Opinions on the Implementation of Certain Policies and Measures for the Development of the Western Region

Implementation of the strategy of development of the western region and acceleration of the development of the central and western regions is a major decision of the CPC Central Committee, which is forward-looking and takes a comprehensive view of the overall situation. . According to "the State Council on the implementation of a number of policies and measures to develop the west of the notice" (Guofa [2000] No. 33), the State Council Office of Western Development, in conjunction with the relevant departments, to further study and formulate the implementation of a number of policies and measures for the development of the west of the opinion.
One, the scope of application of policies and measures
(a) the implementation of a number of policies and measures for the development of the western region and the implementation of the views of the scope of application, including Chongqing Municipality, Sichuan Province, Guizhou Province, Yunnan Province, Tibet Autonomous Region, Shaanxi Province, Gansu Province, the Ningxia Hui Autonomous Region, Qinghai Province, the Xinjiang Uygur Autonomous Region (Xinjiang Production and Construction Corps listed separately) and the Inner Mongolia Autonomous Region, Guangxi Zhuang Autonomous Region (hereinafter collectively referred to as the Western Region). Other areas of national autonomous regions (Hunan Province, Xiangxi Tujia and Miao Autonomous Prefecture, Hubei Province, Enshi Tujia and Miao Autonomous Prefecture, Jilin Province, Yanbian Korean Autonomous Prefecture), in the actual work of the relevant policies and measures to be taken into account.
Two, increase the construction capital investment

(3) of the country's newly arranged major infrastructure projects in the western region, its investment is mainly by the central financial construction funds, other special construction funds, bank loans and the use of foreign capital and enterprises to solve the self-financing, leaving no funding gaps, the local government in the use of land, fee waivers and other aspects of active cooperation. To focus on the construction of a number of major projects related to the overall situation of the development of the west, such as the "West-East Gas Pipeline", "West-East Electricity Pipeline", the Qinghai-Tibet Railway, highways and national highways, the rational development of water resources and conservation of water resources, etc..
(4) The central government will take various ways to raise special funds for western development and support key projects in western development. Railway, transportation, water conservancy, agriculture, forestry, information industry and other departments in the arrangement of construction funds, to continue to increase the proportion of key projects in the western region.
Three, prioritize construction projects
(e) guided by scientific planning, play the role of both planning and market mechanisms in the allocation of resources, in the western region to prioritize the layout of a number of construction projects, including: water conservancy, highways, railroads, airports, pipelines, telecommunications, and other infrastructure construction, ecological environment, the characteristics of the development of agriculture, hydroelectricity, high-quality coal, oil, natural gas, Copper, aluminum, potassium, phosphorus and other advantageous energy, mineral resources development and utilization, urban infrastructure construction, characteristics of tourism development, characteristics of high-tech and military-to-civilian technology industrialization.
Four, increase financial transfers
(F) increase the western region, especially in ethnic areas (refers to ethnic autonomous regions, enjoy the same treatment of ethnic autonomous regions in the provinces and non-ethnic provinces of the national autonomous regions) general transfers. As the central government's financial resources increase, the central government will gradually increase the scale of general transfer payments to the western region. The general transfers are calculated on the basis of the difference between the standard fiscal revenues and expenditures of each region, and the standard revenues and expenditures are calculated on the basis of objective factors in accordance with the principles of science and reasonableness, using a uniform formula, without being influenced by subjective factors. In the distribution of general transfer funds, ethnic areas are given an appropriate preference. Starting from 2000, the central government arranged a portion of the financial resources to be used specifically for transfer payments to ethnic areas.
(VII) the central government to the local special fund subsidies to the western region tilt. Increase the development of agricultural science and technology in the western region, dry farming, water-saving agriculture, agro-ecological environment protection and construction, agricultural pest control and relief. Increase investment in comprehensive agricultural development in the western region, focusing on upgrading medium- and low-yield fields to improve basic agricultural production conditions and the ecological environment; vigorously develop high-quality, high-yield and high-efficiency agriculture and promote industrialized management; and selectively build modernized agricultural demonstration zones and science and technology demonstration zones. From 2001 onwards, according to the actual situation in the western region, the proportion of local supporting funds for comprehensive agricultural development will be appropriately adjusted downward, and the investment in land management will be increased. For provinces (autonomous regions and municipalities directly under the central government) with financial difficulties in the western region, the central financial authorities will provide appropriate subsidies for the increased expenditures arising from the implementation of the policy of raising the wages of employees of institutions and agencies and the incomes of low-income residents in cities and towns that was introduced in 1999, the amount of the subsidies to be determined on the basis of the number of employees and retired employees of the institutions and agencies of the various regions, the increase in the monthly per capita wages and retirement benefits, and the coefficient of subsidies for the transfer of payments. The central government subsidizes local state-owned enterprises to subsidize the basic living expenses of laid-off workers, the basic pensions of retired workers and the minimum living expenses of urban residents, with an appropriate bias towards the western region. Education, science and technology, health, politics and law, culture, cultural relics and other special funds allocation of subsidies, should also be tilted to the western region.
