Other relatives who have a long-term dependency relationship with overseas Chinese or returned overseas Chinese, their status as overseas Chinese dependents can be examined and recognized by a notary public after the issuance of a notarization of dependency. Article 3 overseas Chinese requesting to return to their home countries to settle, by their own diplomatic representation in foreign countries, consular authorities or other foreign authorities authorized by the Ministry of Foreign Affairs to apply, or by themselves or through their domestic relatives to the proposed residence of the city or county public security organs to apply, by the provinces, autonomous regions and municipalities directly under the Central Municipality of the public security organs in accordance with the relevant provisions of the State issued a certificate of return to their home countries to settle. Article 4 The local people's governments and the relevant departments shall, in accordance with the relevant provisions of the State, provide resettlement for overseas Chinese who have returned to their home countries for settlement. Article 5 The All-China Federation of Returned Overseas Chinese and its local organizations shall carry out their activities in accordance with their statutes and safeguard the lawful rights and interests of returned overseas Chinese and their dependents.
Returned overseas Chinese and their dependents may, in accordance with the law, organize other social organizations to carry out lawful activities appropriate to the needs of returned overseas Chinese and their dependents.
The lawful rights and interests of social organizations for returning overseas Chinese and overseas Chinese and their legal activities in accordance with their statutes shall be protected by law; and no organization or individual shall appropriate or damage any property owned by them in accordance with law. Article 6 The State shall take appropriate measures to support farms, forest farms and other enterprises that resettle returned overseas Chinese.
The local people's governments and the departments concerned shall make special arrangements for the allocation of funds and materials to farms, forest farms and other enterprises for the resettlement of returned overseas Chinese, and shall earmark the funds for this purpose. Article 7 the resettlement of returned overseas Chinese farms, forestry and other enterprises legally use of state-owned land, forests, beaches, water and other natural resources, enterprises enjoy the right to use in accordance with the law, and their legitimate rights and interests, and their own means of production, management of crops, the products produced by the law shall be protected, no organization or individual shall encroach upon, or damage.
In case of disputes over the ownership of land or other natural resources between the farms and forests where returned overseas Chinese are resettled and other organizations or individuals, the disputing parties shall settle the disputes through consultations; in case the consultations fail, the disputes shall be dealt with in accordance with the provisions of the relevant laws and regulations. Article 8 If the farms, forest farms and other enterprises where returned overseas Chinese are resettled set up schools and health care institutions in accordance with the actual situation, the local people's government shall give support and assistance in the provision of teachers, medical personnel and training; and the State shall give assistance in the provision of equipment and funds. Article IX returned overseas Chinese, overseas Chinese may invest in various forms of industrial and commercial enterprises, their legitimate rights and interests are protected by law.
Returned overseas Chinese, overseas Chinese dependents to invest in industrial and commercial enterprises, investment in the development of deserted mountains, wasteland, mud flats, or engaged in agriculture, forestry, animal husbandry, by-products, fisheries production, the local people's government shall give support.
Returned overseas Chinese, overseas Chinese family members to accept gifts from friends and relatives outside the small production tools, directly for industrial and agricultural production, processing, maintenance, as well as approved imports of good seedlings, breeding animals, breeding poultry, breeding eggs, in accordance with relevant state regulations. Article 10 returned overseas Chinese, overseas Chinese in the country to establish public welfare undertakings, the local people's government and the relevant departments shall give support, their legitimate rights and interests are protected by law.
Returned overseas Chinese, overseas Chinese dependents to accept gifts from friends and relatives outside the material, directly for public welfare undertakings, the organization organizing the public welfare undertakings by the application, approved by the competent authorities, to enjoy the reduced or exempted from customs duties. Article 11 The State shall protect the ownership of the private houses of returned overseas Chinese and their dependents in China. Returned overseas Chinese and their dependents shall enjoy the rights of possession, use, disposal and income of their private houses in accordance with the law, which shall not be infringed upon by any organization or individual. Article 12 The lease of private housing of returned overseas Chinese and overseas Chinese shall be signed by the lessor and the lessee of the lease contract, and to the real estate management organs where the housing is registered for the record. When the lease contract is terminated, the lessee shall return the house to the lessor. Article 13 If the state expropriates land for national construction in accordance with the law and needs to demolish or relocate the private houses of overseas Chinese and their dependents, the demolition and relocation unit must hold the approval documents, demolition and relocation plans and demolition and relocation programs as stipulated by the state, and apply for demolition and relocation to the competent department of housing demolition and relocation of the people's government of the local people's government at the county level or above, and obtain the permit of housing demolition and relocation before demolition and relocation is permitted. The demolition and relocation unit shall give appropriate compensation and proper resettlement in accordance with the relevant provisions of the State. Article 14 The students of returned overseas Chinese, the children of returned overseas Chinese and the children of overseas Chinese in the country to apply for all kinds of post-compulsory education schools, the local enrollment department shall, in accordance with the relevant provisions of the State in conjunction with the actual situation in the region to give appropriate care. Article 15 State organs, social organizations and state-owned enterprises and institutions, when recruiting employees, under the same conditions, shall give priority to the employment of returned overseas students, returned overseas children and children of overseas Chinese in the country.
Returned overseas students, children of returned overseas Chinese and children of overseas Chinese in the country to organize employment and self-employment, the relevant departments shall give support. Article 16 Returned overseas Chinese and their dependents may apply to study abroad at their own expense.
Returned overseas Chinese, overseas Chinese dependents with university or university degree or above apply for self-funded study abroad, in accordance with the relevant provisions of the State to give appropriate care. Article 17 If a returned overseas Chinese or overseas Chinese goes abroad to study at his own expense and he is a serving employee, he may retain his official position for one year from the date he is allowed to leave the country; if he is a student of a higher education institution, his school registration shall be handled in accordance with the relevant provisions of the State.
Returned overseas Chinese and their dependents who have returned to their home countries after studying abroad at their own expense, and who request the state to arrange for their jobs, can contact the diplomatic representative organs and consular organs of their countries in foreign countries half a year before the date of graduation to apply for the relevant registration formalities; and the job arrangements shall be handled by the competent state education departments or personnel departments in accordance with the relevant provisions for the same kind and equivalent qualifications of the persons sent abroad to study.
