Sichuan Province Interim Measures for the Management of Remote Off-site Bid Evaluation
The first article is to deepen the systematic management of outstanding issues in the field of project bidding, ensure that remote off-site bid evaluation activities are carried out in a unified, standardized and orderly manner, and further optimize The business environment in the bidding market is based on the "Tendering and Bidding Law of the People's Republic of China", "Regulations on the Implementation of the Tendering and Bidding Law of the People's Republic of China", "Electronic Bidding and Bidding Measures", "Sichuan Provincial Bidding Evaluation Experts and Comprehensive Bidding Evaluation" The Measures for the Management of Expert Database and other laws, regulations, rules and normative documents are formulated based on actual conditions.
Article 2 The term “remote off-site bid evaluation” as mentioned in these Measures refers to the use of electronic bidding systems and remote off-site bid evaluation and scheduling management systems to establish bid evaluation committees in accordance with the law to carry out evaluation of engineering construction projects across cities (states). target activities.
Article 3 These Measures shall apply to remote off-site bid evaluation activities for engineering construction projects within the administrative region of our province that require bidding according to law.
If remote bid evaluation is carried out across provinces, the relevant provisions of these Measures may be followed.
Article 4 Administrative supervision departments such as development and reform, natural resources, housing and urban-rural construction, transportation, water conservancy, agriculture and rural areas, radio and television, and energy shall supervise and manage remote off-site bid evaluation activities in accordance with the division of responsibilities.
Article 5 The provincial government government services and public resource trading service center are responsible for the construction, operation and maintenance of the remote remote bid evaluation and dispatch management system.
Public resource trading service centers at all levels should be equipped with venues, software and hardware facilities and network environments that meet the requirements for remote off-site bid evaluation in accordance with regulations to ensure that remote off-site bid evaluation activities can be carried out under safe and confidential conditions conduct. The remote off-site bid evaluation machine locations will be determined as required and will be uniformly dispatched by the Provincial Government Affairs Service and the Public Resource Trading Service Center. Accelerate the improvement of online supervision functions and provide technical support for administrative supervision departments to carry out remote off-site bid evaluation and supervision in accordance with the law.
Article 6 For projects that require full-process electronic bidding according to law and do not use separation of assessment methods to determine winning bidders, if one of the following conditions is met, remote remote bid evaluation shall be used:
(1) Projects with total investment or bundled bidding projects with a total investment of less than 30 million yuan (excluding 30 million yuan) must be bid according to law;
(2) Due to special professions and complex technical requirements , there are special bid evaluation requirements, and relevant professional bid evaluation experts cannot be selected in the specified area;
(3) Relevant professional bid evaluation experts cannot be selected in the specified area within one hour from the start of the selection of bid evaluation experts. of.
For projects other than those specified in the preceding paragraph, the municipal (state) development and reform department and the public resource trading service center may consult with the relevant industry authorities to determine the scope of local remote off-site bid evaluation projects.
Article 7 For projects that comply with the provisions of Article 6 of these Measures, remote off-site bid evaluation may not be used if one of the following circumstances occurs:
(1) There are more than 20 bidding companies
(2) The secondary site cannot be determined through the remote remote bid evaluation and dispatch management system.
Article 8 For projects that carry out remote off-site bid evaluation, the venue reservation shall be made online according to the affiliation with the provincial, municipal (state) public resource trading service center (including branch centers) according to the procedures.
Article 9 The remote remote bid evaluation venue is divided into main venue and auxiliary venue.
The bid evaluation site at the public resource trading venue where the project bid is opened is the main site, and other bid evaluation sites are auxiliary sites. All bid evaluation activities can be conducted in the off-site.
After the project bid opening, the auxiliary sites will be randomly determined through the remote remote bid evaluation and dispatch management system. There will be no more than two auxiliary sites.
Article 10 For remote off-site bid evaluation projects, main field and auxiliary field experts will be uniformly selected at the Sichuan Province Comprehensive Bid Evaluation Expert Database Selection Terminal at the project bid opening location.
