The measures referred to in the emergency expropriation compensation, refers to the city, district people's government of citizens, legal persons or other organizations to implement the emergency expropriation of compensation according to law.
The compensation referred to in these measures refers to the citizens, legal persons or other organizations that have the right of ownership or usufruct of the expropriated materials and places. Article 4 The objects of emergency requisition include sites, facilities, equipment, transportation and other materials (hereinafter collectively referred to as requisitioned materials and places) that are urgently needed for responding to emergencies. Expropriation of the implementation of the unit by the municipal and district people's governments in accordance with the following provisions to be determined, but also according to the specific circumstances to be determined separately:
(a) the expropriation of food by the development and reform departments are responsible for the implementation of;
(b) the expropriation of energy by the department of development and reform, the economic and information technology sector or the business sector is responsible for the implementation of;
(c) medicines, Medical equipment and medical institutions, the requisition of sites, personnel, and materials is implemented by the health department, the market supervision department, or the medical security department;
(iv) the requisition of clothing, quilts, and other relief materials is implemented by the emergency management department;
(v) the requisition of transportation facilities and equipment and means of transportation is implemented by the transportation department;
(vi) The requisition of construction machinery by the urban and rural construction department or housing security housing management department is responsible for implementation;
(vii) the requisition of municipal engineering maintenance machinery by the urban law enforcement department is responsible for implementation;
(viii) the requisition of special equipment by the market supervision department is responsible for implementation;
(ix) the requisition of stadiums by the sports department is responsible for implementation;
(x) The expropriation of hotels and food, drinking water and other necessities of life shall be implemented by the department of commerce;
(xi) the expropriation of squares shall be implemented by the people's government of the region in which it is located;
(xii) the expropriation of other materials and places shall be implemented by the corresponding competent authorities. Article XIV expropriation implementation unit shall be sent to the citizens, legal persons or other organizations in accordance with the law, emergency expropriation decision. Emergency requisition decision shall be sealed and contain the following matters:
(1) the requisitioning unit, the requisitioning implementation unit and the citizens, legal persons or other organizations of the basic information;
(2) requisitioning based on the reasons and causes;
(3) the requisitioned materials, places, the name of the quantities, specifications, and the relevant technical security requirements;
(4) the requisitioned materials, premises;
(v) the duration of the expropriation;
(vi) the legal consequences of failure to fulfill the obligations stipulated in the emergency expropriation decision letter;
(vii) the channels of redress for dissatisfaction with the expropriation.
If the emergency expropriation decision cannot be served in advance because of the urgency of the situation, the unit implementing the expropriation may first give notice and make an emergency expropriation. The expropriation implementation unit shall within 48 hours after the emergency expropriation to complete the relevant procedures.
