The administrative departments of population and family planning, health, food and drug supervision and administration, industry and commerce shall, according to their respective functions and duties, supervise and manage the non-medical need to identify the sex of the fetus and choose the sex for artificial termination of pregnancy. Article 5 People's governments at all levels and their relevant departments, social organizations, enterprises and institutions shall strengthen publicity and education on prohibiting non-medical needs to identify the sex of the fetus and choose sex for artificial termination of pregnancy.
Newspapers, radio, television, internet and other media should advocate social fashions such as gender equality and caring for girls, do a good job in public welfare propaganda, and keep the sex ratio of the birth population balanced.
Medical and health institutions and family planning technical service institutions shall set up eye-catching signs in relevant workplaces, and prohibit non-medical needs to identify the sex of the fetus and choose sex to artificially terminate pregnancy. Article 6 It is forbidden for any unit or individual to use ultrasonic technology and other technical means to identify the sex of the fetus for non-medical needs or to selectively terminate pregnancy artificially.
Medical and health care institutions and family planning technical service institutions shall not disclose the sex of the fetus during the physical examination of pregnant women and fetuses, and the inspection report shall not contain the content of the sex of the fetus.
It is forbidden for any unit or individual to use human assisted reproductive technology to select the sex of the fetus. The administrative departments of health, population and family planning shall strengthen the supervision and management of medical and health institutions and family planning technical service institutions to provide human assisted reproductive technical services. Seventh suspected fetal sex-linked genetic diseases need to be identified, it should be identified by the medical and health institutions designated and published by the health administrative department of the people's Government of the autonomous region. Non-designated and published medical and health institutions and any other unit or individual shall not carry out fetal sex identification.
The implementation of fetal sex identification for medical needs shall be collectively audited by an expert group composed of more than three medical and health institutions as stipulated in the preceding paragraph. If it is really necessary to terminate the pregnancy after diagnosis, the medical and health institution shall issue a medical diagnosis certificate and notify the population and family planning administrative department of the people's government at the county level that issued the "Birth Service Certificate". Eighth by the medical and health institutions designated by the administrative department of health of the people's Government of the autonomous region, if the fetus suffers from a sex-linked genetic disease, the pregnant woman may terminate her pregnancy artificially. Article 9 A woman who meets the statutory fertility conditions and is pregnant for more than 14 weeks may not terminate her pregnancy manually, except under any of the following circumstances:
(a) the fetus has serious defects or serious genetic diseases;
(2) The pregnant woman suffers from a serious illness, and the continuation of pregnancy will endanger her life safety or seriously endanger her health;
(three) the medical and health institutions designated by the health administrative department of the people's Government of the autonomous region need to terminate the pregnancy;
(four) divorce, widowhood and other requirements to terminate the pregnancy. Tenth medical and health institutions or family planning technical service institutions shall abide by the following provisions before carrying out artificial termination of pregnancy:
(a) under any of the circumstances specified in Items 1, 2 and 3 of Article 8 and 9, check my identity certificate and the medical diagnosis certificate issued by the medical and health institutions designated by the health administrative department of the people's government of the autonomous region or the medical and health institutions that carry out prenatal diagnosis at or above the county level;
(2) In case of the circumstances specified in Item 4 of Article 9, check my identity certificate and the certificate issued by the population and family planning administrative department of the county-level people's government or the family planning institution of the township (town) people's government or the subdistrict office. Eleventh artificial termination of pregnancy surgery should be carried out by qualified medical and health institutions or family planning technical service institutions.
Medical and health institutions or family planning technical service institutions that carry out artificial termination of pregnancy shall protect the privacy of the parties concerned according to law. Article 12 No unit or individual may forge or issue false certificates required for artificial termination of pregnancy. Article 13 Medical and health institutions shall, in accordance with regulations, carry out midwifery registration, report the registration situation in writing to the health administrative department of the local people's government at the county level every quarter, and send a copy to the population and family planning administrative department at the same level. Fourteenth the purchase of ultrasound diagnosis and chromosome detection equipment with the function of identifying the sex of the fetus shall be submitted for the record in accordance with the following provisions:
(a) the purchase of medical and health institutions, reported to the health administrative department of the people's government at the county level where the institution is located for the record;
(two) units and individuals outside the medical and health institutions to buy, reported to the local people's government at the county level population and family planning administrative departments for the record;
(3) The filing time is within 20 days from the date of purchase;
(four) the contents submitted for the record include the type, quantity, place of use and list of operators of the purchased equipment.
The administrative department of health or the administrative department of population and family planning shall, when accepting the record, inform the purchaser in writing of the relevant regulations and requirements for the management and use of equipment.
