Establishing and perfecting the system of punishing and preventing corruption is the starting point for the CPC Central Committee with Comrade Hu Jintao as the general secretary to complete the major task of economic and social development and consolidate the overall ruling position of the party. It has a very important position and role in the construction of anti-corruption by deepening the understanding of the ruling law and the anti-corruption work law, profoundly summing up the practical experience of anti-corruption and accurately grasping the scientific conclusions drawn from the current situation of anti-corruption in China.
(1) Building a system for punishing and preventing corruption is a major strategic decision. Since the 16th National Congress of the Communist Party of China, the CPC Central Committee with Comrade Hu Jintao as the general secretary has attached great importance to the building of a clean and honest party style and the struggle against corruption, developed through inheritance and innovated through practice, and made a strategic decision to establish and improve a system for punishing and preventing corruption. On June 5438+ 10, 2003, the Third Plenary Session of the 16th CPC Central Committee put forward the goal of establishing and perfecting a system of punishing and preventing corruption that is compatible with the socialist market economic system. In September, 2004, the Fourth Plenary Session of the 16th CPC Central Committee emphasized that we should adhere to the principle of treating both the symptoms and root causes, comprehensive management, giving equal attention to punishment and prevention, and pay close attention to establishing and improving the system of punishing and preventing corruption. The 17th National Congress of the Communist Party of China wrote the policy of anti-corruption construction, establishing and perfecting the system of punishing and preventing corruption into party constitution, and fixed it in the form of fundamental laws and regulations within the Party, which is a scientific summary and full affirmation of the theory and practice of anti-corruption in recent years. The Fourth Plenary Session of the Seventeenth Central Committee clearly put forward that the construction of a system for punishing and preventing corruption should be accelerated and the anti-corruption struggle should be carried out in depth. On June 5438+ 10, 2005, the Central Committee of the Communist Party of China promulgated the Implementation Outline for Establishing and Perfecting the System of Punishing and Preventing Corruption, and in May 2008, it issued the Work Plan for Establishing and Perfecting the System of Punishing and Preventing Corruption for 2008-20 12. Party committees and governments at all levels should, in accordance with the basic requirements of reform and innovation, simultaneous punishment and prevention, overall promotion and key construction, do a good job in the construction of a system for punishing and preventing corruption and effectively enhance the effectiveness of anti-corruption construction. From this, we can clearly see that the requirements of the CPC Central Committee for the construction of a system to punish and prevent corruption are consistent, and the principles and policies for the construction of anti-corruption are also deepening, developing and improving. Constructing and perfecting the punishment and prevention system is the focus of anti-corruption construction. Through the overall coordination, systematic governance and overall promotion of anti-corruption work, the scientific, institutionalized and standardized level of anti-corruption construction will be continuously improved.
(2) Party committees and governments attach great importance to it and consciously assume the main responsibility for the construction of a system for punishing and preventing corruption. Party committees (party groups), governments and discipline inspection and supervision organs at all levels have incorporated anti-corruption into all important policies and measures in accordance with the requirements and arrangements of the central authorities, persisted in solving corruption problems with development ideas and reform methods, made great efforts to improve the system of punishing and preventing corruption, and strived to explore new ways and methods to strengthen education, improve the system, strengthen supervision, deepen reform, strictly rectify and resolutely punish, and made new progress in the construction of the system of punishing and preventing corruption. The anti-corruption situation of the whole party and society has been further consolidated and developed, the governance of outstanding problems in key areas and key links has been further strengthened, and the comprehensive effect of taking multiple measures to prevent and control corruption has been further revealed.
Since last year, Party committees and governments at all levels have taken the implementation of the Work Plan for Establishing and Perfecting the System of Punishing and Preventing Corruption for 2008-20 12 as a major political task, put it on the important agenda of the Party committees and governments, determined the annual work objectives, defined the work tasks of the lead units and co-organizers of the system of punishing and preventing corruption, and deployed and implemented it together with the economic and social development work, thus playing the main role of anti-corruption responsibility. At the beginning of 2009, 3 1 provinces (autonomous regions and municipalities), Xinjiang production and construction corps, 39 leading units of punishment and prevention system construction of central and state organs, 132 key state-owned enterprises in the central government and 12 central financial enterprises' party committees (party groups) generally held anti-corruption deployment meetings, and the main responsible comrades of the party committees (party groups) attended the meeting. After the Central Commission for Discipline Inspection held the deployment meeting to promote the inspection of the system of punishing and preventing corruption in 2009, all localities and departments quickly implemented the spirit of the meeting and formulated the inspection "plan" and "method", which were personally examined and approved by the main leaders of the Party Committee and the government. At present, party secretaries and provincial leading cadres in eight provinces have led teams to check the implementation of the punishment and prevention system and the responsibility system for building a clean and honest government, and other provinces (autonomous regions and municipalities) are also actively carrying out this work.
