Article 27
Workers with work-related injuries of grades five to ten who retain their labor relations shall enjoy the relevant treatment in accordance with the provisions of the Regulations on Work-Related Injury Insurance;
Work-related injuries shall continue to retain their work-related injury medical insurance treatment after they have enjoyed the basic old-age insurance treatment on a monthly basis.
If an injured worker of Grade 5 to Grade 10 has his labor relationship terminated or dissolved, the lump-sum medical benefit for the injury and the lump-sum employment benefit for the disability shall be calculated on the basis of the average monthly salary of the workers of the province in the previous year when the labor relationship is terminated or dissolved, according to the following standards:
Thirty months for Grade 5 disability, 25 months for Grade 6 disability, 10 months for Grade 7 disability, and Seven months for Grade Eight Disability, four months for Grade Nine Disability, and two months for Grade Ten Disability. However, if the employee is less than five years from the statutory retirement age, the one-time disability employment benefit is paid in accordance with the standard of twenty percent reduction for each additional week of age of the employee.
