The term "elevator" as mentioned in these Measures refers to the elevators determined in accordance with the special equipment catalog stipulated by the state, including passenger elevators, freight elevators, escalators and moving walkways, etc. Article 3 Elevator safety management shall adhere to the principles of safety first, prevention first, clear rights and responsibilities, comprehensive management, convenience and efficiency. Article 4 The municipal and county (district) people's governments shall strengthen the leadership of elevator safety management, ensure the funds for elevator safety supervision and management, urge market supervision and management and other relevant departments to perform their elevator safety supervision and management responsibilities in accordance with the law, and promptly coordinate and resolve problems in elevator safety supervision and management. major issues.
Township people’s governments and sub-district offices should assist in the work related to elevator safety supervision and management.
The management agencies of development zones (parks) and tourist resorts shall do a good job in the supervision and management of elevator safety in their areas in accordance with the responsibilities prescribed by the Municipal People's Government. Article 5: The market supervision and management department is responsible for the supervision and management of elevator safety within its own administrative region.
The housing and urban-rural development department is responsible for supervising and managing the quality and standards of civil engineering projects such as elevator shafts, machine rooms, and pits in projects under construction.
The property administration department is responsible for strengthening guidance and supervision on the performance of daily safety operation management responsibilities of elevators by property service enterprises within their respective administrative regions in accordance with the law.
Departments of finance, development and reform, education, public security, transportation, commerce, industry and information technology, natural resources and planning, culture, radio, television and tourism, health, emergency management, communications industry management, fire rescue and other departments and units should do a good job in elevator safety supervision and management in accordance with their respective responsibilities. Article 6 Market supervision and management and other departments shall strengthen the publicity and education of elevator safety knowledge and enhance the public's elevator safety awareness and self-protection ability.
Schools, kindergartens and other educational institutions should incorporate elevator safety knowledge into safety education content, popularize elevator safety knowledge, and enhance students' and children's awareness of safe and civilized use of elevators.
News media should carry out public welfare publicity on elevator safety laws, regulations and related knowledge. Article 7 encourages the use of new technologies and methods such as big data and the Internet of Things to promote the intelligent and information-based development of elevator use, maintenance, inspection, detection, emergency response and supervision and management, improve the level of elevator safety management, and strengthen the prevention of accidents and Emergency rescue capabilities. Article 8 Encourage elevator production, use, maintenance and other units to purchase elevator safety liability insurance to improve the ability to pay compensation for elevator accidents. Article 9 The Elevator Industry Association shall strengthen industry self-discipline, organize and carry out elevator safety training and consulting services, participate in elevator emergency mutual aid and rescue activities, and improve industry service and safety management levels. Chapter 2 Construction and Installation Article 10 The construction project design unit shall reasonably design elevator shafts, machine rooms, pits and other building structures based on the building's use functions and in accordance with relevant regulations and standards, and provide opinions on the elevator configuration quantity and parameter performance.
The construction drawing review agency shall review the hoistway, machine room, pit and other building structures as well as the elevator selection and configuration in accordance with relevant regulations and standards. Article 11 The construction unit shall, in accordance with the specific regulations on elevator selection and configuration and the opinions of the construction project design unit, make purchases that are compatible with the building structure and use needs, comply with relevant national and provincial standards, and meet the requirements of emergency rescue, fire protection, barrier-free access, Elevators for traffic flow and other requirements.
Before the elevator is delivered for use, mobile communication signal coverage in the elevator car and shaft should be completed. Article 12 The construction unit installing elevators shall comply with the production safety requirements at the construction site and adopt on-site safety protection measures.
The construction unit shall organize the acceptance of the quality of the elevator installation project in accordance with the relevant national standards for the construction quality acceptance of elevator projects. Article 13 For civil construction projects such as elevator shafts, machine rooms, and pits, the anti-leakage warranty period shall not be less than five years, starting from the date when the project is completed and accepted.
Article 14 If a construction project supported by government financial funds is equipped with an elevator, an air conditioner shall be installed in the elevator machine room. Social investment construction projects are encouraged to install air conditioners in elevator machine rooms. Article 15 When purchasing and installing elevators for affordable housing, government-invested rural housing improvement projects, and other construction projects supported by government financial funds, the relevant departments shall, together with the market supervision and management department, conduct inspections on the elevator's safety performance, technical support, failure rate, After-sales service and credit evaluation will be evaluated and demonstrated to ensure that the elevator meets national safety standards. Chapter 3 Usage Management Article 16 The elevator user unit shall be determined in accordance with the following regulations:
(1) If the newly installed elevator has not been handed over to the owner, the project construction unit shall be the user unit;
( 2) The elevator belongs to one owner, and the owner is the user;
(3) If the elevator belongs to multiple owners and some of them manage it by themselves, the owners shall pass a written agreement Determine the user unit;
(4) If the right to use a place containing an elevator is rented, loaned or otherwise transferred, it may be agreed that the user shall be the user unit; if there is no agreement, the elevator owner shall be the user unit;
(5) If a property service enterprise or other manager is entrusted to manage the property, the trustee shall be the user unit.
If the elevator user unit cannot be determined, the township people's government and sub-district office where the elevator is located should urge the owner to determine the user unit, or designate the user unit.
