Article 34 of the provincial and municipal people's government health department shall designate qualified medical institutions as AIDS clinical guidance medical institutions; county (city, district) people's government health department shall designate qualified medical institutions as AIDS diagnosis and treatment of medical institutions.
Designated clinical guidance, diagnosis and treatment of medical institutions must be equipped with AIDS diagnosis and treatment of equipment and technical force.
Article 35 The antiretroviral treatment, hospitalization and outpatient surgery, dialysis treatment, endoscopy, oral treatment and other invasive operations of HIV-infected persons and AIDS patients shall be attended to in the designated medical institutions. The designated medical institutions shall provide AIDS counseling, diagnosis and treatment services for HIV-infected persons and AIDS patients.
No medical institution shall shirk or refuse to treat a patient for other diseases because the patient is HIV-infected or AIDS patient.
Article 36 Medical institutions shall diagnose and treat HIV-infected patients and AIDS patients in accordance with the diagnostic and therapeutic standards.
The diagnosed HIV-infected persons and AIDS patients, by the provincial people's government, the competent health department trained and qualified medical personnel to inform the diagnosis results of his or her own, spouse or guardian, and to give medical guidance. Due to the needs of AIDS prevention and social security and other work, the competent health department may inform relevant departments such as civil affairs, education, public security, judicial administration and other relevant departments, and the relevant departments shall maintain confidentiality.
Article 37 HIV-infected persons and AIDS patients, by the usual place of residence of disease prevention and control institutions for medical management, the establishment of personal files, and regular medical follow-up.
Residents' committees and villagers' committees shall, under the guidance of the disease prevention and control institutions, carry out intervention work for people with risky behaviors susceptible to HIV infection, do a good job in the management and prevention of HIV-infected persons and AIDS patients, and create a friendly, understanding, and healthy living environment for HIV-infected persons and AIDS patients, and encourage them to adopt positive attitudes toward life and cooperate with examinations and treatments. The Government should also encourage them to adopt a positive attitude towards life and cooperate with the examination and treatment of HIV and AIDS patients. If a place of care has been established in the place of regular residence, HIV-infected persons may work, study and live in the place of care.
Article 38 The supervised persons in prisons, detention centers, drug addiction treatment centers, education centers, reeducation centers, labor reeducation centers and other supervisory places who are diagnosed to be HIV-infected, the supervisory unit shall, under the guidance of the local disease prevention and control agency, medically manage them in the supervisory place; however, for those who have already had the onset of the disease, the supervisory unit shall cooperate with the designated health care agency to The implementation of isolation treatment or apply in accordance with the law outside the prison (outside) execution.
When HIV-infected persons and AIDS patients are permitted to leave the place of supervision in accordance with the law, the supervisory unit shall promptly notify the competent health department of the people's government at or above the county level of the place of their domicile, as well as their immediate family members.
Article 39 of the daily disinfection of HIV-infected persons and AIDS patients, in accordance with the relevant provisions of the state. HIV-infected persons and AIDS patients die, their bodies should be cremated under the guidance of the disease prevention and control agencies in the place of death. Entry of foreigners, overseas Chinese and Hong Kong, Macao and Taiwan residents of HIV infection and AIDS patients in death, their bodies by the entry-exit inspection and quarantine departments responsible for supervising the cremation.
Article 40 HIV-infected persons and AIDS patients engaged in work may spread, spread AIDS, the competent health department shall promptly notify their units to adjust the work, the unit shall be notified to adjust their jobs immediately after receiving the notification, but shall not be dismissed from the employment or labor contract, and bear the responsibility of confidentiality of their illness and the reasons for the adjustment.
Article 41 No unit or individual shall discriminate against HIV-infected and AIDS patients and their relatives, or infringe upon or deprive them of the rights and interests they enjoy in accordance with the law in such areas as medical and health services, labor and employment, social security, marriage, study and participation in social activities.
Any unit or individual shall, in accordance with the law, maintain the confidentiality of persons infected with HIV and AIDS patients. Without the consent of the person or his or her guardian, no unit or individual shall disclose to the public the name, address, workplace, portrait, medical history and other information that may infer his or her specific identity of the person and his or her family members.
Article 42 HIV-infected persons and AIDS patients shall fulfill the following obligations:
(1) to accept epidemiological investigations, and to accept the treatment and medical guidance of medical and health institutions;
(2) when seeking medical treatment, to inform the receiving doctor of the fact that they are infected or ill in a truthful manner;
(3) before applying for marriage registration, to inform each other in a truthful manner of the fact of infection or illness, and to inform each other in a truthful manner of the fact that they are infected or ill. (c) Before applying for marriage registration, inform the other party of the facts of the infection or disease, and receive medical guidance at a healthcare institution;
(d) Inform the other party of the facts of the infection or disease beforehand if you have sexual relations with them;
(e) Learn about the prevention and treatment of AIDS and take the necessary protective measures to prevent infection of other people.
Article 43 No one shall threaten another person with blood or body fluids containing the AIDS virus.
No one shall intentionally spread AIDS in any way.