(three) to establish and improve the coordination mechanism, and form a joint force of the lead unit and the co-organizer in the construction of punishment and prevention system to grasp the construction of anti-corruption. At present, the central and state organs 17 lead units and co-organizers have established a joint meeting mechanism. The People's Bank of China, the China Banking Regulatory Commission, the China Insurance Regulatory Commission and the China Securities Regulatory Commission have jointly issued relevant documents, established a joint meeting system for the construction of punishment and prevention systems, and determined the working procedures. The Ministry of Finance has established a division of labor and cooperation system with the National Development and Reform Commission, the People's Bank of China and other units for the seven leading tasks undertaken. The Supreme People's Court, the Supreme People's Procuratorate, the State Administration of Work Safety and other units, using the joint conference platform, regularly study with the co-organizers. The Supervision Department of the Central Commission for Discipline Inspection, the Central Organization Department, the Ministry of Public Security, the Ministry of Justice, the Ministry of Foreign Affairs and other departments have established an inter-ministerial joint meeting system to prevent the escape of public officials who violate discipline and law. Some provinces (autonomous regions and municipalities) lead units and co-organizers have formulated norms for contact and cooperation, forming a joint effort to fight corruption and promote honesty.
The second is to strengthen supervision and inspection and promote the implementation of major central decision-making arrangements.
It is an important duty of the discipline inspection and supervision organs to carry out supervision and inspection around the major decision-making arrangements of the central government, ensure the implementation of the party's line, principles and policies, and ensure the smooth implementation of central government decrees. The work done in this respect mainly includes:
(a) to strengthen the supervision and inspection of the implementation of the central government's policy of expanding domestic demand and promoting economic growth. Since last year, the Supervision Department of the Central Commission for Discipline Inspection has carried out in-depth supervision and inspection closely around the implementation of a series of major decision-making arrangements such as ensuring growth, ensuring people's livelihood and ensuring stability. Together with the National Development and Reform Commission, the Ministry of Finance, the National Audit Office and other departments, 24 central inspection teams for the implementation of the policy of expanding domestic demand and promoting economic growth were formed, which went deep into 3/kloc-0 provinces (autonomous regions and municipalities) and Xinjiang Production and Construction Corps in three rounds, as well as relevant central departments and central enterprises. Focus on supervision and inspection of the implementation of the new central investment of 654.38 billion yuan in 2008 and 280 billion yuan in 2009, timely discover and correct problems such as slow project progress, inadequate implementation of matching funds, lax project approval and construction procedures, improper fund allocation management, irregular bidding and project management, and seriously investigate and deal with a number of cases of violation of discipline and law, effectively preventing serious violations of discipline and law and promoting the smooth progress of central investment projects. According to statistics, 24 Central Leading Group for Inspection Work made a total of 3,963 rounds of inspections (times). By the end of 2009, the national discipline inspection and supervision organs had investigated 88 cases of violation of discipline and law in implementing the policy of expanding domestic demand and promoting growth.
(2) Strengthen the supervision and inspection of land management and mineral resources development. In view of the fact that some local units illegally granted land under the pretext of coping with the international financial crisis, the Supervision Department of the Central Commission for Discipline Inspection and the Ministry of Land and Resources issued the Notice on Seriously Investigating and Punishing Illegal Acts of Not Reporting Land Use, and seriously investigated and dealt with relevant illegal acts; In conjunction with the Ministry of Finance, the Ministry of Land and Resources, the People's Bank of China and the National Audit Office, the Notice on Further Strengthening the Management of Land Transfer Revenue and Expenditure was issued, requiring all localities to fully incorporate the land transfer revenue and expenditure into the local capital budget management to ensure that the land transfer revenue is collected and paid into the local treasury on time and in full, and the expenditure should be arranged from the land transfer revenue through the local fund budget, and a thorough "two lines of revenue and expenditure" management should be implemented. Last year, discipline inspection and supervision organs at all levels, together with relevant departments, investigated and dealt with 33,643 cases of illegal land use, of which discipline inspection and supervision organs investigated and dealt with 100 1 case.