(viii) The central financial funds for poverty alleviation, focusing on the western poverty-stricken areas. V. Increase financial and credit support
(XII) to increase credit investment in infrastructure construction in the western region. Focus on supporting railroads, trunk highways, electricity, oil, natural gas and other large and medium-sized transportation, energy project construction. (xiv) increase agriculture, ecological construction of credit investment. Agricultural banks and rural credit unions should actively expand small loans to farmers, and issue credit loans to those who have the ability to repay loans. Support the development of power, natural gas, tourism and biological resources rational development and other industries in the western region, the loan amount of large key projects, can be resolved by the head office of the commercial bank direct loans, loans are not included in the local branch of the deposit and loan ratio or limit of the scope of the assessment. At the same time, the technological transformation of enterprises in the western region, high-tech enterprises and the development of small and medium-sized enterprises, but also to give credit support.
VI, vigorously improve the soft environment for investment
(p) conscientiously implement the reform of state-owned enterprises and the development of relevant policies to deepen the reform of state-owned enterprises in the western region, so that enterprises really become the main body of market competition. Accelerate the establishment of modern enterprise system, the implementation of system innovation. In addition to the national lifeblood and security of the enterprises held by the state, encourage other large and medium-sized state-owned enterprises through the standardization of listing, Sino-foreign joint ventures and mutual equity participation and other forms, in accordance with the law, restructured into a limited liability company or joint-stock limited company. Restructured enterprises should establish board of directors and supervisory boards in accordance with the law, and clearly define the respective responsibilities of the shareholders' meeting, board of directors, supervisory board and managerial level, so as to ensure that each one of them is responsible for its own duties, coordinates its operation, and exercises effective checks and balances. The establishment of a clear division of labor of state-owned assets management, operation and supervision system, so that the state-owned assets as soon as possible in place to strengthen the external supervision of the main business of state-owned assets. Further deepen the reform of the three systems of labor, personnel and distribution within the enterprise, and gradually form a new mechanism that enables operators to go up and down, personnel to come in and go out, and income to go up and down. Combined with the industrial restructuring, adhere to the principle of "advancement and retreat" and "do something, do not do something", and promote the strategic adjustment of the state-owned economic layout. Further liberalize and revitalize state-owned small and medium-sized enterprises, and actively promote the construction of the organization and management system, policy system and social service system for small and medium-sized enterprises. In the practical work to increase support for the western region of state-owned enterprises to turn around losses, restructuring and transformation.
(17) actively guide the western region of individual, private and other non-public economy to accelerate the development of the east and central enterprises and individuals to encourage investment in the western region. In addition to the special provisions of the law, all domestic enterprises of all kinds of ownership can enter the investment areas open to foreign businessmen. Encourage individual, private and other non-public economic entities to invest in a variety of ways, such as sole proprietorships, joint ventures, cooperation, concessions.
(xviii) simplify the approval process of investment projects. In addition to the overall situation of the national economy and long-term development, national security has an important impact on the major projects or projects with special provisions, enterprises use their own funds or domestic bank loans to invest in the national non-restricted industry projects, the need for the Government to balance the construction, business conditions, the competent government departments only approve their project proposals, enterprises in the implementation of the conditions for the construction of the construction of the independent decision on whether to start construction, and in the commencement of the project. After the implementation of the construction conditions, the enterprise will decide whether to start the construction on its own, and report to the competent government departments for the record.
(19) seriously comply with the implementation of the central government on the introduction of foreign investment in a series of policies, laws and regulations. Efforts to optimize the regional layout of foreign investment, encourage foreign investment in the western region. Reasonably simplify the approval procedures for foreign investment projects. In addition to major projects or projects with special provisions, foreign-invested projects using their own funds and commercial bank loans to invest in the western region in the national encouragement of industries and advantageous industries, the competent government departments will only approve the feasibility study report of the project, the project proposal, the commencement of the report will no longer be submitted to the competent government departments for approval. Gradually simplify the approval procedures for foreign-invested enterprise contracts, statutes.
(xx) further change the functions of the government, in improving the soft environment for investment, rectify the market economic order, the effective protection of intellectual property rights, the maintenance of economic and legal system. The implementation of the separation of government and enterprises, reduce the number of approvals, standardize procedures, clean up and abolition of rules and regulations that do not meet the requirements of the development of a socialist market economy and open to the outside world. Matters that do need to be examined and approved by the government at all levels should be implemented with convenient services, and efficiency and transparency should be improved. Strengthen the construction of arbitration mechanism, timely handling of economic disputes, to protect the legitimate rights and interests of investors.
VII, the implementation of tax incentives
(21) of the western region of the state to encourage the category of domestic-funded enterprises and foreign-invested enterprises, in the period from 2001 to 2010, a reduction of 15% of the tax rate of enterprise income tax. Domestic-funded enterprises in the State-encouraged category are those whose main business is the industrial projects specified in the Catalogue of Industries, Products and Technologies Currently Encouraged by the State (Revised in 2000), and whose income from main business accounts for more than 70% of the total income of the enterprise. State-encouraged foreign-invested enterprises refer to enterprises whose main business is based on the encouraged projects in the Catalogue for the Guidance of Industries for Foreign Investment and the industrial projects stipulated in the Catalogue of Industries with Advantages for Foreign Investment in the Central and Western Regions, and whose income from main business accounts for more than 70% of the total income of the enterprise. With the approval of the provincial people's government, domestic-funded enterprises in the national autonomous areas can be reduced or exempted from enterprise income tax on a regular basis, and foreign-invested enterprises can be reduced or exempted from local income tax. The approval authority and procedure for the reduction or exemption of income tax of central enterprises shall be executed in accordance with the current relevant regulations.