The number of expert members of the home bid evaluation committee shall not exceed one-half of the number of expert members of the bid evaluation committee.
Article 11 The remote off-site bid evaluation master and the deputy bidder *** Resource Trading Service Center are respectively responsible for on-site management services such as identity verification and sign-in of the bid evaluation committee members, and the unified custody of their communication tools , guide members of the bid evaluation committee to the remote off-site bid evaluation room and provide necessary technical assistance.
Article 12 The bid evaluation committee for remote remote bid evaluation projects shall set up a person in charge according to regulations, and the person in charge shall have equal voting rights with other members of the bid evaluation committee.
When the members of the bid evaluation committee of the main venue and the auxiliary venue have different opinions on the objective evaluation matters of the bidding documents, the person in charge of the bid evaluation committee will organize the members of the bid evaluation committee to conduct online consultation and discussion. If consensus cannot be reached, voting will be conducted through the electronically assisted bid evaluation system. Members of the bid evaluation committee who have objections to the bid evaluation conclusion may state their different opinions and reasons in writing. If a member of the bid evaluation committee refuses to sign the bid evaluation report and does not state his or her different opinions and reasons, he or she shall be deemed to agree with the bid evaluation conclusion. The bid evaluation committee shall make a written explanation and keep it on record.
Article 13 If the main or auxiliary bid evaluation activities cannot be carried out due to power outages and network, system, equipment, etc. failures, the tenderer shall obtain resource trading services from the project supervision department and the public security department. With the approval of the Center, the bid evaluation venue can be changed and the corresponding bid evaluation committee members can be replaced. If it is expected that the bid evaluation cannot be resumed and completed on the same day, the bid evaluation time, bid evaluation venue and bid evaluation committee members shall be determined separately.
If the bid evaluation experts need to be replaced due to the circumstances specified in the preceding paragraph, they shall be supplemented or re-selected in accordance with the relevant provisions of the "Sichuan Province Bid Evaluation Experts and Comprehensive Bid Evaluation Expert Database Management Measures". The evaluation conclusion made by the replaced bid evaluation committee member is invalid, and the evaluation will be re-evaluated by the replaced bid evaluation committee member.
The replaced members of the bid evaluation committee shall strictly abide by the confidentiality requirements and shall not disclose the bid documents, evaluation status and other situations related to the bid evaluation. The corresponding bid evaluation fees shall be paid in accordance with regulations.
Article 14 Members of the bid evaluation committee may leave the venue only after forming the bid evaluation report, completing the electronic signature of the bid evaluation materials, and confirming it with the person in charge of the bid evaluation committee.
Article 15 If remote off-site bid evaluation requires review of the bid evaluation results, the review shall be conducted at the original primary and secondary sites.
Article 16 After the remote remote bid evaluation activity is over, the deputy farm *** resource trading service center shall promptly send the electronic data of the bid evaluation project and the audio and video backup of the bid evaluation to the main venue *** The resource trading service center keeps it unified. The main venue's resource trading service center shall centrally and properly keep the main and auxiliary venue's bid evaluation materials in accordance with the relevant provisions on file management.
If the tenderer needs to retrieve remote off-site bid evaluation archives, the host company's resource trading service center should cooperate and provide them.
Article 17 The Provincial Government Services and Public Resources Trading Service Center shall establish an online payment system for bid evaluation fees. The bid evaluation fees for remote off-site bid evaluation shall be paid by the bidder or its entrusted bidding agency through the online payment system in accordance with the prescribed standards.
Article 18 The provincial government government services and the public *** resource trading service center should establish a remote remote bid evaluation emergency management system, and the public *** resource trading service centers at all levels shall formulate emergency response plans accordingly. , to ensure rapid response when emergencies occur and to ensure that bid evaluation activities are carried out in an orderly manner.
Article 19 The number of days the remote off-site bidding evaluation machine of the municipal (state) public *** resource trading service center is actually open during the year shall be included in the annual assessment of the provincial government government services and the public *** resource trading service center.
Article 20 These Measures will come into effect on July 1, 2022 and will be valid for two years.
