The scope of application of the License Rules for Production and Filling Units of Special Equipment refers to the license for the design, manufacture, installation, modification, repair and filling units of special equipment used in People's Republic of China (PRC).
The licensing subjects of the Rules for Licensing Special Equipment Production and Filling Units include the departments that license special equipment production and filling units, namely, the State Administration of Market Supervision and the departments responsible for the safety supervision and management of special equipment of the provincial people's government (hereinafter referred to as the State Administration of Market Supervision and the departments responsible for the safety supervision and management of special equipment of the provincial people's government hereinafter referred to as the provincial special equipment safety supervision department, the General Administration of Market Supervision and the provincial special equipment safety supervision department hereinafter collectively referred to as the issuing authority).
Article 16 of the Law of the People's Republic of China on Safety of Special Equipment, if new materials, new technologies and new processes are adopted for special equipment, which do not meet the requirements of safety technical specifications, or the safety technical specifications do not require them, which may have a significant impact on safety performance, it shall report to the safety supervision and administration department of special equipment in the State Council, and the safety supervision and administration department of special equipment in the State Council shall promptly entrust a safety technical consulting institution or relevant professional organizations to conduct technical review, and the review results shall be approved by the safety supervision and administration department of special equipment in the State Council.
The State Council special equipment safety supervision and management department shall promptly incorporate the relevant technical requirements of new materials, new technologies and new processes that are allowed to be used into the safety technical specifications.
Article 18 The State shall, according to the principle of classified supervision and management, implement a licensing system for the production of special equipment. The production unit of special equipment shall meet the following conditions, and may engage in production activities only after being approved by the department in charge of safety supervision and management of special equipment:
(1) Having professional and technical personnel suitable for production;
(2) Having equipment, facilities and workplaces suitable for production;
(three) a sound quality assurance, safety management and post responsibility system.
