Measures for the Administration of Drug Addiction in Hubei Province

Chapter I General Provisions Article 1 In order to strengthen the management of drug rehabilitation, effectively treat drug addicts and injecting drug addicts (hereinafter referred to as drug addicts) and maintain social order, these measures are formulated in accordance with the Decision of the NPC Standing Committee on Drug Control, the Measures for Compulsory Drug Rehabilitation of the State Council and other relevant laws and regulations, and in combination with the actual situation of our province. Article 2 These Measures shall apply to the establishment of drug rehabilitation places and the implementation of drug rehabilitation management within the administrative area of Hubei Province.

The measures referred to in drug rehabilitation centers refer to compulsory drug rehabilitation centers planned by the provincial people's government, established and managed by public security organs, reeducation-through-labor centers established in accordance with the relevant provisions of the state (hereinafter referred to as reeducation-through-labor centers) and medical institutions approved for voluntary drug rehabilitation (hereinafter referred to as drug rehabilitation treatment institutions). Article 3 People's governments at all levels should strengthen their leadership and social propaganda on drug control and drug rehabilitation. The people's governments at or above the county level (including county-level cities, provincial cities and districts, the same below) shall set up a leading group for drug control, which shall be responsible for coordinating and organizing drug rehabilitation work.

Public security organs are in charge of drug control and drug rehabilitation. The anti-drug leading group office of the people's government at or above the county level is located in the public security organ and is responsible for its daily work.

Health, justice and other departments should carry out work related to drug rehabilitation activities in accordance with their respective responsibilities. Article 4 Drug rehabilitation centers should establish and improve various management systems, implement legal management and civilized management, strengthen legal and moral education, and implement the method of combining drug therapy with psychotherapy, so that drug addicts can get rid of drug habit and become useful people in society.

Help and education personnel shall respect the privacy rights of drug addicts and shall not disclose the relevant information of drug addicts to others. Article 5 The family members of drug addicts, the unit where they work, the local police station where their registered residence is located and relevant social parties shall formulate measures to help drug addicts completely quit drug addiction and prevent relapse. Sixth drug addicts' detoxification experience is not recorded in personal files, and there is no discrimination in further education and employment after detoxification. Article 7 Units and individuals who have made remarkable achievements in drug rehabilitation shall be commended and rewarded by people's governments at all levels or public security organs. Chapter II Establishment and Conditions of Drug Rehabilitation Places Article 8 The establishment plan of drug rehabilitation places shall be put forward by the provincial leading group for drug rehabilitation according to the actual situation of drug rehabilitation in various places, and shall be implemented after being approved by the provincial people's government. Article 9 A drug rehabilitation center must meet the following conditions:

(1) Having a place suitable for conducting business. Wards in drug rehabilitation centers should be closed; Drug treatment wards should be equipped with consultation rooms, pharmacies, laboratories, wards, publicity and education rooms, indoor and outdoor activity rooms; Compulsory drug rehabilitation centers and reeducation-through-labor centers should also set up productive and working places.

(two) drug rehabilitation places should have the storage conditions of narcotic drugs and psychotropic drugs, and have the conditions and facilities for the diagnosis and treatment of common complications of drug rehabilitation and the rescue of critical cases.

(3) Having the necessary funds and personnel. Compulsory drug rehabilitation centers should be equipped with necessary discipline cadres, medical personnel and guards; The person in charge of the compulsory drug rehabilitation center and the main health technical personnel must be on-the-job personnel of the unit; Doctors engaged in drug therapy must have the technical title of doctor or above and have been engaged in mental health work for more than 2 years. Discipline cadres engaged in drug rehabilitation management and education must be people's policemen with college education or above and engaged in public security work for more than 2 years. Nursing staff engaged in drug rehabilitation nursing work must have the technical title of nurse or above and have been engaged in mental health professional work for more than 2 years; At least 1 person with the technical title of pharmacist or above is responsible for drug rehabilitation management. Article 10 The establishment of a compulsory drug rehabilitation center shall be reported to the public security organ at or above the county level for approval in accordance with the relevant provisions of the state, and the office of the provincial leading group for drug control shall organize relevant departments to conduct inspection and acceptance. In line with the conditions, the provincial health administrative department and the provincial anti-drug leading group office respectively issued the Practice License for Medical Institutions and the Practice License for Drug Rehabilitation and Drug Treatment, and they are licensed to practice.

The establishment of reeducation-through-labor drug rehabilitation center was proposed by the provincial judicial administrative department, and was approved by the provincial anti-drug leading group office after organizing the relevant departments to accept it.

The establishment of a voluntary drug rehabilitation center shall be applied by a unit with corresponding technology and facilities according to the prescribed procedures, and the office of the provincial drug control leading group shall organize the relevant departments to accept it. Meet the conditions, by the provincial health administrative department and the provincial drug control leading group office were issued the "medical institution practice license" and "drug rehabilitation medical practice license", licensed to practice.

No unit or individual may carry out drug rehabilitation medical service without obtaining the "Drug Rehabilitation Medical Practice License" issued by the Office of the Provincial Drug Control Leading Group. Article 11 Drug rehabilitation centers shall not set up branches engaged in drug rehabilitation treatment, and shall not subcontract or entrust drug rehabilitation services to other units and individuals. Twelfth the establishment of compulsory drug rehabilitation centers, should make full use of the existing local conditions.

The planning and financial departments of the people's governments at or above the county level shall incorporate the capital construction investment and required funds of compulsory drug rehabilitation centers into the capital construction plan and financial budget. Chapter III Administration of Drug Addiction Article 13 Public security organs shall send drug addicts to compulsory detoxification centers for detoxification. However, the following persons shall be ordered by the public security organs to give up drugs within a time limit outside the compulsory drug rehabilitation center:

(a) life can not take care of themselves;

(2) Suffering from acute infectious diseases or other serious diseases;

(3) Being pregnant or nursing a baby under one year old;

(4) Others who are not suitable for detoxification in compulsory detoxification centers.

Persons who have been ordered to give up drugs within a time limit should give up drugs themselves or go to drug rehabilitation institutions for drug treatment.
