor activities in the day not less than two hours, of which not less than one hour of physical activity.

Article 26 The kindergarten shall establish a scientific evaluation system of nursery education.

The kindergarten shall establish a growth file for each child. Teachers and caregivers should do a good job of observation records and case analysis of young children, targeted observation of young children's behavior, performance, timely analysis of the development of young children, development requirements, timely adjustment of the teaching design.

Article 27 The kindergarten shall actively carry out teaching and research activities. For young children's educational experiments shall be approved by the local education department at or above the county level. Without approval, the kindergarten shall not carry out various forms of educational experiments, shall not hang a variety of educational experiments and research base plaque.

Article 28 The kindergarten shall not require children to purchase any teaching materials and reading materials.

Chapter III Administrative Affairs

Article 29 The kindergarten shall implement the director's responsibility system, and the director shall be fully responsible for the work of the kindergarten.

The director of a kindergarten shall be employed by the unit, organization or individual that organizes the kindergarten and shall be filed with the approving authority of the kindergarten.

Teachers, physicians, health workers, caregivers and other staff of private kindergartens are employed by the director of the kindergarten, or by the unit, organization or individual holding the kindergarten.

The use of public kindergarten staff, in accordance with the state and the province's institutions personnel management policies.

Article 30 kindergartens should be in accordance with the relevant provisions of the state and the province staff. Private kindergartens employing staff should be in accordance with the requirements of the relevant laws and regulations on labor security for employment procedures, to protect the legitimate rights and interests of teachers and staff in accordance with the law.

Article 31 The director of the kindergarten, teachers and other staff shall have the qualifications required by the state, and obtain the appropriate qualifications, and in line with the "kindergarten work regulations" stipulated in the other conditions.

Article 32 The kindergarten staff of all types shall obtain a health certificate. Mental illness and chronic infectious diseases shall not be engaged in kindergarten work.

Article 33 The kindergarten staff shall participate in job training and continuing education in accordance with the provisions of the education department and relevant departments.

The kindergarten shall, through various forms, provide conditions for teachers' scientific research, teaching and research, and promote teachers' professional growth.

Article 34 The kindergarten shall have a stable source of funding to ensure the normal operation of child care and education. Kindergarten organizers or contractors should be arranged annually a certain amount of special funds for the maintenance of premises, equipment renewal.

Article 35 kindergartens must strictly implement the price supervisor, finance, education and other departments on the management of kindergarten fees.

Article 36 The kindergarten shall not charge additional fees for running experimental classes, special classes and interest classes, etc., and shall not make financial gains by organizing activities for young children.

Article 37 The kindergartens shall abide by the financial management system, implement independent accounting of funds, fees earmarked for special purposes, and consciously accept the audit supervision.

The kindergarten's meal expenses must establish a special account, regularly open accounts to parents of young children.

Article 38 The kindergarten should have a certain percentage of the annual funds for the purchase of play and teaching aids and books.

Article 39 to encourage and support social organizations, individual citizens to donate property to the kindergarten.

The kindergarten shall accept donations in accordance with relevant state laws and regulations.

Article 40 The kindergarten shall establish a system of contact with parents, set up a parents' committee, through the opening of parent schools, parents' meetings, parents' open day activities, and other forms of guidance to parents of scientific child-rearing.

Provincial and municipal demonstration kindergartens should actively explore and create conditions for the gradual development of community-based, to the family radiation of infants and young children 0-3 years of age early education guidance and services.

Chapter IV Safety and Health

Article 41 The government at all levels and its education, public security, justice, housing and urban-rural development, transportation, culture, health, industry and commerce, quality supervision, press and publication departments shall, in accordance with the division of responsibilities, according to law, is responsible for kindergarten safety, and to fulfill the kindergarten environment around the management of kindergarten and kindergarten safety supervision and management responsibilities.

Article 42 The kindergarten shall enhance security awareness, set up security institutions, establish and improve the security management system, develop all kinds of security work plan, regular organization of emergency preparedness drills.

