The specific scope of special equipment is determined according to the catalogue of special equipment approved and published by the State Council.
The safety supervision of special motor vehicles in the field (factory) shall be implemented in accordance with the relevant provisions of the state. Article 3 Units and individuals engaged in the production (including design, manufacture, installation, renovation and maintenance, the same below), sale, use, inspection and safety supervision of special equipment within the administrative region of this province shall abide by these regulations.
Where laws and administrative regulations provide otherwise, such provisions shall prevail. Article 4 The people's governments at or above the county level shall strengthen their leadership over the safety work of special equipment, encourage the adoption of advanced technology and implement scientific management methods to improve the energy-saving performance and safety management level of special equipment. Timely coordinate and solve major problems existing in the safety supervision of special equipment, and organize relevant parties to investigate and manage hidden dangers of safety accidents of special equipment.
Township (town) people's governments and sub-district offices shall assist the safety supervision and management departments of special equipment to do a good job in safety supervision of special equipment. Fifth provincial special equipment safety supervision and management departments are responsible for the safety supervision of special equipment in the province, and the special equipment safety supervision and management departments of cities and counties (cities, districts) with districts are responsible for the safety supervision of special equipment within their respective administrative areas.
Safety production supervision and management, transportation, construction and other departments shall, in accordance with their respective responsibilities, do a good job in the safety supervision and management of special equipment. Article 6 Any unit or individual has the right to report any violation of these Regulations to the safety supervision and management department of special equipment and the administrative supervision department.
Special equipment safety supervision and management departments and administrative supervision departments shall keep confidential the informants and reward them in accordance with the relevant provisions of the state. Chapter II Production, Sale and Use Article 7 Units that produce, sell and use special equipment shall go through the corresponding administrative licensing, examination and approval and registration according to law, establish and improve the safety management system and post responsibility system for special equipment, and strengthen the education and training of professional and technical personnel and special equipment operators. No unit or individual may engage in the production, sale and use of special equipment without obtaining the corresponding administrative license, approval and registration according to law.
The main person in charge of the production, sale and use of special equipment is responsible for the safety of the production, sale and use of special equipment in this unit.
Encourage special equipment users involved in public safety to apply for third-party liability insurance for special equipment. Eighth special equipment manufacturing units should be in strict accordance with the design documents for production. If laws and regulations require the design documents to be appraised or the products to be type tested, mass production can only be carried out after the appraisal or test is qualified. Article 9 If a special equipment manufacturing unit or special equipment safety supervision and management department finds that the manufactured special equipment has defects that endanger personal and property safety due to reasons such as design, technology and materials, the manufacturing unit shall immediately stop production or deliver it for use, notify the sales and use units in time, and effectively eliminate the product defects by means of return, replacement and repair. Article 10 The sales unit of special equipment shall establish and strictly implement the system of checking, acceptance and sales account of special equipment, check the manufacturing license, design documents, product quality certificate, installation, use and maintenance instructions, supervision and inspection certificate and other documents of special equipment, be responsible for the legality of the products it sells, and shall not sell special equipment with incomplete licenses or special equipment explicitly eliminated, prohibited from manufacturing or forcibly scrapped by the state.
The sales unit shall immediately stop selling the special equipment with safety defects as stipulated in Article 9 of these regulations, and assist the manufacturing unit in handling it. Article 11 Whoever engages in the installation and renovation of pressure pipelines shall inform the county-level special equipment safety supervision and management department where the project is located in writing before construction, and report to the special equipment inspection and testing institution for supervision and inspection in accordance with the requirements of safety technical specifications. Those who fail to pass the supervision and inspection or fail to pass the supervision and inspection shall not be delivered for use.
Engaged in regular maintenance or emergency repair of pressure pipelines, it shall inform the county-level special equipment safety supervision and management department where the project is located in writing within ten days from the date of construction. Article 12 A cylinder filling unit shall obtain a cylinder filling license and be responsible for the safety of the filled cylinders and sales outlets.
It is forbidden to carry out loading and unloading operations in places that do not meet the safety requirements, and it is forbidden to overload cylinders, or to fill cylinders that are illegally manufactured, have not been inspected or failed to pass the inspection, and have exceeded the inspection period.
Where laws and regulations provide otherwise for the management of gas cylinder filling, such provisions shall prevail. Thirteenth special equipment users should meet the following requirements when using special equipment:
(a) the special equipment shall have the use registration documents, and the registration mark or safety inspection mark shall be placed in a prominent position of the equipment;
(two) the user shall set up a special equipment safety management organization or be equipped with full-time and part-time safety management personnel and operators. The safety management personnel and operators of special equipment must pass the examination by the safety supervision and management department of special equipment and obtain the corresponding qualification certificates;
(three) the user shall establish a system of safety management, maintenance and self-inspection of special equipment, and conduct self-inspection and daily maintenance in accordance with state regulations and make records;
(four) the user shall, one month before the expiration of the validity period of the special equipment inspection and testing, apply to the special equipment inspection and testing institution for regular inspection and testing, and shall not continue to use it without inspection and testing or unqualified inspection and testing;
(five) the user shall establish a responsibility system for the investigation and management of hidden dangers of safety accidents, and establish special equipment safety technical files and special equipment safety emergency plans according to regulations. If hidden dangers of safety accidents are found during use or through inspection and safety supervision, the hidden dangers shall be eliminated immediately or the use shall be stopped.
