Gansu Province Urban and Rural Planning Regulations (2018 Revision)

Chapter I General Provisions Article 1 In order to strengthen the management of urban and rural planning, coordinate the spatial layout of urban and rural areas, improve the human environment, and promote the comprehensive, coordinated and sustainable development of the urban and rural economy and society, these regulations are formulated in accordance with the "Law of the People's Republic of China on Urban and Rural Planning" and other relevant laws and administrative regulations, and in the light of the actual situation of this province. Article 2 In the administrative area of this province to formulate and implement urban and rural planning, construction activities within the planning area, the application of these regulations. Article 3 The urban and rural planning referred to in these regulations includes township system planning; master planning, detailed control planning, special planning for infrastructure and public ****service facilities, and detailed construction planning for cities, county towns and towns; township planning and village planning.

The planning area referred to in these regulations refers to the built-up areas of cities, county towns, towns and villages, as well as the areas where planning control is necessary due to the needs of urban and rural construction and development.

The county town, as referred to in this Ordinance, includes the town where the county government is located and the towns, townships and villages that have been closely related to the construction and development of the town.

The infrastructure and public ****service facilities referred to in this ordinance refer to the infrastructure network systems such as roads, rail transportation, water supply, drainage, heating, flood control, fire protection, electricity, telecommunications, gas, sanitation and other infrastructural systems and infrastructure such as transportation hubs, water sources and their protection zones, and sewage and garbage treatment of cities, county towns, towns, and other infrastructure facilities; education, medical and health care, culture and sports, commercial services, finance, post and telecommunications, public ****service facilities such as education, health care, culture and sports, commercial services, financial, postal and telecommunication services, community services and barrier-free facilities. Article 4 The general planning of cities, county towns and towns shall be subject to the urban system planning; the detailed control planning, infrastructure and public **** service facilities special planning shall be subject to the general planning of cities, county towns and towns; the detailed construction planning shall be subject to the detailed control planning, infrastructure and public **** service facilities special planning. Article 5 The competent department of urban and rural planning of the people's governments of provinces, cities and counties shall be responsible for the management of urban and rural planning in the administrative area.

The competent department of urban and rural planning of the people's government of an autonomous prefecture is responsible for the management of urban and rural planning in its administrative area, and is specifically responsible for the preparation and implementation of urban and rural planning in the city where the prefecture government is located.

Municipal districts with relatively independent urban functions are approved by the provincial people's government to be specifically responsible for the management of urban and rural planning in the region in accordance with the county's planning management responsibilities. Chapter II Planning Article 6 The preparation of urban and rural planning shall be based on the location of the city in the region, the nature of the city, the development goals and the carrying capacity of resources, urban and rural development and regional development, coordination of the relevant relationship, and the development and utilization of underground space to make provisions. Among them, the mandatory requirements for space control should be clearly labeled in the planning results and independent of the chapter.

The planning of the provincial capital city shall take into account the needs of the central government in Gan and the provincial units of land layout and spatial arrangement. The planning of county cities, towns and townships shall be based on the economic and social development of the counties, towns and townships where the people's governments are located, reflecting the regional characteristics and providing services for the surrounding rural life and production. Article 7 The provincial people's government to organize the preparation of provincial town system planning, reported to the State Council for approval; city and state people's governments to organize the preparation of town system planning in their administrative areas, reported to the provincial people's government for approval.

The people's governments of cities and counties organize the preparation of master plans for cities and county towns, and submit them to the people's governments of the next higher level for approval; the people's governments of towns organize the preparation of town master plans under the guidance of the competent departments of urban and rural planning of the people's governments of cities and counties, and submit them to the people's governments of the next higher level for approval.

Before preparing the master plan, the organizing unit shall entrust the relevant functional departments or relevant institutions to carry out thematic studies on the spatial development strategy, population and construction land scale, comprehensive transportation, resource and environmental carrying capacity and other major issues. The thematic study report shall be examined and agreed by the people's government at this level as the basis for the preparation of the plan. Article 8 The provincial town system planning and master planning of cities and counties shall be considered by the standing committee of the people's congress at its level before they are submitted for approval, and the deliberations of the members of the standing committee shall be referred to the people's government at its level for study and processing.

Town master plans shall be considered by the town people's congress before they are submitted for approval, and the deliberations of the delegates shall be referred to the people's government at this level for study and processing.

The organizing and preparing authorities of the plan shall submit for approval the provincial township system plan and the master plan of the city or county or the township master plan, and shall submit the deliberations of the members of the Standing Committee of the People's Congress at the present level or of the delegates of the township people's congress and the modification of the plan in the light of the deliberations. Article 9 The people's governments of townships and towns shall organize the preparation of township and village plans under the guidance of the competent departments for urban and rural planning of the people's governments of cities and counties, and submit them to the people's governments at the next higher level for approval. Village planning shall be discussed and agreed upon by the villagers' meeting or the meeting of villagers' representatives before being submitted for approval.

Township planning, village planning should be based on the local national economy and social development plan to determine the scale of construction and construction standards for infrastructure and public **** services. The people's governments of cities and counties shall formulate technical guidelines and drawings for the construction of agricultural buildings, and specifically determine the technical standards for the construction of agricultural buildings. Article 10 The department in charge of urban and rural planning of the people's governments of cities and counties shall organize the preparation of detailed control planning for cities and county towns according to the overall planning of the cities and county towns; the people's governments of towns shall, under the guidance of the department in charge of urban and rural planning of the people's governments of cities and counties, organize the preparation of detailed control planning for towns according to the overall planning of the towns; of which detailed control planning for newly planned land shall be prepared within two years after the approval of the overall planning. Preparation of detailed control planning for the old town shall be divided into planning and control plots in accordance with the principle of combining respect for land use rights and optimization of land layout.

The master plan has been determined by the mandatory content, as well as the main use of each plot and compatibility, building density, building height, floor area ratio, green space rate, infrastructure and public **** service facilities supporting the provisions of the detailed control plan shall be mandatory.
