Decision of the Standing Committee of the Shaanxi Provincial People's Congress on Amending the Regulations on Patriotic Hygiene of Shaanxi Province (2003)

I. Article 11 (3) of the Regulations is amended to read: "(3) The administrative department of construction or the administrative department of urban amenities and environmental sanitation is responsible for the supervision and management of environmental sanitation, and in accordance with the requirements of urban planning and the standards for the construction of urban environmental sanitation facilities the construction of centralized garbage disposal yards, the construction of new or remodeled public **** toilets, and the setting up of environmental sanitation containers and other environmental sanitation infrastructure, organizing the promotion of urban living garbage bagging, the implementation of the classification of garbage collection, transportation and harmless treatment, management of urban public **** toilets and harmless treatment of feces." Second, amend Article 14 of the regulations to read: "Citizens should abide by the public **** hygiene norms, and cultivate civilized and healthy public **** hygiene habits.

The following behaviors are prohibited in the city's streets, squares, green spaces, residential areas and other public **** places:

(a) spitting, defecation;

(b) indiscriminate dumping of garbage, sewage, feces, and littering of animal carcasses;

(c) carrying, walking the family dog defecate anywhere without cleaning up;

(d) littering of fruit and vegetable peels, packaging, paper, cigarette butts, chewing gum and other waste;

(E) smoking in non-smoking places;

(F) burning leaves, garbage or other waste in the open air or in garbage collection containers." Third, before the original article 28 of the regulations, add two articles, as article 28, article 29.

Article 28 provides that: "the urban people's government and its construction administrative departments or urban environmental sanitation administrative departments in accordance with urban planning requirements and urban environmental sanitation facilities construction standards for the construction of environmental sanitation infrastructure, by the higher people's government ordered to make corrections within a certain period of time, and given a notice of criticism, the failure to make corrections, by the people's government of the higher to pursue the administrative responsibility of responsible personnel. administrative responsibility of the responsible personnel."

Article 29 stipulates: "In case of violation of the provisions of paragraph 2 of Article 14 of these Regulations, the administrative department in charge of urban amenities and environmental sanitation shall order rectification, take remedial measures, clean up or remove, and give a warning in accordance with the severity of the case, and may impose a fine in accordance with the following provisions:

(a) Anyone who spits or drowns in the street shall be sentenced to a fine of not less than ten yuan Fifty yuan fine;

(b) littering garbage, sewage, feces, littering animal carcasses, individuals shall be sentenced to a fine of not less than twenty yuan to not more than two hundred yuan, and the unit shall be sentenced to a fine of not less than two hundred yuan;

(c) carry, walk the family dog feces and waste anywhere not to be cleaned up, shall be sentenced to a fine of not less than twenty yuan to not more than one hundred yuan;

(d) littered with fruit and vegetable peels, packaging, paper, cigarette butts, chewing gum and other waste, a fine of ten to twenty yuan;

(E) smoking in non-smoking places, a fine of ten yuan;

(F) burning leaves, garbage, or other waste in the open air or in the garbage collection containers, the individual shall be sentenced to a fine of ten to fifty yuan, and the unit of a fine of two hundred yuan to two thousand yuan. ." Fourth, the regulations of Article 34 amended to read: "violation of Article 16, Article 19, Article 23, paragraph 2 of the relevant provisions of these regulations, respectively, by the environmental protection, public security, agriculture, economic and trade departments in accordance with relevant laws and regulations shall be punished as Article 36."

This decision shall come into force on the date of publication.

"Shaanxi Provincial Patriotic Health Regulations" in accordance with this decision to make the corresponding changes, the order of the relevant provisions of the corresponding adjustments, re-published.
