According to the Regulations of Sichuan Province on Property Management (hereinafter referred to as the Regulations), the power supply and distribution facilities in residential areas completed on May 1 2022 shall be designed and constructed by the construction unit in accordance with national, industrial and local technical standards and norms, and the power supply and distribution facilities and related pipelines shall be handed over in accordance with the requirements of the Regulations.
Among them, if the facilities, equipment and related pipelines for high-voltage power supply in new residential areas are installed and constructed by qualified units organized by power supply enterprises according to law and pass the completion acceptance, the power supply enterprises shall be responsible for maintenance.
If the facilities, equipment and related pipelines for high-voltage power supply in newly-built residential areas are installed and constructed by qualified units organized by the construction unit according to law and passed the completion acceptance, with the consent of the owners, the owners' committee or the entrusted property service personnel may hand over the facilities, equipment and related pipelines for high-voltage power supply to the power supply enterprise for maintenance.

According to the requirements of the Regulations, after the owners of power supply and distribution facilities agree and sign the handover agreement, they will be maintained by the power supply enterprises.
In terms of handover scope, the property right does not belong to the 10 kV power supply line outside the red line of the residential quarter of the power supply enterprise, and the facilities, equipment and related pipelines for power supply in the property service area (including the resettlement quarter funded by the government), including pipelines, switches (cabinets), metering devices, transformers and supporting auxiliary facilities involving high voltage of residents between the red line of the building division and the transformer in the property service area.
The Exposure Draft also mentioned the handover conditions-there should be a clear demarcation point between the handover facilities and the non-handover facilities; The assets supporting equipment to be handed over are attached with land, houses and buildings, and the relevant safety responsibilities should be clearly defined in the agreement. The assets to be handed over must have clear ownership certificates, and there are no guarantee, pledge, mortgage, ownership disputes and unresolved legal disputes in the assets, and the users have the ownership and exclusive right to dispose of the assets. If the transferred equipment has other rights, but can be dismantled by other means, it shall be dismantled before the transfer.
In terms of financial support, according to the Notice of the General Office of the Municipal Government on Printing and Distributing the Action Plan of Optimizing Energy Structure to Promote Urban Green and Low-carbon Development in Chengdu and the Policies and Measures of Optimizing Energy Structure to Promote Urban Green and Low-carbon Development in Chengdu (Cheng Ban Fa (2022) No.36), if the power supply enterprise accepts the existing residential quarters, it will give each residential quarter a one-time reward of 40,000 yuan, which will be used as a whole for the operation, maintenance and management of power facilities in subsequent residential quarters.

Led by local electric power management departments and housing construction departments, neighborhood offices (township people's governments) and communities (villages) are responsible for organizing. For residential areas with industry committees, the industry committees shall apply on behalf of the owners according to law; For residential areas without industry committees, the community (village) entrusts the community management unit to apply on behalf of the owners; If there is no industry committee and management unit, the community (village) shall apply (hereinafter referred to as the applicant). After receiving the application, the power supply enterprise shall conduct an on-site inventory of the power supply and distribution facilities that need to be handed over, jointly determine the handover and reception scheme with the applicant, and publicize it in the community bulletin board for not less than 7 days.

The applicant organization shall solicit the opinions of all the owners, and the owners who account for more than two-thirds of the exclusive area of the residential area and the number of owners who account for more than two-thirds shall participate in the voting, and more than half of the owners who participate in the voting agree. The applicant shall place the voting results in the location formula of the community bulletin board for not less than 7 days. If the voting result does not meet the quorum requirement, the applicant may reorganize the voting after coordination by the local government department; If the voting result still does not meet the quorum requirement, the handover will be terminated.

After the voting is passed and the publicity expires, the power supply enterprise shall fulfill the internal decision-making procedures for receiving assets as soon as possible, sign a free transfer agreement with the transfer applicant for the customer's power supply and distribution assets, and clarify the transfer scope, transfer rights and obligations, and subsequent operation and maintenance management responsibilities of power supply and distribution facilities.

After the signing of the Agreement on Free Transfer of Customer's Power Supply and Distribution Assets, the power supply enterprise, the owners' committee of residential quarters, the management unit and the community (village) shall make an inventory of the transferred power supply and distribution facilities to form a physical list, which shall be signed by both parties in writing for confirmation. Power supply enterprises are responsible for asset appraisal through third-party appraisal institutions determined according to laws and regulations, and after the appraisal is completed, the assets are recorded according to the prescribed procedures.

The power supply enterprise is responsible for the maintenance of the power supply and distribution facilities and related pipelines handed over free of charge, and the costs of maintenance, conservation, renewal and transformation shall be borne by the power supply enterprise (if the new residential area is still in the warranty period, it shall be borne by the construction unit). According to the potential safety hazards of power supply and distribution facilities in residential areas and the present situation of surrounding distribution networks, overall planning and capital transformation will be carried out. If the property unit (construction unit, management unit, owners' committee, etc.). ) of the residential power supply and distribution facilities are really unwilling to hand over the power supply and distribution facilities, it shall be filed with the local housing and construction department, and the main body of responsibility shall be determined according to the principle of "who owns the property", and the residential management unit such as the property owner or the property service personnel entrusted by it shall perform the operation and maintenance obligations of the power supply and distribution facilities and bear corresponding responsibilities. Existing residential areas that have not been handed over to power supply and distribution facilities before the end of 2024 must be accepted by power supply enterprises in the later period, and those that fail to pass the acceptance shall be transformed by property owners themselves.
