Article 39 prohibits bidders from colluding with each other to bid. In any of the following cases, the bidders are colluding with each other to submit bids:
(1) bidders negotiate among themselves on the bidding price and other substantive contents of the bidding documents;
(2) bidders agree among themselves on the winner;
(3) bidders agree among themselves that some of the bidders give up their bids or win the bid;
(4) bidders who are members of the same group, association, or chamber of commerce are not permitted to submit bids in accordance with the rules and regulations of the organization. (e) Bidders who are members of the same organization make a joint bid in accordance with the requirements of the organization;
(v) Other joint actions between bidders in order to seek to win the bid or to exclude particular bidders.
Article 40 Bidders are deemed to have colluded with each other in bidding if any of the following circumstances applies:
(1) the bidding documents of different bidders are prepared by the same organization or individual;
(2) different bidders entrust the same organization or individual with the handling of the bidding;
(3) different bidders' bidding documents contain the same member of the project management;
(d) The bidding documents of different bidders are abnormally consistent or the bidding prices are regularly different;
(e) The bidding documents of different bidders are mixed with each other;
(f) The bidding deposits of different bidders are transferred from the accounts of the same unit or individual.
Article 41 prohibits the bidder and the bidder from colluding in bidding. In any of the following cases, the bidder and the bidder collude in bidding:
(1) the bidder opens the bidding documents before the opening of the bidding and leaks the relevant information to other bidders;
(2) the bidder directly or indirectly leaks the information on the bidding price and members of the bid appraisal committee to the bidders;
(3) the bidder explicitly or implicitly lowers or increases the bidding price;
(4) the bidder is prohibited from bidding on the basis of the bidding price of the project. offer;
(d) the bidder authorizes the bidder to withdraw or modify the bidding documents;
(e) the bidder expressly or impliedly facilitates the bidder to win the bidding for the particular bidder;
(f) other acts of collusion between the bidder and the bidders for the purpose of seeking to win the bidding for the particular bidder.
Article 67 Bidders bidding in collusion with each other or with the bidder, the bidder to the bidder or the bid evaluation committee members to bribe to win the bid, the winning bid is invalid; constitutes a crime, shall be investigated for criminal responsibility;
