According to the "Regulations for the Supervision and Administration of Medical Devices" (State Council Decree No. 276), Article 3 of the medical devices referred to in these regulations, refers to the instruments, equipment, apparatus, materials or other items used in the human body, either alone or in combination, including the software required; their use on the human body surface and in the body is not obtained by pharmacological, immunological or metabolic means, but may involve and play a supporting role by these means; and its use is intended to accomplish the following intended purposes.
1. Prevention, diagnosis, treatment, monitoring, and mitigation of disease.
2. Diagnosis, treatment, guardianship, mitigation, and compensation for injury or disability.
3. The study, substitution, and regulation of anatomical or physiological processes.
4. Pregnancy control.
The test tube is clearly not a medical device and is not required.
