Units and individuals should actively participate in the green life action, to develop a civilized, healthy, environmentally friendly lifestyle, and reduce the amount of kitchen waste generated from the source.
Encouragement and support for scientific research on kitchen waste treatment and process improvement, and promote the resourceful utilization and harmless treatment of kitchen waste. Article 5 municipal and district people's governments shall strengthen the management of kitchen waste management leadership and organization and coordination, the establishment of financial investment in stable guarantee mechanism, will be included in the relevant funds into this level of the financial budget.
The municipal environmental health department is responsible for the supervision and management of the city's kitchen waste. District environmental health departments should do a good job in the jurisdiction of the daily supervision and management of food waste.
The competent ecological environment department is responsible for the supervision and management of the prevention and control of environmental pollution in the process of generating, collecting, transporting and disposing of kitchen waste.
Development and reform, finance, natural resources and planning, market supervision and management, tourism and culture, business, water, agriculture and rural areas, public security, comprehensive administrative law enforcement and other relevant departments should be in accordance with their respective responsibilities to do a good job in the supervision and management of kitchen waste related work.
The catering industry associations should play the role of industry self-regulation, to assist the relevant departments to do a good job of supervision and management of kitchen waste.
Yucai Eco-District Management Committee shall determine the specific departments responsible for the day-to-day supervision and management of kitchen garbage in this jurisdiction. Article 6 The municipal people's government and its relevant departments shall, in accordance with the territorial spatial planning and relevant special planning, co-ordinate the collection and disposal of kitchen waste, the construction needs of facilities, to ensure that the collection and disposal facilities land. Article 7 of the kitchen waste to implement unified collection, centralized disposal franchise management.
The municipal environmental health department may, according to management needs, in accordance with the provisions of laws and regulations, respectively, to grant different kitchen waste collection and disposal service enterprises. If the government needs to provide feasibility gap subsidies, the municipal financial authorities are responsible for carrying out the relevant work.
The municipal environmental health department in conjunction with the relevant departments of food waste collection, disposal project franchise implementation program review. The relevant departments in accordance with their responsibilities to issue a written review respectively.
The municipal environmental health department comprehensive written review of the relevant departments, reported to the municipal people's government to finalize the kitchen waste collection and disposal project franchise implementation plan. Article IX of the municipal environmental health department according to the finalized kitchen waste collection, disposal project franchise implementation plan, should be through the bidding and other competitive means of selecting the franchisee, and signed a franchise agreement with the franchisee selected in accordance with the law.
The need to set up a project company, the municipal environmental sanitation department shall sign a preliminary agreement with the investor selected in accordance with the law, agreeing that it will be registered to set up a project company within a specified period of time, and sign a franchise agreement with the project company.
The franchise agreement should include the project name, content, franchise mode, area, scope and duration, the project company's registered capital, capital contribution and transfer of equity, the number, quality and standard of services, prices and charges for the determination of the method, standard and adjustment procedures, the government's commitments and guarantees, monitoring and evaluation, performance guarantees, liability for breach of contract and so on.
Franchise term expires after the need to continue to operate, kitchen waste collection, disposal service enterprises should be in the term expires thirty days before the municipal environmental health department for continuation procedures. Municipal environmental health department after full assessment and justification for the extension granted, should be with kitchen waste collection and disposal service enterprises to re-sign the franchise agreement. Article 10 is engaged in kitchen waste collection and disposal service enterprises, shall obtain kitchen waste collection and disposal service license according to law.
The municipal environmental health departments in accordance with the law to meet the conditions of the enterprise issued kitchen waste collection and disposal service license, and promptly obtain a service license for the enterprise list to the public. Article XI apply for kitchen waste collection and transportation service license shall meet the following conditions:
(1) with corporate personality;
(2) a legal road transport business license, vehicle license;
(3) a fixed office space and mechanical equipment, vehicle parking space;
(4) equipped to meet the collection and transportation of kitchen waste
(d) equipped with special collection containers to meet the needs of kitchen waste collection and transportation needs of fully enclosed automatic unloading vehicles, and install driving and loading and unloading recorders;
(f) have a sound technical, quality, safety, monitoring and other aspects of the management system;
(g) other conditions prescribed by laws and regulations.