(three) to strengthen the supervision and inspection of the implementation of energy conservation and emission reduction and environmental protection policies and measures. Conscientiously carry out supervision and inspection on the implementation of energy conservation and emission reduction targets and the implementation of the environmental impact assessment system, and resolutely prevent and correct illegal approval or approval of projects, especially those with high energy consumption and high pollution. During the period of1-1in 2009, 9 cases of environmental violations were investigated and dealt with nationwide 10489, and 5 cases of environmental violations were listed and supervised together with the Ministry of Environmental Protection.
Third, strengthen the education and supervision of party style and clean government, and improve the consciousness of leading cadres to be honest in politics.
Carrying out anti-corruption education is the basic work to prevent corruption and the ideological guarantee for leading cadres to resist corruption and change. While strengthening education, strengthening the restriction and supervision of leading cadres' power exercise plays a key role in enhancing the effect of anti-corruption education, standardizing the operation of power and effectively preventing corruption.
(a) to carry out the education of party spirit, party style, party discipline and clean government, and enhance the awareness of honesty and self-discipline of leading cadres. First, special training courses on clean and honest political education for leading cadres were held at different levels, focusing on training the main leaders of the party and government and clarifying the requirements of party discipline and political discipline. In many places, special education on leading cadres' incorruptibility in politics has been carried out, and the main leaders of party committees and governments have personally made counseling reports and put forward requirements for party discipline and political discipline for the main leading cadres of the party and government in cities and counties. The second is to make full use of typical cases to carry out warning education and give full play to the fundamental role of investigating cases. Many places have established warning education demonstration bases to educate party member cadres, especially leading cadres, with typical cases. The third is to strengthen post clean government education. In some places, combined with the actual work, pilot projects of post clean government education were carried out, and combined with post responsibilities and discipline requirements, public officials were educated and guided to perform their duties in a standardized manner. Fourth, actively carry out the pilot work of the clean government examination before leading cadres take office. Some provinces (autonomous regions and municipalities) actively promoted the pilot project of promoting learning through examination and achieved initial results. Fifth, the Supervision Department of the Central Commission for Discipline Inspection, the Publicity Department of the Communist Party of China, the Ministry of Culture, the State Administration of Radio, Film and Television, and the General Administration of Press and Publication jointly formulated and issued the Opinions on Strengthening the Construction of a Clean Government Culture, and jointly launched public service advertisements for clean government with relevant departments to further promote the creation of a clean government culture, enhance the anti-corruption awareness of the whole society, and form an ideological and moral foundation and social and cultural atmosphere of integrity.
(2) Strengthen the cultivation of leading cadres' party spirit and work style, and focus on solving outstanding problems in leading cadres' work style. Party committees, governments and discipline inspection and supervision organs at all levels conscientiously implement the central decision-making arrangements, focus on solving outstanding problems in leading cadres' party spirit, party style and party discipline, and vigorously strengthen the work style construction of leading cadres. First, use a variety of carriers to carry out work style construction theme practice activities. All localities and departments regard strengthening the work style construction of leading cadres as the key work to be implemented in 2009, and carry out a series of thematic practice activities with the main contents of "strengthening party spirit cultivation, promoting fine work style" and "serving the economy to ensure growth, improving people's livelihood and ensuring stability". The second is to implement the requirements of the central government for strict economy and stop the wind of extravagance and waste. The Supervision Department of the Central Commission for Discipline Inspection and the Ministry of Finance jointly issued the Notice on Taking Effective Measures to Seriously Implement the Eight Requirements of Strict Economy (Zhong [2009] 1 1), which made overall arrangements for the implementation of the document of the Central Commission for Discipline Inspection11and put forward clear requirements. The third is to organize special governance for outstanding problems. In some places, the problems existing in the style of leading cadres, such as weakening the purpose, passing the buck, being lazy or inefficient, have been dealt with. The fourth is to strengthen supervision and inspection and promote the implementation of the work. All localities have established rules and regulations, strengthened supervision, and promoted further changes in the style of leading cadres.
