Regulations on Traditional Chinese Medicine in Chongqing Municipality

Chapter I General Provisions Article 1 In order to inherit and promote traditional Chinese medicine, safeguard and promote the development of traditional Chinese medicine in this city, improve the health of citizens, according to the "Chinese People's Republic of China *** and the State of Traditional Chinese Medicine Law", "Chinese People's Republic of China *** and the State of basic medical care and health promotion law," and other laws and administrative regulations, in conjunction with the actual situation in this city, the formulation of these regulations. Article 2 The regulations shall apply to activities in the administrative area of the city engaged in the medical treatment, prevention, health care, rehabilitation, education, scientific research, industry, culture, external exchanges and related supervision and management of Chinese medicine. Article 3 The development of traditional Chinese medicine shall follow the laws of traditional Chinese medicine, inherit the essence of traditional Chinese medicine, maintain and give full play to the characteristics and advantages of traditional Chinese medicine, and promote the development of the theory and practice of traditional Chinese medicine. Adhere to the equal importance of Chinese and Western medicines, and support the complementary and coordinated development of Chinese and Western medicines. Article 4 The people's governments of cities and counties (autonomous counties) shall incorporate the cause of traditional Chinese medicine into national economic and social development planning, establish and improve the management system, service system and protection system in line with the characteristics of traditional Chinese medicine, incorporate the work of traditional Chinese medicine into the government's performance appraisal, and promote the cause of traditional Chinese medicine and the industry in a coordinated manner to promote the high-quality development.

The people's governments of cities and counties (autonomous counties) shall establish and improve the joint meeting system of traditional Chinese medicine, study the formulation and guidance for the implementation of policies and measures to promote the development of traditional Chinese medicine, and coordinate and solve the major problems of the development of traditional Chinese medicine in the administrative region.

Township people's governments and street offices shall provide support for the promotion and application of traditional Chinese medicine within their jurisdictions, and give full play to the role of traditional Chinese medicine in basic medical and health services. Article 5 the city, district and county (autonomous county) people's government departments in charge of traditional Chinese medicine is responsible for the administration of traditional Chinese medicine in the administrative region.

Cities, counties (autonomous counties) and other relevant departments shall do a good job in their respective areas of responsibility related to the management of traditional Chinese medicine. Article 6 Chinese medicine industry organizations should strengthen industry self-discipline, establish and improve industry norms, promote the construction of industry integrity system, play a role in technical advice, academic exchanges, guide and urge members to carry out their activities in accordance with the law. Article VII of the city to promote the culture of traditional Chinese medicine, popularize the knowledge of traditional Chinese medicine, and create a social atmosphere of concern and support for the development of traditional Chinese medicine.

Article VIII of the city, county (autonomous county) people's government in the cause of traditional Chinese medicine has made outstanding contributions to the organization and individuals, in accordance with the relevant provisions of the state and municipal level to give recognition, rewards. Chapter II Chinese medicine services and norms Article 9 municipal, district and county (autonomous county) people's governments shall strengthen the construction of Chinese medicine service system, in the planning of medical institutions, land development and utilization, medical equipment allocation to optimize and improve the layout of traditional Chinese medicine hospitals, support the development of medical institutions with characteristics and advantages of traditional Chinese medicine, and to provide guarantees for the access of citizens to traditional Chinese medicine services.

The people's governments of counties and districts (autonomous counties) shall not merge, withdraw, or change the nature of their Chinese medicine medical institutions without authorization. Indeed need to merge, withdrawal of government-organized medical institutions of traditional Chinese medicine or to change the nature of its traditional Chinese medicine, shall seek the views of the competent departments of traditional Chinese medicine at the next level. Article 10 city, county (autonomous county) people's government shall hold a suitable scale of modern comprehensive Chinese medicine hospital. County (autonomous county) people's government organized by the Chinese medicine hospital shall gradually reach the level of Grade 2A or above, city, district people's government organized by the Chinese medicine hospital shall gradually reach the level of Grade 3 hospital.

Government-organized general hospitals, maternity and child health care institutions and specialized hospitals with the conditions, should improve the mechanism of Chinese and Western medicine, set up Chinese medicine departments and a certain proportion of Chinese medicine beds, equipped with Chinese medicine practitioners, traditional Chinese medicine practitioners.

Community health service centers, township health centers should set up Chinese medicine integrated service area, reasonably equipped with Chinese medicine professionals and technicians.

District and county (autonomous county) people's governments shall strengthen community health service stations, village health center Chinese medicine equipment and facilities, and its practitioners to carry out regular technical training to enhance the capacity of Chinese medicine services. Article 11 encourages social forces to participate in the development of traditional Chinese medicine by organizing traditional Chinese medicine medical institutions in accordance with the law or donations, investment and other ways to meet the people's multi-level, diversified demand for medical services.

Social forces organized by the Chinese medical institutions in the access, practice, medical insurance designation, scientific research and teaching, title assessment of medical personnel to enjoy the same treatment as the government-organized Chinese medical institutions. Article XII of the city, county (autonomous county) departments in charge of traditional Chinese medicine shall integrate Chinese and Western medicine resources, promote the application of appropriate technology of traditional Chinese medicine, support general hospitals, specialized hospitals, women and children's health care institutions to establish a joint consultation system of Chinese and Western medicine, and promote the integration of the development of Chinese and Western medicine.

The Chinese medicine medical institutions should be based on Chinese medicine services, make full use of Chinese medicine technology and modern science and technology, to improve the diagnosis and treatment of critical illnesses, difficult and complex diseases and Chinese medicine superiority of the service capacity, and general hospitals *** with the assumption of social health care, emergency emergency medical care, prevention of disease, emergency response to health emergencies, etc., and provide diversified services for the community. Article XIII of the city, district and county (autonomous county) people's government shall support Chinese medicine hospitals to take the lead in the formation of sub-regional, hierarchical medical consortium, the implementation of hierarchical diagnosis and treatment system.

Cities, counties (autonomous counties) people's governments organized by the Chinese medicine hospitals should strengthen the region's primary health care institutions in the guidance of Chinese medicine services, to enhance the comprehensive medical level of primary health care institutions and the ability to provide Chinese medicine services.
