Chapter I General Provisions Article 1 In order to strengthen the management of domestic waste, improve the urban and rural habitat, protect public health, promote the construction of ecological civilization, and promote sustainable economic and social development, according to the "Chinese People's Republic of China *** and the State Solid Waste Pollution Prevention and Control Law," "the Chinese People's Republic of China *** and the State Circular Economy Promotion Law" and the State Council "Urban Amenities and Environmental Hygiene Management Regulations" and other laws and administrative regulations. Combined with the actual situation in this province, the formulation of these regulations. Article 2 These regulations shall apply to the management of domestic garbage in the administrative area of this province. Article III of this province to implement the classification system of domestic garbage. Living garbage in accordance with national standards are divided into: recyclables, hazardous waste, food waste and other waste. Municipal people's governments in the districts should be combined with the actual local specific classification catalog or refinement of the classification categories. Article 4 The management of domestic waste shall follow the principles of government promotion, universal participation, urban and rural integration, local management, local conditions, simplicity and ease of implementation, to achieve the reduction of domestic waste at the source, the whole process of classification, resource utilization, harmless treatment. Article 5 The people's governments at or above the county level shall incorporate the management of domestic garbage in the administrative area into the national economic and social development planning and ecological environmental protection planning at this level, establish a coordination mechanism for the classification of domestic garbage, and strengthen and coordinate the management of the classification of domestic garbage capacity-building, and the required funds are included in the budget of this level.

Township (township) people's governments, street offices are responsible for the management of domestic garbage within the jurisdiction of the specific work, the village (neighborhood) committees to assist in carrying out the reduction of domestic garbage at the source, the classification of management work. Article 6 The competent department of housing and urban-rural construction of the provincial people's government is responsible for organizing, coordinating, guiding and supervising the management of domestic garbage in the province.

Cities and counties (cities and districts) with districts are responsible for organizing and implementing the management of domestic waste by the departments determined by the people's governments at their respective levels (hereinafter referred to as the domestic waste management departments).

The competent ecological environment department is responsible for the supervision and management of pollution prevention and control during the transportation and treatment of hazardous waste, as well as pollution prevention and control of domestic waste treatment enterprises.

Departments of the people's governments at or above the county level, such as agriculture and rural areas, development and reform, finance, natural resources, commerce, education, culture and tourism, health, market supervision and management, industry and information technology, organ affairs management, transportation, science and technology, as well as postal administrations, shall, in accordance with their respective responsibilities, do a good job of work related to the management of household waste. Article 7 The whole society shall respect the environmental sanitation staff and the fruits of their labor.

The people's governments at or above the county level and the relevant departments shall ensure that environmental sanitation staff labor compensation and welfare benefits, improve their working conditions, and safeguard their legitimate rights and interests.

Cities and counties (cities and districts) people's governments shall organize, guide and do a good job of environmental sanitation staff health care and skills training, to ensure operational safety. Article 8 advocate the whole society to practice low-carbon green lifestyle, and develop the habit of domestic waste classification. Units, families and individuals who produce domestic waste shall fulfill the obligation to reduce the amount of domestic waste at the source and classify and put it in according to law, and bear the responsibility of the producers of domestic waste.

Living garbage producers shall pay the living garbage disposal fee. Domestic garbage disposal fee charges by the people's governments at or above the county level in accordance with the relevant provisions of the state to formulate separately. Article 9 The people's governments at or above the county level shall promote the classification of domestic garbage placement, collection, transportation, treatment of carbon emission reduction, and promote the high-quality development of low-carbon economy. Article 10 Encourage and support the research and development and scientific and technological innovation of new technologies, new processes, new materials and new equipment in the reduction, resource utilization and harmlessness of domestic garbage. Article 11 The people's governments at all levels and the relevant departments shall strengthen the publicity and guidance on the reduction of domestic waste at source, the whole process of classification, resource utilization and harmless treatment, popularize the knowledge of domestic waste reduction and classification, and promote the typical experience. Chapter II Planning and Construction Article 12 The competent departments of housing and urban-rural construction and development and reform of the provincial people's government shall, in accordance with the national special plan for domestic garbage, and in conjunction with the province's population, geography, and goals for the treatment of domestic garbage, prepare a special plan for domestic garbage at the provincial level, and make it public in accordance with the law.

The municipal people's government of the municipal living garbage management department shall, in conjunction with the relevant departments, in accordance with the provincial living garbage special planning, the preparation of the administrative area of living garbage special planning, and shall be announced to the community according to law.

Special planning for domestic garbage should be integrated with the layout of domestic garbage facilities, in line with the administrative region of the national economy and social development planning, territorial spatial planning, ecological environmental protection planning and other planning. Article XIII of the county (city, district) people's government, the domestic waste management department shall, in accordance with the higher domestic waste special planning, take hearings, seminars and other forms of listening to the views of the development of domestic waste disposal facilities, places, annual construction plans, and organization and implementation. Article XIV of the city, county (city, district) people's government shall be living garbage disposal facilities, places of annual construction plan required land into the annual land use plan, to ensure that the living garbage disposal facilities, places of construction land.

Cities and counties (cities and districts) people's governments in the districts of natural resources departments should be identified in the special planning of domestic garbage disposal facilities, places construction land, into the national land spatial planning, and according to the law to the community.

The land used for the construction of domestic waste disposal facilities and establishments determined by the national land spatial planning shall not be changed without legal procedures.
