Legal analysis: the crime of collusion in bidding, refers to the bidders colluding with each other to make tender offers, harming the interests of the bidders or other bidders, or the bidders and bidders colluding in bidding, harming the lawful rights and interests of the state, the collective and the citizens, and the circumstances of the seriousness of the behavior. Bidders colluding with each other to make tender offers, or bidders colluding with bidders to make tenders, suspected of one of the following circumstances, shall be prosecuted: (a) harming the bidder, the bidder, or the lawful interests of the state, the collective, or the citizens, and resulting in a direct economic loss amounting to more than five hundred thousand yuan; (b) the amount of unlawful proceeds amounting to more than one hundred thousand yuan; (c) winning the project in the amount of more than two million yuan; (d) taking the Threats, deception or bribery and other illegal means; (e) although the above amount does not reach the standard, but within two years for collusion in bidding, has been subjected to administrative punishment for more than two times, and collusion in bidding; (f) other cases of seriousness of the circumstances.
Legal basis: Article 223 of the Criminal Law If the bidders collude with each other in the bidding offer to the detriment of the bidder or other bidders, and the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall be sentenced to or punished by a single fine. The bidder and the bidder collusion bidding, damage to the legitimate interests of the state, collective, citizens, in accordance with the provisions of the preceding paragraph shall be punished.