(22) in the western region of the new transportation, electric power, water conservancy, postal, radio and television enterprises, to give preferential policies to reduce or waive enterprise income tax. Among them: domestic-funded enterprises from the date of production and operation, the first year to the second year of exemption from enterprise income tax, the third year to the fifth year of half the enterprise income tax. If a foreign-invested enterprise operates for more than 10 years, it shall be exempted from enterprise income tax from the first to the second year, and shall be subject to a 50% reduction of enterprise income tax from the third to the fifth year from the year of profit-making. Transportation enterprises referred to in this article are enterprises investing in new enterprises engaged in the operation of highways, railroads, aviation, ports, terminals and pipeline transportation; electric power enterprises are enterprises investing in new enterprises engaged in the operation of electric power; water conservancy enterprises are enterprises investing in new enterprises engaged in the comprehensive management of rivers and lakes, flood prevention and removal, irrigation, water supply, water resources protection, hydropower generation, water and soil conservation, river dredging, river and sea dyke construction and other development of water conservancy and prevention of water hazards; postal enterprises are enterprises investing in new enterprises engaged in the development of water conservation and prevention of water hazards. Postal enterprises are enterprises investing in new postal operations; radio and television enterprises are enterprises investing in new radio and television operations. Unless otherwise specified, the main business revenue of the above types of enterprises must account for more than 70% of the total revenue of the enterprise.

(24) the western region highway national highway, provincial highway construction land, compared with the railroad, civil aviation construction land, exempted from cultivated land occupation tax. The scope of exemption from cultivated land occupation tax is limited to the cultivated land occupied by highway routes and side ditches on both sides of highway routes, and the cultivated land occupied by stockpiling yards, road-keeping road classes, checkpoints, engineering teams and car-washing yards along the highway routes are not exempted from the tax. The provincial people's government shall decide whether or not to exempt the land used for the construction of highways other than national highways and provincial highways from the cultivated land occupation tax. If the above tax-exempted land use is changed and no longer belongs to the tax-exempted scope, the arable land occupation tax shall be paid from the date of the change of use.

The use of rural collectively owned barren mountains, wasteland and other unused land for afforestation, grass and other ecological construction, can be contracted, leased, auctioned and other ways to obtain land use rights, the implementation of the land use rights for 50 years; land use rights can be inherited, transferred (rent), mortgage.
(XXVII) the implementation of strict protection of basic farmland, the realization of arable land balance. Sloping arable land is more areas, in order to protect the local food production capacity, without affecting the ecological construction of the premise, according to the overall land use planning, can be part of the years have been rectified, there are good water conservancy and soil and water conservation facilities of the slope of 15 degrees to 25 degrees of the arable land for basic farmland, but also some of the better supporting facilities of the new development of the finishing of the arable land designated as basic farmland. In accordance with the relevant regulations, the production pattern of basic farmland planting can be adjusted to develop cash crops, but the farming conditions shall not be destroyed. Land consolidation projects should be prioritized in the basic farmland protection zone, so that the effective area of farmland in the protection zone continues to increase, and the quality continues to improve. Increase the investment of the state in the development of land consolidation and reclamation in the western region. Provinces (autonomous regions and municipalities directly under the central government) in the western region to pay the central new construction land land use fees, in principle, through the arrangement of land development and consolidation projects to allocate the full amount. Developing unutilized land into grassland or garden land, which can be adjusted to arable land as determined by the relevant government authorities, can be offset against the index of supplementary arable land, and be protected and managed as arable land. Infrastructure construction occupies arable land, under the premise of ensuring the balance of arable land, the arable land reclamation fee can be charged according to the lower limit of the standard set by the provinces (autonomous regions and municipalities directly under the Central Government).
(xxviii) improve the efficiency of construction land approval, reduce the approval process, timely provision and protection of land for economic construction. Need to report to the State Council for approval of the construction of land, in the stage of land use approval, the competent government departments to review whether it is in line with the land use planning and planning, arable land balance and land acquisition compensation and resettlement can be implemented. The information submitted for approval can be simplified accordingly to the content of the examination. Compensation and resettlement for land requisition should be in accordance with the Land Management Law and other laws, so as to prevent all kinds of free-riding charges and protect the interests of farmers. The use of state-owned unutilized land can be exempted from paying land compensation fees. Unless otherwise provided for by law, land for construction projects shall be utilized in accordance with the law and state-owned land shall be used with compensation, and land shall be supplied by way of bidding and auction. Foreign-invested project land, really necessary, with the approval of the state-owned land use rights can be used for equity, capital contribution in the form of state-owned land use rights.
9, the implementation of preferential policies on mineral resources
