Article 29: People’s governments at or above the county level shall formulate emergency rescue plans for production safety accidents within their respective administrative regions and establish an emergency rescue system.
The emergency rescue plan for production safety accidents shall include the following contents:
(1) The command and coordination agency for emergency rescue;
(2) The relevant departments’ emergency response measures Responsibilities and division of labor in rescue;
(3) Emergency rescue organizations and their personnel and equipment;
(4) Emergency response, personnel evacuation, engineering rescue, medical first aid and other measures;
(5) Emergency measures for other accidents caused by production safety accidents;
(6) Funding guarantee and material reserves for emergency rescue.
Article 30: People’s governments at or above the county level shall arrange emergency rescue funds for production safety accidents and shall be guaranteed by the same level of finance.
Article 31: Production and business units shall establish emergency rescue organizations or equip emergency rescue personnel, and formulate emergency rescue plans for production safety accidents.
The emergency rescue plan for production safety accidents shall include the following contents:
(1) Emergency rescue organizations and their responsibilities;
(2) Emergency rescue plan activation procedures ;
(3) Emergency response measures;
(4) Funding guarantee and material reserves for emergency rescue.
Production and business units shall conduct emergency rescue plan drills for production safety accidents at least once a year.
Article 32: When a production safety accident occurs in a production and business operation unit, the relevant personnel at the accident site shall immediately report it to the person in charge of the unit.
After receiving the accident report, the person in charge of the production and operation unit shall take effective measures to organize rescue according to the emergency rescue plan, prevent the accident from expanding, and reduce casualties and property losses.
If it is really necessary to change the accident scene conditions when organizing rescue, on-site records should be kept.
Production and business units shall not conceal, tamper with, or destroy accident evidence, and shall not forge or destroy the accident scene.
Article 33 If a production safety accident occurs in a production and business operation unit, it shall immediately report to the local production safety supervision and management department and relevant departments. After receiving a report on a production safety accident, the production safety supervision and management department and relevant departments shall promptly report it in accordance with relevant regulations.
Production and business units, relevant people's governments, and departments responsible for the supervision and management of production safety shall not conceal or fail to report, make false reports, or delay in reporting production safety accidents.
Article 34: After receiving a report of a production safety accident, the people's government at or above the county level shall take effective measures to organize rescue according to the emergency rescue plan, prevent the accident from expanding, and reduce casualties and property losses.
Article 35: If a production safety accident occurs and a person is injured and needs medical treatment, the production and business unit where the accident occurred shall promptly send the injured person to a medical institution and advance the medical expenses. If advance payment cannot be made in time due to special circumstances, medical institutions shall not refuse rescue on this basis.
