In order to further strengthen the basic situation of bidding websites in this region, Yunnan Tendering Network has formulated the Management Measures for Survey and Bidding of Construction and Municipal Engineering in Yunnan Province in combination with the management situation of bidding personnel in this region. Article 32 The tenderer and the winning bidder shall, within 30 days from the date of issuance of the bid-winning notice, sign a survey entrustment contract in accordance with the requirements of the People's Republic of China (PRC) Contract Law and the relevant provisions on the management of engineering survey contracts, and in accordance with the contents of the tender documents and the bid documents of the winning bidder, and perform all the contents stipulated in the contract. The survey fee can fluctuate by 20% within the charging standard stipulated by the state. The tenderer shall not issue the bid-winning notice on the condition of reducing the survey fee, increasing the workload and shortening the design cycle, nor shall he conclude other agreements with the winning bidder that deviate from the substantive contents of the contract. If the tenderer violates the above provisions, the effectiveness of the contract signed by him shall be implemented in accordance with the relevant provisions of the People's Republic of China (PRC) Contract Law, and the competent construction department shall handle it in accordance with the provisions of Article 42 of the Regulations on the Administration of Survey and Design of Construction Projects in Yunnan Province.
Article 33 A tenderer shall protect the intellectual property rights of bidders. Without the written consent of the bidder, the tenderee shall not transfer the delivered survey plan to a third party or use it for other construction projects beyond the scope of this tender.
Thirty-fourth construction departments at all levels should strengthen the integrity management of construction units, bidding agencies, survey units and employees. Record all kinds of dishonest behaviors and illegal behaviors in survey and bidding activities, and establish integrity files.
Thirty-fifth government departments at all levels shall not interfere with the normal bidding activities, and shall not refuse to bid the winning bid according to the prescribed procedures. In the management stage of project preliminary design approval, construction drawing review and filing, and other provinces coming to Yunnan to survey and design units for filing, the construction administrative departments at all levels should check the bidding situation of the project, and if the project that must be tendered is not tendered or not tendered in accordance with the provisions of these measures, it should be ordered to make corrections according to law.
In the tendering and bidding activities of engineering survey, those who violate the Bidding Law of People's Republic of China (PRC), the Measures for Bidding and Bidding of Engineering Construction Project Survey and Design, the Regulations on the Administration of Survey and Design of Construction Project in Yunnan Province and these Measures shall be dealt with by the competent construction department according to law.
