Article 2 (Meaning of Terms)
The term "municipal solid waste" as mentioned in these Measures refers to the waste generated by units and individuals in this Municipality in their daily life or in the activities of providing services for their daily life, excluding construction waste, industrial waste and medical waste.
The term "municipal solid waste disposal fee" as mentioned in these Measures refers to the collection, transportation and disposal fees generated by transporting domestic waste from the garbage dropping point to the garbage disposal site for harmless treatment. Article 3 (Scope of Application)
Units and individuals that produce domestic garbage within the five urban areas of Jinjiang, Qingyang, Jinniu, Wuhou and Chenghua (including high-tech zones, hereinafter referred to as the five urban areas) shall pay garbage disposal fees.
Urban households enjoying the minimum living allowance for urban residents are exempt from garbage disposal fees. Article 4 (Formulation of Standards)
The standard of garbage disposal fee in this Municipality shall be formulated by the municipal price administrative department.
The municipal price department shall hold a hearing when formulating or adjusting the charging standard for garbage disposal fees. Article 5 (Management Responsibilities)
The municipal administrative department of city appearance and environment is responsible for the collection and management of garbage disposal fees. Municipal price, finance, taxation, civil affairs, urban management administrative law enforcement and other departments and relevant departments of Wucheng District shall carry out their duties and coordinate in the collection and management of garbage disposal fees. Article 6 (Chargers)
Garbage disposal fees of urban residents (including temporary residents), state organs, institutions, social organizations, production and business units, self-employed households, hospitals, schools, military units and other units shall be collected by the municipal administrative department of city appearance and environment. The garbage disposal fee of the self-supporting and self-transporting unit shall be collected by the municipal administrative department of city appearance and environment. Article 7 (Method of Charging)
Garbage disposal fees are charged according to the principle of combining quantity fees with fixed fees, and the specific charging methods are as follows:
(a) urban residents (including temporary population) to households as a unit of fixed monthly fees;
(2) State organs, institutions and social organizations charge fixed fees per person;
(3) Production and business units, self-employed households, hospitals, schools, military units, etc. Charge according to the amount of domestic waste generated. If it is difficult for production and business units and self-employed households to charge by volume, they can charge by measuring the business area.
(4) Self-collecting and self-transporting units are charged according to the amount of garbage entering the site. According to items (2) and (3), the garbage disposal fee can be charged monthly or quarterly, or once a year. Article 8 (Charging Base)
According to the unit volume, the annual domestic waste treatment amount is approved based on the annual domestic waste production amount; State organs, institutions and social organizations with fixed income shall, on the basis of the number of registered employees in the previous year, determine the amount of fees charged in the current year. The base of garbage disposal fee is approved by the city appearance and environmental management department of Wucheng District.
Newly established units that charge by volume may refer to units of the same industry and scale to verify the amount of charges; Newly established state organs, institutions and social organizations with a fixed per capita income shall verify the amount of fees according to the actual number of registered people in that year.
The approved fee base or fee amount shall be notified to the payer in writing by the city appearance and environmental management department of the five districts. Article 9 (Charging Voucher and Application Method)
Units that collect garbage disposal fees must hold a license issued by the municipal price administrative department; The toll collectors shall wear the toll work permit made by the municipal city appearance and environmental management department, and issue a special invoice uniformly printed by the municipal local tax department. Otherwise, the parties have the right to refuse to pay and report.
The license fee shall be applied by the municipal administrative department of city appearance and environment to the municipal administrative department of price. The municipal administrative department of city appearance and environmental sanitation shall apply for the original license for charging, and the entrusted charging unit shall apply for a copy of the license for charging.
The special invoice for garbage disposal fee and the work permit for charging shall be handled or collected by the entrusted charging unit and department with the entrustment contract to the municipal administrative department of city appearance and environmental sanitation. Article 10 (Financial System)
Garbage disposal fees should be strictly managed by two lines of revenue and expenditure, and stored in special accounts, which should be earmarked to pay for the collection, transportation and disposal fees of municipal solid waste, and no unit or individual may intercept or misappropriate them.
The financial revenue and expenditure management of garbage disposal fees shall be subject to the supervision and inspection of the competent departments such as auditing, price, finance and taxation. Article 11 (Toll Collection Agency)
The municipal and district administrative departments of city appearance and environment shall have corresponding working institutions to be responsible for the collection of garbage disposal fees, ensure that the garbage disposal fees are collected in full and on time, and prevent repeated charges and arbitrary charges. Article 12 (liability for non-payment)
In violation of the provisions of these measures, do not pay or resort to deceit to pay less garbage disposal fees, the municipal administrative department of city appearance and environment shall order it to pay within a time limit; Fails to pay within the time limit, since the date of overdue, an overdue fine of 5‰ will be charged on a daily basis, and the urban management administrative law enforcement department may impose a fine of more than 1 1,000 yuan on individuals and a fine of less than 200 yuan on units.
