(2) Construction engineering equipment;
(3) Equipment under repair or transformation;
(four) special reserves, emergency rescue and disaster relief, military industry approved reserves and equipment necessary for mobilization of production;
(5) Equipment that consumes high energy, seriously pollutes the environment and endangers the personal safety of employees, as well as equipment that has been explicitly eliminated by the relevant departments of the State Council and is not allowed to be transferred and diffused;
(6) Equipment to be scrapped. Article 3 The adjustment and utilization of idle equipment refers to the adjustment, consultation and technical service activities such as free allocation, paid transfer, lease, renovation and reuse, and purchasing and selling on a commission basis to solve the waste caused by idle equipment of enterprises to the state and enterprises. Article 4 Doing a good job in the management of idle equipment adjustment and utilization is an important work content and responsibility of equipment management institutions and state-owned assets management departments at all levels. Fifth national idle equipment adjustment and utilization work by the the State Council production office in conjunction with the State Administration of State-owned Assets is responsible for the leadership and coordination. The State Council production office exercises the administrative and technical management functions of the national idle equipment adjustment and utilization work; The State Administration of State-owned Assets exercises the relevant management functions related to the evaluation and confirmation of the value of state-owned equipment and the change of asset property rights in the adjustment and utilization of idle equipment in the country. Sixth industries and local idle equipment adjustment and utilization work by the relevant departments of the State Council and local economic commissions at all levels (Planning Commission), the state-owned assets management department is responsible for the division of labor. The equipment management institutions of administrative departments at all levels shall be responsible for the management, business guidance, supervision and inspection of idle equipment adjustment and utilization of enterprises in their own industries and regions in accordance with the provisions of the State Council's Regulations on Equipment Management of Industrial Transportation Enterprises Owned by the Whole People and the principle of equipment classification management. Matters related to the change of property rights of state-owned equipment assets shall be the responsibility of the state-owned assets management department at the same level. Seventh industrial and commercial administration, price, taxation and auditing departments should strengthen the supervision and management of the transfer and utilization of idle equipment according to law. Article 8 The the State Council Production Office and the State Administration of State-owned Assets entrust the China Equipment Management Association to assist in organizing and coordinating the daily work of the national idle equipment adjustment and utilization management, carry out resource investigation, collection, summary and information release of idle equipment, organize technical appraisal, technical consultation and appraisal of idle equipment, and hold exhibitions and various forms of idle equipment adjustment activities at home and abroad. In accordance with the relevant provisions of the State Administration of State-owned Assets, evaluate the value of idle equipment and handle other matters authorized by the State Council Production Office and the State Administration of State-owned Assets.
The relevant departments of the State Council, the economic commissions of all provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning, the departments in charge of enterprises and the state-owned assets management departments at the same level may be assisted by the existing equipment management institutions or entrusted equipment management associations to organize, coordinate and handle the daily management of the adjustment and utilization of idle equipment in their respective regions and departments. Article 9 According to the business needs, an application can be made for the establishment of a consulting service institution specializing in the adjustment of idle equipment in central cities (including the idle equipment adjustment market, the same below). Tenth idle equipment swap consulting services must be strictly controlled. The establishment of local idle equipment adjustment consulting service institutions needs to be declared by the administrative department, approved by the provincial, autonomous region, municipality directly under the central government, municipal economic commission (Planning Commission) and the state-owned assets management department, applied to the local administrative department for industry and commerce for registration, and can only start business after approval. The establishment of cross-regional and industry-wide idle equipment swap consulting service institutions must be reported to the State Council Production Office and the State Administration of State-owned Assets by the competent industry department of the State Council for examination and approval, and apply for registration with the State Administration for Industry and Commerce, and can only be started after approval. Eleventh enterprises idle equipment adjustment and utilization, must strictly implement these measures and the relevant provisions of the state on equipment management, state-owned assets management, collective enterprises, private enterprises and individual industrial and commercial households are prohibited from operating idle equipment adjustment business. Twelfth enterprises should strengthen the management of idle equipment and actively take measures to adjust and deal with idle equipment. The equipment management department of the enterprise is responsible for the technical management of idle equipment, keeping the equipment sealed and preventing the equipment from being lost, rusted and damaged during disassembly; The financial department of the enterprise is responsible for the financial supervision and management of idle equipment. Thirteenth do a good job in idle equipment statistics, establish idle equipment statistics reporting system. Fourteenth idle equipment adjustment and utilization, must be in accordance with the principle of equipment classification management, according to their authority, strictly fulfill the examination and approval procedures.
(a) the equipment under the jurisdiction of the superior competent department, the enterprise must be in accordance with the relevant provisions of the superior competent department, after identification, review, declaration and approval before adjustment.
(two) the idle equipment within the jurisdiction of the enterprise must establish strict examination and approval procedures and complete supervision and management systems within the enterprise according to the requirements of these measures. The adjusted equipment shall be reported to the superior equipment management department and the tax and state-owned assets management department for the record, and shall be subject to the supervision and inspection of the superior equipment management, finance, taxation, state-owned assets management and auditing departments.
