Chapter IV of the Hubei Provincial Water Pollution Prevention and Control Regulations Water Pollution Control

Article 35 The water pollution prevention and control facilities of the construction project shall be designed, constructed and put into use at the same time with the main project, and pass the acceptance of the competent department for environmental protection. Water pollution prevention and control facilities have not been completed or not through the competent department for environmental protection acceptance, the construction project shall not be put into production or use.  Sewage disposal unit shall establish water pollution prevention and control facilities operation and management system to ensure that the normal operation of facilities and water pollutants discharged steadily up to the standard; shall not be removed without authorization, shut down or idle sewage treatment facilities. For maintenance and other reasons need to stop or partially stop the operation of sewage treatment facilities, shall obtain the consent of the competent department of environmental protection.  Article 36 The discharge of key water pollutants in industrial projects should be entered into development zones, industrial parks and other industrial clusters.  Development zones, industrial parks and other industrial clusters should be integrated planning, construction of centralized sewage treatment facilities, the implementation of industrial sewage treatment. Sewage disposal units of sewage pre-treatment of sewage discharged to the centralized sewage treatment facilities, should be in line with the centralized treatment facilities for the acceptance of standards.  Article 37 urban sewage shall be centralized treatment. People's governments at or above the county level shall, in accordance with urban drainage and sewage treatment planning, in accordance with the principle of rain and sewage diversion, clear drainage and sewage network, pumping stations, sewage treatment plants and other centralized sewage treatment facilities in towns and cities of the scale, layout, construction schedule and safeguards, and in the provincial people's government to complete the period specified by the people's government.  The development and construction of new urban areas shall be in accordance with the principle of planning before construction, priority arrangements for the construction of centralized drainage and sewage treatment facilities; the transformation of the old city shall be integrated planning and construction of sewage network and other centralized treatment facilities for urban sewage.  Article 38 The people's governments at or above the county level shall increase investment, strengthen urban drainage and sewage network construction, improve sewage collection and treatment rate, to ensure that the construction of urban drainage and sewage network and centralized sewage treatment facilities operating funds, sewage charges are not enough to pay the operating costs, should increase the level of financial subsidies.  The provincial people's government shall annually announce the construction, operation and discharge of centralized urban sewage treatment facilities of the people's governments of cities (states) and counties (cities and districts) in compliance with the standards; and encourage and support the completion of the construction of centralized urban sewage treatment facilities on schedule.  Article 39 The construction of garbage dumps, disposal yards and garbage treatment facilities shall take anti-seepage and other treatment measures. It is prohibited to construct garbage dumps, disposal yards and garbage disposal facilities in areas adjacent to surface water bodies and in flood discharge zones; if they have been constructed, they shall be ordered by the local people's government to be relocated within a certain period of time.  Article 40 Waste liquids generated by laboratories, testing laboratories and laboratories of medical institutions, schools, scientific research institutes and enterprises shall be collected separately and disposed of safely in accordance with the regulations, and it is prohibited to discharge them into drainage pipes or directly into water bodies.  The competent department for environmental protection shall, in accordance with the relevant provisions of the strengthening of laboratories, testing laboratories, laboratories waste liquid disposal supervision and management, to provide guidance for the relevant units in accordance with the law to dispose of waste liquids.  Article 41 The people's governments at all levels shall strengthen the construction of rural sewage treatment facilities, the villages that are not included in the urban sewage network of domestic sewage treatment, giving priority to the use of ecological, low-energy, resource-based sewage treatment technology; in the drinking water source protection zones, both sides of the river and other key areas of the villages, should be constructed sewage treatment facilities, and to ensure that the construction and operation of the funds.  Article 42 The departments in charge of transportation, environmental protection, agriculture (fisheries), tourism and other departments shall establish a joint mechanism for the enforcement of waterborne pollution prevention and control of ships, and implement the supervision of ship pollutants from ship to shore.  Ships should be configured in accordance with state regulations of the appropriate anti-fouling equipment and devices, the discharge of pollutants should be in line with the corresponding emission standards.  Ports, wharves, water service areas should be constructed ship oil sewage, domestic garbage shore reception and harmless treatment facilities, into the urban pipeline network or rural sanitation management.  Ships sailing or mooring in lakes and reservoirs with the function of drinking water sources shall use clean energy; for ships using gasoline, diesel and other fuels, restrictive measures shall be taken to phase out.  Article 43 The competent department of environmental protection of the provincial people's government shall, in conjunction with the competent department of water administration in the rivers, lakes, reservoirs, canals, cities (states), counties (cities, districts) at the junction of the surface water environment quality monitoring section, to determine the monitoring section of the water body of the water quality standards applicable to the water environment, and regular monitoring and release of monitoring information.  Rivers, lakes, reservoirs, canals upstream of the people's government must take measures to ensure that the water quality of the outbound section of the standard.  Article 44 across the city (state), county (city, district) of rivers, lakes, reservoirs, canals, the implementation of the junction cross-section water quality assessment system.  The higher people's government of the assessment of the city (state), county (city, district) people's government ordered rectification; the people's government must take effective measures to reduce the discharge of water pollutants, until the water quality of the border cross-section of the water quality standards, and to the downstream people's government of the affected areas to make compensation.  Specific assessment and compensation by the provincial people's government.  Article 45 The people's governments of the regions where the rivers, lakes, reservoirs and canals are located and their relevant departments shall establish a joint consultation system, cooperate with each other, *** enjoy the information, coordinate the prevention and control of water pollution in the cross-administrative regions, and prevent and dispose of water pollution incidents in the cross-administrative regions.  Disputes over water pollution in cross-administrative areas may be resolved through consultation by the people's governments concerned, or coordinated by the people's governments higher up in the same ****.  Article 46 The people's governments at or above the county level shall, in respect of watersheds and regions where water pollution is serious, delineate key regulatory areas, determine key regulatory industries and enterprises, formulate treatment plans, and remediate them in a limited period of time.  People's governments at or above the county level shall organize relevant departments to carry out water ecological environment survey, formulate restoration programs, take measures such as intercepting and treating sewage, dredging, transferring and diverting water, connecting rivers and lakes, wetland restoration, ecological protection belt construction, and other measures to carry out comprehensive management of water ecosystems, and to protect and restore water ecology.  Article 47 The people's governments at or above the county level and their relevant departments shall carry out groundwater pollution remediation work in areas where groundwater pollution is prominent such as solid waste stockpiling, landfills, mining, petrochemical industry production, and serious agricultural surface source pollution.  Article 48 The people's governments at or above the county level shall take financial support, skills training, transfer of employment, social security and other means to support the people's governments who have switched to other professions as a result of cleaning up aquaculture, livestock and poultry farming, and the implementation of the return of farmland to the lake, the return of fisheries to the lake, as well as ecological migrants, and other causes of switching to new professions.  Article 49 The people's governments at or above the county level shall develop the environmental protection market, through bidding, commissioning and other ways to purchase services from the community, to attract various types of market players to carry out water pollution prevention and control technology assessment, water pollution prevention and control facilities, construction and operation of water pollution control and water environment restoration and other environmental protection services, and to promote the prevention and control of water pollution market-oriented.
