Chapter 1 General Provisions Article 1 In order to strengthen the management of domestic waste, improve the living environment, promote the construction of ecological civilization and sustainable economic and social development, according to the "Prevention and Control of Environmental Pollution by Solid Waste of the People's Republic of China" These measures are formulated in light of the actual situation of this city and other relevant laws and regulations, such as the Law of the People's Republic of China on Promotion of Circular Economy and the Regulations of Fujian Province on the Management of Urban and Rural Domestic Waste. Article 2 These Measures shall apply to the implementation of classified placement, collection, transportation, disposal and related management activities of domestic waste in the areas determined and announced by the people's governments at the county level in this city. Article 3 Domestic garbage as mentioned in these Measures refers to solid waste generated in daily life or activities that provide services for daily life, as well as solid waste that is regarded as domestic garbage according to laws and regulations.
Domestic waste in this city is divided into four categories:
(1) Recyclables refer to domestic waste suitable for recovery and recycling, mainly including waste paper and waste plastics , scrap metal, waste glass, waste fabric, waste furniture, waste electrical and electronic products, etc.
(2) Kitchen waste refers to domestic waste that is perishable and contains organic matter, including household kitchen waste (including melon and fruit peels, leftovers, discarded food, etc. generated in daily life of the family) ), kitchen waste (including food residues, food processing waste and waste edible oils and fats generated by catering industry, canteens, etc.), other kitchen waste (including vegetables and fruits generated by agricultural product wholesale markets, farmers' markets, large supermarkets and other places, Carrion, minced meat bones, aquatic products, livestock and poultry offal, etc.).
(3) Hazardous waste refers to domestic waste that causes direct or potential harm to human health and the natural environment, mainly including waste batteries (including waste nickel-cadmium batteries and mercury oxide batteries, etc.), electronic hazardous waste Waste, lamp tubes, waste medicines and their packaging, waste thermometers, waste blood pressure monitors, waste paint and solvents, mineral oil, pesticides, disinfectants and their packaging, etc.
(4) Other garbage refers to other domestic waste except recyclables, kitchen waste and hazardous waste.
Industrial solid waste, hazardous waste, medical waste, construction waste, greening operation waste and other wastes shall be handled in accordance with relevant laws, regulations and rules.
If rural domestic waste cannot be classified and disposed in accordance with the provisions of paragraph 2, it may be first divided into two categories: kitchen waste and other garbage.
Municipal and county-level people's governments can formulate and publish to the public specific classification catalogs and disposal specifications of domestic waste based on local actual conditions, provide various forms of inquiry services, and guide units and individuals to accurately classify and dispose of garbage at fixed times and locations. Article 4 Domestic garbage should be put away, collected, transported and disposed of in categories.
Domestic waste classification management follows the principles of government promotion, national participation, urban and rural coordination, territorial management, and step-by-step progress. Article 5 People's governments at the municipal and county levels shall strengthen unified leadership over the classification and management of domestic waste, incorporate the classification and management of domestic waste into the national economic and social development plan, and incorporate the funds required for the classification and management of domestic waste into the fiscal budget of the government at the same level.
The Municipal People's Government should set goals for domestic waste classification management, coordinate and promote the city's domestic waste classification work, establish a coordination mechanism for domestic waste classification management, and solve major problems in domestic waste classification management.
County-level people's governments should strengthen leadership over domestic waste classification management within their own administrative regions, implement domestic waste classification work goals, coordinate the construction of domestic waste classification and placement, collection, transportation and processing facilities, and ensure operation.
The township (town) people's government and sub-district offices are responsible for the specific implementation of the classification, collection and transfer of domestic waste within their jurisdiction, as well as related supervision and disposal work.
The village (resident) committee shall do a good job in publicity and guidance on the classification of domestic waste in the residential areas of village (residents) within its jurisdiction, and assist the units, village (residents) and property service companies in the jurisdiction to carry out domestic waste classification Classification work. Encourage village (resident) committees to formulate village rules and regulations or management regulations, and urge and guide village (residents) to actively participate in domestic waste management.
Article 6 The urban management department of the Municipal People's Government is the competent department for the classification and management of urban domestic waste in this city. It is responsible for the organization, implementation, inspection, guidance, supervision and management of the classification of urban domestic waste in this city, and is responsible for the management of other garbage transfer station facilities at the same level in the city. and operations, formulate graphic signs and technical specifications for domestic waste classification collection containers and disclose them to the public, do a good job in the supervision and management of terminal classification processing facilities, and urge property service companies to carry out domestic waste classification and other work.
The supervision and management of domestic waste under the people's government at the county level shall be organized and implemented by the department determined by the people's government at the same level (hereinafter collectively referred to as the domestic waste supervision and management department of the people's government at the county level).
The development and reform department is responsible for incorporating domestic waste classification management into the national economic and social development plan, and doing a good job in the approval, filing or approval management of projects related to domestic waste classification.
The education department is responsible for organizing, supervising and guiding the domestic waste classification work of schools, kindergartens and other educational institutions, and urging schools, kindergartens and other educational institutions to carry out knowledge and education on domestic waste classification.
The financial department is responsible for ensuring funding for the classification and management of domestic waste.
The housing and urban-rural development department is responsible for promoting the construction of domestic waste classification facilities and the supervision and management of the city's rural domestic waste classification.
The natural resources authorities are responsible for incorporating the construction of facilities for the classification, collection, transfer, and disposal of domestic waste into the supporting planning requirements for public service facilities in construction projects, and planning the land required for relevant infrastructure construction. and land supply work.
The agricultural and rural authorities are responsible for guiding the development and utilization of renewable energy resources in rural domestic waste.
The competent department of ecology and environment is responsible for monitoring the emission of pollutants from domestic waste classification centralized transfer and disposal facilities, as well as the supervision and management of the prevention and control of environmental pollution during the collection, storage, transportation and disposal of hazardous waste.
The competent commerce department is responsible for promoting the recycling management of recyclables in domestic waste, formulating and implementing development plans and industrial policies for the renewable resource recycling industry.
The public security, market supervision and management, culture and tourism, health, transportation, agency affairs management and other competent departments shall work together to do a good job in the classification and management of domestic waste in accordance with their respective responsibilities.
The competent departments of various industries should incorporate the classification of domestic waste into the industry management responsibilities, and guide and supervise relevant units in the industry to do a good job in classifying domestic waste.
