In order to effectively prevent, timely control and eliminate the hazards of public health emergencies, safeguard public health and life safety, and maintain normal social order, according to the Emergency Response Law of People's Republic of China (PRC), the Emergency Regulations on Public Health Emergencies of the State Council and the Implementation Measures for the Emergency Regulations on Public Health Emergencies of Sichuan Province, combined with Chengdu and other laws and regulations, Article 2 (meaning of clauses)
The term "public health emergencies" as mentioned in these Measures refers to the sudden occurrence of major infectious diseases, mass unexplained diseases, major food and occupational poisoning and other events that seriously affect public health, and have caused or may cause serious damage to public health.
According to the National Emergency Plan for Public Health Emergencies, public health emergencies are divided into four levels: particularly serious, major, large and general. Article 3 (Scope of Application)
These Measures shall apply to the prevention, control and emergency treatment of public health emergencies within the administrative area of this Municipality. Article 4 (Working Principles)
The emergency work of public health emergencies should follow the principle of giving priority to prevention and being always ready, and implement the principles of unified leadership, graded responsibility, territorial management, legal development, timely response, decisive measures, relying on science and strengthening cooperation. Article 5 (Job Responsibilities)
City and district (city) county people's governments (including Chengdu Tianfu New District and Chengdu High-tech Zone Administrative Committee, the same below) shall set up emergency headquarters (hereinafter referred to as the headquarters) to be responsible for the handling of public health emergencies within their respective administrative areas. The municipal headquarters is composed of the commander-in-chief, deputy commander-in-chief and relevant member units. The headquarters is held by the leaders in charge of the Municipal People's Government, and the office of the municipal headquarters is located in the municipal public health administrative department.
The municipal and district (city) county health administrative department shall set up a health emergency office to undertake the daily work of the headquarters office.
The relevant departments of the municipal and district (city) county people's governments shall do a good job in emergency handling of public health emergencies within their respective responsibilities.
Town (township) people's government, street offices under the leadership of the headquarters, responsible for the prevention, control and emergency treatment of public health emergencies within their respective administrative areas, villagers' committees and residents' committees shall obey and cooperate. Article 6 (Emergency Reserve)
The municipal and district (city) county people's governments shall improve the emergency reserve system for public health emergencies, and urge the departments of development and reform, finance, medical and health care, emergency management, human society, civil affairs, etc. to reserve materials, equipment, facilities, technology and human resources related to public health emergencies. Article 7 (Publicity and Education)
Municipal and district (city) county people's governments and relevant departments carry out regular health education and publicity and education on the core knowledge of public health emergencies, so as to enhance the public's public health safety awareness and prevention ability. Article 8 (Personal Protection)
Health, agriculture, public security, transportation, urban management and other departments and relevant units shall purchase personal accident insurance for emergency personnel responding to public health emergencies, and provide necessary protective equipment and preventive measures; Necessary preventive measures such as health protection, vaccination and preventive medication should be provided for important departments and posts that are related to the normal operation of the city and may be affected by public health emergencies. Article 9 (Guarantee of Treatment)
The municipal and district (city) county people's governments shall improve the medical assistance system for public health emergencies, and ensure that people disabled by public health emergencies receive timely and effective treatment. Article 10 (Treatment of Personnel)
To participate in public health emergencies emergency training, drills and disposal of staff, the unit should ensure that their original post benefits remain unchanged; For those who work outside normal working hours, the unit where they work shall pay remuneration in accordance with relevant regulations; For the staff who are sick, disabled or sacrificed due to participating in emergency response, the unit where they work shall give corresponding subsidies and pensions. Article 11 (Care and Help)
No unit or individual may make things difficult for or discriminate against the staff, the wounded and the sick and their families in public health emergencies for any reason. District (city) county people's government, relevant departments and units shall give necessary help to the existing practical difficulties. Article 12 (Praise and Reward)
City and district (city) county people's governments and relevant departments shall commend and reward those who have made contributions to the emergency response of public health emergencies. Chapter II Prevention and Emergency Preparedness Article 13 (Plan Management)
The municipal and district (city) county people's governments shall, according to the emergency plan for public health emergencies of the people's governments at higher levels, formulate the emergency plan for public health emergencies at the corresponding level.
The relevant departments of the city and district (city) county shall, according to the emergency plan of the people's government at the same level, prepare the emergency plan of their own departments and systems and report it to the people's government at the same level for the record.
The following units shall formulate emergency plans:
(a) airports, stations and other transportation hub operating units;
(two) hotels, restaurants, shopping malls, hospitals, schools and other places where people gather;
(three) the production and processing units of health-related products such as food and medicine;
(4) Units that produce, process, sell, store, transport and use toxic and harmful substances such as chemicals;
(five) other units that need to formulate emergency plans as stipulated by laws, regulations and rules.
The emergency plan shall be revised and supplemented in a timely manner according to the changes and implementation of public health emergencies.