All regions and departments have reduced the budgets for going abroad on business, vehicle purchase and operation, and official reception by 654.38+05.806 billion yuan; Compared with the average level in the past three years, the number of party and government cadres going abroad on business, the number of people and the funds decreased by 49.0%, 45.5% and 37.6% respectively. Public funds for traveling abroad have been further curbed. In the first half of 2009, the national discipline inspection and supervision organs investigated and dealt with a total of 103 cases involving 3 19 people, and recovered the amount involved of 5,376,438+million yuan.
(3) Strengthen the supervision and restriction on the exercise of leading cadres' power, and promote the standardized operation of power. We will conscientiously implement the regulations on inner-party supervision, implement an inner-party inquiry and inquiry system for members of local party committees and discipline inspection commissions in conjunction with relevant departments, and actively carry out pilot work on handling requests for dismissal or replacement by members of local party committees and discipline inspection commissions. The economic responsibility audit of leading cadres of the party and government and leaders of state-owned enterprises has been further promoted. The inspection work always takes finding problems as the focus, strengthening the application of inspection results as the lifeline, and promoting the work as the fundamental purpose. The Central Leading Group for Inspection Work has visited Zhejiang and other provinces (autonomous regions and municipalities), China Insurance Regulatory Commission and other four central financial institutions, and China Shipping (Group) Corporation and other four important state-owned enterprises, and visited China Everbright (Group) Company, which has promoted the implementation of major central decision-making arrangements and strengthened. The inspection teams of the Party committees of the provinces (autonomous regions and municipalities) and Xinjiang Production and Construction Corps also completed the inspection tour of 149 cities (prefectures and leagues), and visited 199 provincial departments, 37 1 county (city, district and banner) and 29 provinces (autonomous regions and municipalities).
In 2009, under the strong leadership of the CPC Central Committee and the State Council, discipline inspection and supervision organs at all levels conscientiously implemented the spirit of the 17th National Congress of the Communist Party of China and the Third and Fourth Plenary Sessions of the Seventeenth Central Committee, severely investigated and dealt with a number of major cases of violation of discipline and law, which effectively promoted the building of a clean and honest party style and the in-depth development of the anti-corruption struggle.
(1) Seriously investigate and deal with cases of violation of discipline and law. During the period of1-1in 2009, discipline inspection and supervision organs at all levels accepted a total of 13 18362 complaints (times), initially verified disciplinary clues 140828, and filed a case/kloc-0. Of those punished, 85,353 were disciplined and 29,765,438+08 were disciplined. Major cases such as Wang Yi, Mi, Zhou, Pi, Huang Songyou, and Zhou were severely punished, which reflected our Party's firm determination to punish corruption, deterred corrupt elements and enhanced people's confidence in the anti-corruption struggle.
(two) to carry out special treatment of outstanding problems in the field of engineering construction. In July 2009, the central government made a decision to focus on the special treatment of outstanding problems in the field of engineering construction in about two years, and issued the Opinions on the Special Treatment of Outstanding Problems in the Field of Engineering Construction. The Central Leading Group for the Special Treatment of Outstanding Problems in Engineering Construction has formulated and issued the Implementation Plan for the Special Treatment of Outstanding Problems in Engineering Construction, Opinions on Organizing the Investigation of Outstanding Problems in Engineering Construction and Notice on Further Strengthening the Investigation of Cases of Violation of Discipline and Law in Engineering Construction. All relevant departments in various regions set up special governance leading groups and their working institutions to formulate specific work plans or guidance. Set up a special management hotline and reporting website and announce it to the public, and arrange a special person to be responsible for receiving reports and complaints. Established a case clue transfer system and an important case investigation mechanism with relevant industry authorities, regulatory authorities and law enforcement departments. According to statistics, since the implementation of the special treatment work, the discipline inspection and supervision organs at all levels have filed a total of 35 cases17, and given disciplinary sanctions15,21person. The special governance work started well.
