Measures of People's Republic of China (PRC) Municipal Government for the Administration of Compulsory Verification of Measuring Instruments

Article 1 In order to meet the needs of socialist modernization, safeguard the interests of the state and consumers, safeguard people's health and the safety of life and property, and strengthen the management of measuring instruments for compulsory verification, these Measures are formulated in accordance with the provisions of Article 9 of the Metrology Law of People's Republic of China (PRC). Article 2 Compulsory verification refers to the fixed-point periodic verification of measuring instruments for trade settlement, safety protection, medical and health care and environmental monitoring, which are listed in the Catalogue of Measuring Instruments for Compulsory Verification in People's Republic of China (PRC) attached to these Measures, by the metrological verification institutions affiliated to or authorized by the metrological administrative department of the people's government at or above the county level.

These Measures are applicable to compulsory verification and the use of compulsory verification of working measuring instruments. Article 3 The metrological administrative departments of the people's governments at or above the county level shall uniformly supervise and manage the compulsory verification work within their respective administrative areas, and designate subordinate or authorized metrological verification institutions to perform compulsory verification tasks in accordance with the principle of economy, rationality and proximity. Article 4 The metrological verification institutions affiliated to the metrological administrative departments of the people's governments at or above the county level shall be equipped with the metrological standards and verification facilities required by the local people's governments to carry out national compulsory verification. Article 5 Units or individuals that use the work measuring instruments subject to compulsory verification must register the work measuring instruments they use in accordance with regulations, report them to the metrological administrative department of the local county (city) level people's government for the record, and apply for periodic verification to the metrological verification institution designated by them. If it cannot be verified locally, it shall apply to the metrological verification institution designated by the metrological administrative department of the people's government at the next higher level for periodic verification. Article 6 The period of compulsory verification shall be determined by the metrological verification institution that implements compulsory verification according to the metrological verification regulations. Article 7 No unit or individual may use measuring instruments that have not been applied for verification in accordance with the provisions of these Measures or are subject to compulsory verification. Article 8 The metrological administrative department of the State Council and the metrological administrative departments of the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government shall stipulate the verification period of all kinds of working measuring instruments subject to compulsory verification. The institution that implements compulsory verification shall complete the verification on time within the prescribed time limit. Article 9 Institutions that implement compulsory verification shall issue verification certificates and verification certificates uniformly prescribed by the state, or affix verification certificates to measuring instruments; If the verification is unqualified, it shall issue a notice of verification result or cancel the original seal and certificate that passed the verification. Article 10 The metrological administrative department of the people's government at or above the county level may, on the basis of the principle of facilitating management, production and use, and in combination with the actual situation in the region, authorize metrological verification institutions of relevant units to carry out compulsory verification within the prescribed scope. Eleventh institutions authorized to carry out compulsory verification tasks, their corresponding measurement standards, should accept the measurement standards or social public measurement standards; Personnel who perform compulsory verification must pass the examination by authorized units; Authorized units shall supervise their verification work. Article 12 When an institution authorized to carry out compulsory verification becomes a party to a measurement dispute, it shall handle it in accordance with the Detailed Rules for the Implementation of the Metrology Law of People's Republic of China (PRC) and the relevant provisions of the State Metrology Law. Thirteenth enterprises and institutions should strengthen the management of the use of measuring instruments for compulsory verification, and formulate corresponding rules and regulations to ensure that the verification is carried out in accordance with the cycle. Article 14 Units and individuals that use measuring instruments for compulsory verification, metrological supervision and management personnel who perform compulsory verification and metrological verification personnel who violate the provisions of these measures shall be investigated for legal responsibility in accordance with the detailed rules for the implementation of the Metrology Law of People's Republic of China (PRC) and the relevant provisions of the National Metrology Law. Fifteenth institutions that implement compulsory verification work, in violation of the provisions of Article 8 of these measures, delay the verification cycle, should arrange verification in time according to the requirements of the inspected units, and be free of verification fees. Article 16 The metrological administrative department of the State Council may, according to these Measures and the Catalogue of Measuring Instruments for Compulsory Verification in People's Republic of China (PRC), formulate a detailed catalogue of measuring instruments for compulsory verification. Seventeenth approach by the administrative department of measurement in the State Council is responsible for the interpretation of.