Article 43 The kindergarten shall strengthen the staff and children's safety education, improve the staff to protect children's safety skills and children's self-protection ability.

Article 44 The kindergarten should be equipped with full-time security personnel and the necessary equipment and instruments, set up video surveillance and alarm facilities in key areas and networking with public security departments.

Article 45 The kindergarten shall regularly inspect and maintain the premises, facilities, and organize special personnel to conduct daily inspections, records, and strengthen the fire, power management, and timely removal of potential safety hazards, to ensure that young children's life safety.

Article 46 Any unit or individual shall not encroach on and destroy the kindergarten premises and facilities, shall not be set up around the kindergarten dangerous, polluting or affecting the kindergarten lighting buildings and facilities, and shall not interfere with the normal working order of the kindergarten.

Article 47 The kindergarten shall establish and improve the health care system and vaccination certificate inspection system.

Article 48 The kindergarten shall establish the prevention of food poisoning, infectious disease epidemic plan and strict implementation, to assist the local disease control agencies to carry out the vaccination of school-age children.

The kindergarten in the event of food poisoning, infectious disease epidemics, the unit, organization or individual hosting the kindergarten shall immediately take emergency rescue measures, while within the prescribed time limit to report to the relevant departments in a timely manner, and do a good job in accordance with the relevant provisions of the aftermath of the incident.

Article 49 The kindergarten cafeteria shall strictly implement the food hygiene and safety system, all kinds of licenses must be complete.

Young children's tableware and drinking utensils should be used exclusively for special purposes and regularly disinfected to prevent cross-infection.

Article 50 The kindergarten shall establish a guardian and teacher of young children handover system. Kindergartens with school buses shall comply with the "Regulations on the Safe Management of School Buses" (State Council Decree No. 617), the use of school buses designed and manufactured in accordance with the national standards for special school buses for young children, and strictly abide by the provisions of the safety management of school buses.

Chapter V Rewards and Penalties

Article 51 The government or the education department shall recognize and reward those who conscientiously implement these Measures and have one of the following conditions:

(1) The direction of running a school is clear, and the universality and public welfare are outstanding.

(B) to improve the conditions of kindergartens with remarkable achievements.

(C) Conservation, education work is remarkable.

(D) kindergarten management outstanding achievements.

Article 52 of the violation of Article 9 of these measures, without authorization to hold kindergartens, by the education, civil affairs and other departments in accordance with the relevant laws and regulations issued by the administrative penalty decision to prohibit; in the prescribed period of time to refuse to implement the penalty decision or prohibit the unauthorized opening of kindergartens, by the education, civil affairs and other departments of the mandatory banning.

For violation of other provisions of this approach, with one of the following circumstances of the unit and individual, depending on the severity of the case, by the government and its education department or the relevant departments under the authority of the management to give orders to rectify the situation, stop running the school and revocation of the "school license" and other penalties, or by the education department recommended that the relevant departments of the personnel directly responsible for giving administrative sanctions. The circumstances are serious, constitute a crime, by the judicial organs to investigate legal responsibility.

(A) unauthorized changes in the relevant registration matters.

(B) the release of false enrollment brochures or advertisements to cheat money.

(3) The premises and facilities do not meet national health and safety standards, jeopardizing the health of young children or threatening the safety of young children.

(d) The content and methods of education contrary to the laws of early childhood education, harming the physical and mental health of young children.

(E) management chaos, seriously affecting the care and education work, resulting in poor social impact.

(F) submit false documents or other fraudulent means of concealing important facts to obtain a license to run a school.

(VII) maliciously terminate the operation of the school, the funds or withholding, misappropriation of funds for the operation of the school.

(H) violation of state regulations to appoint or dismiss teachers.

(I) corporal punishment or disguised corporal punishment of young children.

(10) The use of toxic and harmful substances in the production of play and teaching aids.

(xi) Encroachment, destruction of kindergarten premises and equipment.

(xii) Interference with the normal working order of the kindergarten.

(xiii) Setting up buildings and facilities around the kindergarten that are dangerous, polluting, or affect the kindergarten's lighting.