(three) to carry out in-depth control of commercial bribery. Focusing on key areas and links such as engineering construction, land transfer and finance, we will focus on investigating and handling commercial bribery cases in which state civil servants use the power of examination and approval, law enforcement and judicial power to engage in collusion between officials and businessmen, trade power and money, ask for bribes and accept bribes, and seriously infringe on the interests of the masses. Severely investigated and dealt with a number of cases involving a large amount of money, serious harm and bad influence. According to statistics, during the period of1-1in 2009, a total of13,858 commercial bribery cases were investigated and dealt with nationwide, involving 3.29 billion yuan, including 2,906 cases involving national civil servants and 3,202 national civil servants. At the same time, actively and properly handle transnational (border) commercial bribery cases, vigorously promote the construction of market integrity system, and standardize the overseas business behavior of Chinese-funded enterprises.
Five, seriously correct unhealthy practices that harm the interests of the masses, and earnestly safeguard the interests of the masses.
Discipline inspection and supervision organs at all levels always regard safeguarding the interests of the masses as an important task, effectively solve outstanding problems that harm the interests of the masses, and let the people feel the actual results of our party's anti-corruption.
(a) clean up and standardize the appraisal and commendation work and achieve remarkable results. 75,588 projects were appraised and commended by the Party-masses system in China, and 73,726 projects were cancelled, with a cancellation rate of 97.54%. By drastically reducing the number of projects, the burden on the grassroots, enterprises and the masses has been reduced, and the work style of departments and industries has been promoted.
(two) to effectively correct the outstanding problems that harm the interests of farmers. In conjunction with relevant departments, we will strengthen supervision and inspection of the implementation of the central government's policy of strengthening agriculture and benefiting farmers, effectively curb unhealthy practices that harm farmers' interests, and further reduce farmers' burden. 2,933 agricultural documents and 5,865 charging items were cleared nationwide, and the problems of arbitrary charges, fines and various fund-raising assessments related to agriculture were corrected and investigated, reducing the burden on farmers by 670 million yuan.
(3) Strengthen food and drug safety rectification. Actively carry out special rectification to crack down on illegal addition of non-edible substances and abuse of food additives, severely crack down on the use of the Internet and other media to publish false advertisements and sell counterfeit drugs through postal channels, further standardize the food and drug market order, and further reduce food and drug safety incidents.
(4) Deepening the management of education fees. The level of funding for rural compulsory education has been further improved. The central government allocated 2965438+200 million yuan for the reform of the rural compulsory education funding guarantee mechanism, and the provinces provided 25.27 billion yuan. A total of 106 items were cancelled nationwide (times). * * * investigated and dealt with the problem of unreasonable charges in education nationwide, involving an amount of 4 1 10,000 yuan, and 245 million yuan has been retired, and 3,530 people have been given disciplinary or other treatment.
(5) Effectively curb unhealthy practices in the purchase and sale of medicines and medical services. Government-led, province-based centralized online drug procurement has been comprehensively promoted, and unhealthy trends in drug circulation and sales have been effectively curbed. Medical institutions' diagnosis and treatment services and charging behaviors are more standardized, and the problem of arbitrary charges is significantly reduced.
(six) to strengthen the supervision of social security funds, housing provident fund, poverty alleviation funds and disaster relief funds. All localities have strengthened auditing and financial supervision, found and corrected the problems of detention, waste and illegal use of funds in time, severely investigated and dealt with corruption, embezzlement, misappropriation and fraudulent use of funds, and strictly investigated the responsibilities, thus promoting the standardization of fund management and operation. Through governance, 4,245 cases of disciplinary problems in the management and use of the "four funds" were investigated and dealt with nationwide, involving 4.45 billion yuan of funds, and 1574 people were given disciplinary sanctions or other treatments.
(7) Strengthen the efforts to control the "three chaos" of highways from the source. The work of cleaning up and standardizing the charging items involved in the reform of refined oil prices and taxes and fees is progressing smoothly, and 2 17 administrative charging items involving transportation and vehicles are cancelled in various places, involving an amount of 39.249 billion yuan; Cancel the toll station 1.430 of the government repayment secondary road.
Six, constantly increase the intensity of system construction, and further improve the level of institutionalization and legalization of anti-corruption.
2009 is a year in which important progress has been made in the construction of anti-corruption system. On May 22, 2009, a meeting was held in the Political Bureau of the Central Committee, China, at which the Interim Provisions on the Accountability of Leading Cadres of the Party and Government, Several Provisions on the Integrity of Leaders of State-owned Enterprises and Regulations on the Inspection Work of the China Production Party (for Trial Implementation) were reviewed and approved. * * * The meeting of the Political Bureau of the Communist Party of China deliberated and passed three anti-corruption laws and regulations at one time, which fully reflected that the CPC Central Committee attached great importance to the construction of anti-corruption system. In order to promote the implementation of the three laws and regulations and the Opinions on Special Treatment of Outstanding Problems in Engineering Construction, the Central Commission for Discipline Inspection held a symposium of the Secretary of the National Commission for Discipline Inspection from July 13 to June 14, 2009, and made special arrangements for related work. Discipline inspection and supervision organs at all levels earnestly study and understand the spirit of the central authorities, actively play their functional roles, and assist the party committees and governments in their implementation. In addition, a number of specific systems and measures have been formulated and implemented in conjunction with relevant departments to vigorously promote the construction of anti-corruption laws and regulations.
(a) to improve the integrity of politics, integrity in politics. On June 29th, 2009, the the Political Bureau of the Communist Party of China (CPC) Central Committee Conference deliberated and adopted "Several Guidelines for party member Leading Cadres of China * * * Production Party", which is an important basic regulation for regulating the political behavior of leading cadres in party member, and is of great significance for ensuring the honesty and self-discipline of leading cadres in party member, strengthening the construction of cadres, further improving the level of managing the party and promoting the construction of anti-corruption. The Ministry of Supervision and other ministries and commissions promulgated the Provisions on Punishment of Leaders of State-owned Enterprises for Violating the Seven Requirements of Integrity and Self-discipline.
(2) improve the punishment system for violations of law and discipline. In order to standardize the financial and economic order, enforce the financial and economic discipline, and punish the disciplinary actions of setting up and using "small coffers", the Central Commission for Discipline Inspection issued the Notes on Several Issues Concerning the Application of the Regulations on Disciplinary Actions within the Chinese Production Party to the disciplinary actions of setting up and using "small coffers". In order to punish and prevent statistical violations, the Ministry of Supervision, Ministry of Human Resources and Social Security and the National Bureau of Statistics promulgated the Provisions on Punishment of Statistical Violations. In order to punish the organization's violation of discipline, the Central Commission for Discipline Inspection officially issued the Interpretation on Several Issues Concerning the Application of the Regulations on Disciplinary Actions of China Production Party.
(3) Promote the convergence between the United Nations Convention against Corruption and China's legal system. From May to September, 2009, the Ministry of Supervision, together with relevant departments of the State Council, sent personnel to Vienna for three times to attend the meeting of the Intergovernmental Working Group on the Review of the Implementation of the United Nations Convention against Corruption and Technical Assistance. At the invitation of the United Nations Secretariat, a delegation from the Ministry of Supervision and the National Bureau of Corruption Prevention went to Doha, Qatar on June 5438+065438+ 10, 2009 to attend the Third Conference of the States Parties to the United Nations Convention against Corruption.
Seven, solidly promote the reform of key areas and key links, and further deepen the prevention and control of corruption from the source.
Solving the deep-seated problems that lead to corruption with reform ideas and methods is the fundamental way to effectively punish and prevent corruption. Since the beginning of this year, a number of reform measures have been implemented and the work is progressing smoothly.
(1) New achievements have been made in the reform of the administrative examination and approval system. In accordance with the requirements of strict control according to law, reasonable control and supervision control, combined with the reality of the reform of administrative management system and the transformation of government functions, and in line with the principle of "the reduction is the reduction", a new round of examination and demonstration was conducted on the existing administrative examination and approval items of the State Council departments. The examination and approval items to be newly established by some departments in the State Council should be strictly examined and checked. Supervise the cancellation and adjustment of a number of administrative examination and approval projects. In 2009, provinces (autonomous regions and municipalities) cancelled 1925 administrative examination and approval items and delegated 2 1 16 administrative examination and approval items.
(2) Deepening the reform of the fiscal and taxation system. The system of "two lines of revenue and expenditure" was further improved, and administrative fees, individual industrial and commercial households management fees and bazaar management fees were cancelled or stopped nationwide 100. The reform of centralized treasury payment system has been comprehensively deepened. More than 320,000 central and local grassroots budget units have implemented the reform of centralized treasury payment, and more than 230,000 income collection units have implemented the reform of non-tax revenue collection.
